The use of private property rights to regulate natural resources is a controversial topic because it touches upon two critical issues: the allocation of wealth in society and the conservation and management of limited resources. This book explores the extension of private property rights and market mechanisms to natural resources in international areas from a legal perspective. It uses marine fisheries to illustrate the issues that can arise in the design of regulatory regimes for natural resources. If property rights are used to regulate natural resources then it is essential that we understand how the law and values embedded within legal systems shape the development and operation of property rights in practice. The author constructs a version of property that articulates both the private and public function of property. This restores some much needed balance to property discourse. He also assesses the impact of international law on the use of property rights-a much neglected topic-and shows how different legal and socio-political values that inhere in different legal regimes fundamentally shape the construction of property rights. Despite the many claimed benefits to be had from the use of private property rights-based management systems, the author warns against an uncritical acceptance of this approach and, in particular, questions whether private property rights are the most suitable and effective arrangement of regulating of natural resources. He suggests that much more complex forms of holding, such as stewardship, may be required to meet physical, legal and moral imperatives associated with natural resources.

Property Rights in Land widens our understanding of property rights by looking through the lenses of social history and sociology, discussing mainstream theory of new institutional economics and the derived grand narrative of economic development. Written by a collection of expert authors, the chapters delve into social processes through which property relations became institutionalized and were used in social action for the appropriation of resources and rent. This was in order to gain a better understanding of the social processes intervening between the institutionalized ‘rules of the game’ and their economic and social outcomes.

Cass and Hylton explain how technological advances strengthen the case for intellectual property laws, and argue convincingly that IP laws help create a wealthier, more successful, more innovative society than alternative legal systems. Ignoring the social value of IP rights and making what others create “free” would be a costly mistake indeed.

Property Rights: Philosophic Foundations, first published in 1977, comprehensively examines the general justifications for systems of private property rights, and discusses with great clarity the major arguments as to the rights and responsibilities of property ownership. In particular, the arguments that hold that there are natural rights derived from first occupancy, labour, utility, liberty and virtue are considered, as are the standard anti-property arguments based on disutility, virtue and inequality, and the belief that justice in distribution must take precedence over private ownership. Lawrence Becker goes on to contend that there are four sound lines of argument for private property that, together with what is sound in the anti-property arguments, must be co-ordinated to form the foundations of a new theory. He therefore expounds a concise but sophisticated theory of property that is relevant to the modern world, and concludes by indicating some of the implications of his theory.

Animal Property Rights: A Theory of Habitat Rights for Wild Animals represents the first attempt to extend liberal property rights theory across the species barrier to animals. It broadens the traditional focus of animal rights beyond basic rights to life and bodily integrity to rights to the natural areas in which animal reside. John Hadley argues that both proponents of animal rights and environmentalists ought to support animal property rights because protecting habitat promotes ecological values and helps to ensure animals live free from human interference. Hadley’s focus is pragmatist – he locates animal property rights within the institution of property as it exists today in liberal democracies. He argues that attempts to justify animal property rights on labor and first occupancy grounds will likely fail; instead, he grounds animal property rights upon the importance of habitat for the satisfaction of animals’ basic needs. The potential of animal property rights as a way of reinvigorating existing public policy responses to the problem of biodiversity loss due to habitat destruction is thoroughly explored. Using the concept of guardianship for cognitively impaired human beings, Hadley translates habitat rights as a right to negotiate – human guardians ought to be allowed to negotiate, on behalf of wild animals, with human landholders whose development activities put animals at risk. In addition to a theory of animal property rights, Animal Property Rights affords a critique of Donaldson and Kymlicka’s wild animal sovereignty theory, a defence of indirect approaches to animal rights, an extensive discussion of euthanasia as a ‘therapeutic hunting’ tool, and the first discussion of Locke’s theory of original acquisition in animal rights literature.
