BOOK EXCERPT:
The past twenty-five years have brought a dramatic expansion of scholarship in maritime history, including new research on piracy, long-distance trade, and seafaring cultures. Yet maritime history still inhabits an isolated corner of world history, according to editors Lauren Benton and Nathan Perl-Rosenthal. Benton and Perl-Rosenthal urge historians to place the relationship between maritime and terrestrial processes at the center of the field and to analyze the links between global maritime practices and major transformations in world history. A World at Sea consists of nine original essays that sharpen and expand our understanding of practices and processes across the land-sea divide and the way they influenced global change. The first section highlights the regulatory order of the seas as shaped by strategies of land-based polities and their agents and by conflicts at sea. The second section studies documentary practices that aggregated and conveyed information about sea voyages and encounters, and it traces the wide-ranging impact of the explosion of new information about the maritime world. Probing the political symbolism of the land-sea divide as a threshold of power, the last section features essays that examine the relationship between littoral geographies and sociolegal practices spanning land and sea. Maritime history, the contributors show, matters because the oceans were key sites of experimentation, innovation, and disruption that reflected and sparked wide-ranging global change. Contributors: Lauren Benton, Adam Clulow, Xing Hang, David Igler, Jeppe Mulich, Lisa Norling, Nathan Perl-Rosenthal, Carla Rahn Phillips, Catherine Phipps, Matthew Raffety, Margaret Schotte.

BOOK EXCERPT:
The world is poised for another important transition. The United States is dealing with the impact of the Afghan and Iraq wars, the use of torture and secret detention, Guantanamo, climate change, nuclear proliferation, weakened international institutions, and other issues related directly or indirectly to international law. The world needs an accurate account of the important role of international law and The Power and Purpose of International Law seeks to provide it. Mary Ellen O'Connell explains the purpose of international law and the power it has to achieve that purpose. International law supports order in the world and the attainment of humanity's fundamental goals of peace, prosperity, respect for human rights, and protection of the natural environment. These goals can best be realized through international law, which uniquely has the capacity to bind even a superpower of the world. By exploring the roots and history of international law, and by looking at specific events in the history of international law, this book demonstrates the why and the how of international law and its enforcement. It directly confronts the notion that international law is "powerless" and that working within the framework of international law is useless or counter-productive. As the world moves forward, it is critical that both leaders and their citizens understand the true power and purpose of international law and this book creates a valuable resource for them to aid their understanding. It uses a clear, compelling style to convey topical, informative and cutting-edge information to the reader.

BOOK EXCERPT:
In many African countries, litigants experience significant uncertainty in their attempts to enforce foreign judgments. Drawing on the experiences of the United Kingdom and the United States (vis-à-vis efforts to attain an effective global legal framework on foreign judgments), this book undertakes a comparative analysis of how South African and Nigerian courts can promote the recognition and enforcement of foreign judgments in a fair manner. This comparative analysis is made considering both African countries as paradigms of their respective legal traditions. The author, a legal consultant and academic in private international law analyses, stage by stage, the challenging process that litigants face when they seek to enforce foreign judgments in South Africa and Nigeria. This analysis includes insightful consideration of broader issues such as the following: how challenges faced by judgment creditors may be circumvented; practical issues impeding the free movement of foreign judgments; impact of globalisation, increase in international commercial transactions, and regionalism on private international law; application of ‘fairness’; how territorial sovereignty and State interests in international commerce impede the free movement of foreign judgments; and ‘qualified obligation’, under which courts would presumptively enforce foreign judgments subject to certain exceptions and to the balancing of competing interests between private litigants and the State. The comparative analysis is undergirded by relevant case law – spanning decades in Africa and centuries in Europe and the United States. In summary, the author projects a clear case for predictability and certainty in the recognition and enforcement of foreign judgments, as well as how to go about it, thus offering lawyers a strategic position to weigh their options in contemplating enforcement of foreign judgments in any jurisdiction even beyond the African region. This innovative approach will also be of particular value to policymakers at national levels, international and regional economic organisations, as well as scholars in private international law and international commercial law generally. This is regardless of their specific legal area or niche, especially considering the dearth of literature in African private international law.
