This book deals with expropriation and other measures affecting property rights as set out in the awards of the Iran-U.S. Claims Tribunal, and thus examines the relation between general international law and the lex specialis, viz., the provisions of the Algiers Declarations and the Treaty of Amity between the Governments of Iran and the United States. It studies what rights have been considered as property rights capable of being independently expropriated or affected by other measures, and what rights have not been so qualified, although they might have been considered as forming an element of valuation. Furthermore, the liability and attributability issues are discussed, as are the methods of compensation and of valuation.

The purpose of this book is to describe the problems posed in the formulation of international rules for bays at the present time, to investigate the history of the several interests that have influenced the development of such rules, to trace the efforts that have been made to codify the rules, and to suggest a further refinement of the rules. This book seeks to combine the fruits of the writer's experience as a navigator with those of his studies in international law, geography, history and economics. Although, after study and thought upon the subject, there is likely to arise an initial desire to write a work that is truly definitive, one must resign himself to something of lesser scope. That being so, there is, if anything, an increased demand upon the writer to exercise careful judgment in his research, and in his exposition of the subject. This writer can only hope that he has discharged this responsi bility to the degree that his efforts will have clarified some issues and that what he has set on paper may be of some assistance to others. Codified in the 1899 and 1907 Hague Peace Conferences and later modified by the 1949 Fourth Geneva Convention, the traditional international law of occupation has been challenged by advocates of human rights and self- determination and tested by the numerous occupations of the last two decades--among them Israeli occupation of the West Bank and Gaza, Turkish occupation of Northern Cyprus, the Vietnamese occupation of Cambodia, U.S. operations in Grenada and Panama, and occupations during the Persian Gulf crisis.
