Taking Law Seriously

eBook Download

BOOK EXCERPT:

This book celebrates the scholarship of Peter Cane. The significance and scale of his contributions to the discipline of law over the last half-century cannot be overstated. In an era of increasing specialisation, Cane stands out on account of the unusually broad scope of his interests, which extend to both private and public law in equal measure. This substantive breadth is combined with remarkable doctrinal, historical, comparative and theoretical depth. This book is written by admirers of Cane's work, and the essays probe a wide range of issues, especially in administrative law and tort law. Consistently with the international prominence that Cane's research has enjoyed, the contributors are drawn from across the common law world. The volume will be of value to anyone who is interested in Cane's towering contributions to legal scholarship and administrative law and tort law more generally.

Exceeding Reason

eBook Download

BOOK EXCERPT:

The work of the later Schelling (in and after 1809) seems antithetical to that of Nietzsche: one a Romantic, idealist and Christian, the other Dionysian, anti-idealist and anti-Christian. Still, there is a very meaningful and educative dialogue to be found between Schelling and Nietzsche on the topics of reason, freedom and religion. Both of them start their philosophy with a similar critique of the Western tradition, which to them is overly dualist, rationalist and anti-organic (metaphysically, ethically, religiously, politically). In response, they hope to inculcate a more lively view of reality in which a new understanding of freedom takes center stage. This freedom can be revealed and strengthened through a proper approach to religion, one that neither disconnects from nor subordinates religion to reason. Religion is the dialogical other to reason, one that refreshes and animates our attempts to navigate the world autonomously. In doing so, Schelling and Nietzsche open up new avenues of thinking about (the relationship between) freedom, reason and religion.

Engaging Buddhism

eBook Download

BOOK EXCERPT:

This is a book for scholars of Western philosophy who wish to engage with Buddhist philosophy, or who simply want to extend their philosophical horizons. It is also a book for scholars of Buddhist studies who want to see how Buddhist theory articulates with contemporary philosophy. Engaging Buddhism: Why it Matters to Philosophy articulates the basic metaphysical framework common to Buddhist traditions. It then explores questions in metaphysics, the philosophy of mind, phenomenology, epistemology, the philosophy of language and ethics as they are raised and addressed in a variety of Asian Buddhist traditions. In each case the focus is on philosophical problems; in each case the connections between Buddhist and contemporary Western debates are addressed, as are the distinctive contributions that the Buddhist tradition can make to Western discussions. Engaging Buddhism is not an introduction to Buddhist philosophy, but an engagement with it, and an argument for the importance of that engagement. It does not pretend to comprehensiveness, but it does address a wide range of Buddhist traditions, emphasizing the heterogeneity and the richness of those traditions. The book concludes with methodological reflections on how to prosecute dialogue between Buddhist and Western traditions. "Garfield has a unique talent for rendering abstruse philosophical concepts in ways that make them easy to grasp. This is an important book, one that can profitably be read by scholars of Western and non-Western philosophy, including specialists in Buddhist philosophy. This is in my estimation the most important work on Buddhist philosophy in recent memory. It covers a wide range of topics and provides perhaps the clearest analysis of some core Buddhist ideas to date. This is landmark work. I think it's the best cross-cultural analysis of the relevance of Buddhist thought for contemporary philosophy in the present literature."-C. John Powers, Professor, School of Culture, History & Language, Australian National University

Human Rights And Public Goods

eBook Download

BOOK EXCERPT:

This powerful and empowering text offers a way forward for alleviating human suffering, presenting a realistic roadmap for enhanced global governance that can create workable solutions to mass poverty. William Felice and Diana Fuguitt emphasize the critical links between international human rights law, international political economy, and global organizations to formulate effective public policy to alleviate human suffering and protect basic human rights for all. They introduce students to the key legal and economic concepts central to economic and social human rights, including the right to education, a healthy environment, food, basic health care, housing, and clean water. They analyze the legal approaches undertaken by the United Nations and explain the key theories of international political economy (including liberalism, nationalism, and structuralism) and central economic concepts (including global public goods, economic equality, and the capabilities approach). In the last decade, a backlash against economic globalization has been fueled by a variety of politicians around the world. A resurgent nationalism is often pitted against international organizations and frameworks for global cooperation. In this new edition, Felice and Fuguitt account for how the current global political climate has affected national and global policies for the provision of public goods and the protection of human rights. They focus on practical policies and actions that both state and nonstate actors can take to uphold economic and social rights. As the first book to integrate these legal and economic approaches, it provides a practical path to action for students, academics, and policy makers alike.
