What did it mean to be a wife, woman, or slave in a society in which a land-owning woman was forbidden to lay with her male slave but the same slave might be allowed to take concubines? Jurists of the nascent Maliki, Hanafi, and Shafi‘i legal schools frequently compared marriage to purchase and divorce to manumission. Juggling scripture, precedent, and custom on one hand, and the requirements of logical consistency on the other, legal scholars engaged in vigorous debate. The emerging consensus demonstrated a self-perpetuating analogy between a husband’s status as master and a wife’s as slave, even as jurists insisted on the dignity of free women and, increasingly, the masculine rights of enslaved husbands. Marriage and Slavery in Early Islam presents the first systematic analysis of how these jurists conceptualized marriage—its rights and obligations—using the same rhetoric of ownership used to describe slavery. Kecia Ali explores parallels between marriage and concubinage that legitimized sex and legitimated offspring using eighth- through tenth-century legal texts. The concept of jihad holds a prominent place in Islamic thought and history. Beyond its spiritual meanings, the term has historically been associated with the sweeping Arab-Believers conquests of the 7-8th century BCE. But given advances in our understanding of the historicity and chronology of the Qur'an and early Islamic texts, is it correct to identify jihad and Islam with violent conquest? In this book, Marco Demichelis explores the history of the concept of jihad in the early proto-Islamic centuries (7-8th). Deploying an interdisciplinary approach which combines the hermeneutical study of the famous 'Verses of the Sword' within the Qur'an itself, with historical writing by Islamic chroniclers as well as non-Islamic sources, numismatics, epigraphical and architectural evidence, the book questions the relationship between the religious concept of jihad and the conquests. The book argues that Christian Byzantine Foederati forices who previously fought against the Persians may have had a formative effect on the later emergence of more bellicose rhetoric. In so doing, it calls into question assumptions about warlike attitudes inherent within Islamic doctrine, and reveals a more nuanced and complicated history of religious violence in the pre, proto and early Islamic period.

This volume studies how the literary elements in the Qur'an function in conveying its religious message effectively. It is divided into three parts. Part one includes studies of the whole Qur'an or large segments of it belonging to one historical period of its revelation; these studies concentrate on the analysis of its language, its style, its structural composition, its aesthetic characteristics, its rhetorical devices, its imagery, and the impact of these elements and their significance. Part two includes studies on individual suras of the Qur'an, each of which focuses on the sura's literary elements and how they produce meaning; each also explores the structure of this meaning and the coherence of its effect. Part three includes studies on Muslim appreciations of the literary aspects of the Qur'an in past generations and shows how modern linguistic, semantic, semiotic, and literary scholarship can add to their contributions.
