Rules And Laws In Sociology

eBook Download

BOOK EXCERPT:

Originally published in 1973, this book examines the difficulties which sociologists have in providing useful scientific definitions of terms like ‘prejudice’ and ‘discrimination’. The author argues that such notions are essentially dependent on the social policy adopted, and that their common misuse by sociologists reflects a deeper confusion – that between the sociologist’s search for social rules and regularities, and their search for social laws. The book clarifies the complex and important relationships between a scientific interest in the rule-oriented behaviour of people and a scientific interest in social laws about that behaviour. It explains how and why so many sociological inquiries lead to the discovery of mere social practices rather than social laws.

Symbolic Constitutionalization

eBook Download

BOOK EXCERPT:

The subject of this book is the social and political meaning of constitutional texts to the detriment of their legal concretization. Focusing on the discrepancy between the hypertrophically symbolic function of constitutions and their insufficient legal concretization, it offers a critical counterpoint to constitutional theory that treats constitutional texts as a panacea to solving political, legal, and social problems. In contrast to the premises of Niklas Luhmann's systems theory regarding law and constitution in world's society, symbolic constitutionalization is approached here in both a comprehensive and far-reaching perspective. Chapter 1 sets out the debate about symbolic legislation. Chapter 2 explains the notion of symbolic constitutionalization as a problem embracing the whole legal system. Chapter 3 approaches the issue in terms of allopoiesis of law, characterizing it primarily as a problem in peripheral modernity and referring to the Brazilian experience. The final chapter discusses the tendency to a symbolic constitutionalization of world society in the scope of a paradoxical peripheralization of the centre.

Trade Diplomacy Transformed Why Trade Matters For Global Prosperity

eBook Download

BOOK EXCERPT:

Trade Diplomacy Transformed: Why Trade Matters for Global Prosperity reveals how three major transformations over the past two centuries in how and why trade diplomacy is done have shaped the essential movement of goods, services, capital and labour across borders, as buyers and sellers meet in the global marketplace. Beginning with the intimately linked origins of diplomacy and international trade in ancient history, the narrative explores the tariff negotiations that first liberalized international trade in the nineteenth century, the emergence and growth of institutions like the European Union and the World Trade Organization, and the recent rapid explosion in the diplomacy of trade dispute resolution. In its provocative conclusion, Trade Diplomacy Transformed argues that, if it is to remain effective as a venue for the globe's trade diplomacy, the WTO must reform itself to become more like the EU.

Conflicts Of Law And Morality

eBook Download

BOOK EXCERPT:

Powerful emotion and pursuit of self-interest have many times led people to break the law with the belief that they are doing so with sound moral reasons. This study, a comprehensive philosophical and legal analysis of the gray area in which the foundations of law and morality clash, views these oblique circumstances from two perspectives: that of the person who faces a possible conflict between the claims of morality and law and must choose whether or not to obey the penal code; and that of the people who make and uphold laws and must decide whether to treat someone with a moral claim to disobey differently from ordinary lawbreakers. In examining the extent of the obligations owed by citizens to their government, Greenawalt concentrates on the possible existence of a single source of obligation that reaches all citizens and all laws. He also discusses techniques of amelioration of punishment for conscientious lawbreakers, asking how far legal systems should go to accommodate individuals who break the law for reason of conscience. Drawing from numerous examples of conflicts between law and morality, Greeawalt illustrates in detail the positions and predicaments of potential lawbreakers and lawmakers alike.
