All At Sea

eBook Download

BOOK EXCERPT:

The tale of (Louis R.) Harlan's transition from adolescence to manhood is related memorably in All at Sea: Coming of Age in World War II. Laced with vignettes depicting the author's naval mistakes, his escapades with and in pursuit of women, and his difficulty in returning to civilian life after the war, All at Sea is a welcome change of pace from more standard, stoic tales of wartime heroism. Harlan's frankness isn't limited to the details of his bouts with ineptitude as a young naval ensign. He also makes pointed observations about the importance of World War II compared to conflicts that have taken place since then, and about the evolution of his own racial attitudes as a product of the South suddenly thrown into settings in which he saw African Americans from a different perspective.

Oil In The Sea Iii

eBook Download

BOOK EXCERPT:

Since the early 1970s, experts have recognized that petroleum pollutants were being discharged in marine waters worldwide, from oil spills, vessel operations, and land-based sources. Public attention to oil spills has forced improvements. Still, a considerable amount of oil is discharged yearly into sensitive coastal environments. Oil in the Sea provides the best available estimate of oil pollutant discharge into marine waters, including an evaluation of the methods for assessing petroleum load and a discussion about the concerns these loads represent. Featuring close-up looks at the Exxon Valdez spill and other notable events, the book identifies important research questions and makes recommendations for better analysis ofâ€"and more effective measures againstâ€"pollutant discharge. The book discusses: Inputâ€"where the discharges come from, including the role of two-stroke engines used on recreational craft. Behavior or fateâ€"how oil is affected by processes such as evaporation as it moves through the marine environment. Effectsâ€"what we know about the effects of petroleum hydrocarbons on marine organisms and ecosystems. Providing a needed update on a problem of international importance, this book will be of interest to energy policy makers, industry officials and managers, engineers and researchers, and advocates for the marine environment.

Aboriginal Customary Law A Source Of Common Law Title To Land

eBook Download

BOOK EXCERPT:

Described as 'ground-breaking' in Kent McNeil's Foreword, this book develops an alternative approach to conventional Aboriginal title doctrine. It explains that aboriginal customary law can be a source of common law title to land in former British colonies, whether they were acquired by settlement or by conquest or cession from another colonising power. The doctrine of Common Law Aboriginal Customary Title provides a coherent approach to the source, content, proof and protection of Aboriginal land rights which overcomes problems arising from the law as currently understood and leads to more just results. The doctrine's applicability in Australia, Canada and South Africa is specifically demonstrated. While the jurisprudential underpinnings for the doctrine are consistent with fundamental common law principles, the author explains that the Australian High Court's decision in Mabo provides a broader basis for the doctrine: a broader basis which is consistent with a re-evaluation of case-law from former British colonies in Africa, as well as from the United States, New Zealand and Canada. In this context, the book proffers a reconceptualisation of the Crown's title to land in former colonies and a reassessment of conventional doctrines, including the doctrine of tenure and the doctrine of continuity. 'With rare exceptions ... the existing literature does not probe as deeply or question fundamental assumptions as thoroughly as Dr Secher does in her research. She goes to the root of the conceptual problems around the legal nature of Indigenous land rights and their vulnerability to extinguishment in the former colonial empire of the Crown. This book is a formidable contribution that I expect will be influential in shifting legal thinking on Indigenous land rights in progressive new directions.' United Nations Naval Peace Operations In The Territorial Sea

eBook Download

BOOK EXCERPT:

This book examines UN naval peace operations, addressing the construction and assessment of authority with respect to a range of acts essential to the conduct of such operations. The focus is particularly upon operations as they relate to and impact upon the Territorial Sea. Within a conceptual approach emphasising the interaction of power and legitimation in the construction of authority, naval peace operations issues such as Innocent Passage, interdiction operations, and transitional administration are considered. The book concludes by proposing a conceptually and operationally sensitive approach to constructing authority for the conduct of UN naval peace operations in the Territorial Sea.

Adapting To Sea Level Rise In The Coastal Zone

eBook Download

BOOK EXCERPT:

For as long as humans have been inhabiting coastal areas and recording what occurs in their environments, coastal zones have been defined through dynamic interactions. And this is further underlined by a more recent development: observed sea level rise. In a thorough but not overly technical approach, Adapting to Sea Level Rise in the Coastal Zone: Law and Policy Considerations provides a legal-policy framework for facing the challenges of sea level rise. The book includes an analysis of sea level rise adaptation strategies that examines the legal impacts of coastal land use decisions based on the current interpretation of private property rights in relation to public control over those rights. The author discusses the science behind sea level rise and highlights policy complexities and options. He then presents an overview of related legalities, and bringing it all together, applies the principles offered in the book, concluding with strategies and solutions and a perspective on the future. If we accept the premise that sea level rise is occurring and will continue for the foreseeable future, then we must begin to consider policy responses to this risk in coastal regions. Part of any pragmatic policy response must include a review of the options available to public institutions when developing and implementing rational adaptation policies. This book offers practical legal/policy approaches to sea level rise adaptation that promotes sound planning in the face of climate change and rising seas.

A World At Sea

eBook Download

BOOK EXCERPT:

The past twenty-five years have brought a dramatic expansion of scholarship in maritime history, including new research on piracy, long-distance trade, and seafaring cultures. Yet maritime history still inhabits an isolated corner of world history, according to editors Lauren Benton and Nathan Perl-Rosenthal. Benton and Perl-Rosenthal urge historians to place the relationship between maritime and terrestrial processes at the center of the field and to analyze the links between global maritime practices and major transformations in world history. A World at Sea consists of nine original essays that sharpen and expand our understanding of practices and processes across the land-sea divide and the way they influenced global change. The first section highlights the regulatory order of the seas as shaped by strategies of land-based polities and their agents and by conflicts at sea. The second section studies documentary practices that aggregated and conveyed information about sea voyages and encounters, and it traces the wide-ranging impact of the explosion of new information about the maritime world. Probing the political symbolism of the land-sea divide as a threshold of power, the last section features essays that examine the relationship between littoral geographies and sociolegal practices spanning land and sea. Maritime history, the contributors show, matters because the oceans were key sites of experimentation, innovation, and disruption that reflected and sparked wide-ranging global change. Contributors: Lauren Benton, Adam Clulow, Xing Hang, David Igler, Jeppe Mulich, Lisa Norling, Nathan Perl-Rosenthal, Carla Rahn Phillips, Catherine Phipps, Matthew Raffety, Margaret Schotte.
