Zu Wort kommen ExpertInnen und JournalistInnen aus Indonesien und Österreich, unter anderem auch hochrangige religiöse Führungspersönlichkeiten der zwei größten muslimischen Vereinigung Indonesiens. Der Sammelband bietet damit einen interessanten Ansatz zur aktuellen Diskussion über die Präsenz und Partizipation von MuslimInnen in Europa und macht die Notwendigkeit des Erfahrungsaustausches – insbesondere um den Herausforderungen der Globalisierung gerecht zu werden – deutlich.Dieser Band vereint Beiträge des Symposiums »State, Law and Religion in Pluralistic Societies – Austrian and Indonesian Perspectives«, das Ende Mai 2009 in Wien vom österreichischen und dem indonesischen Außenministerium in Kooperation mit der Rechtswissenschaftlichen Fakultät der Universität Wien organisiert wurde. This volume focuses on issues that have only recently come to the forefront of the discipline such as freedom from religion, ordination of homosexuals, apostasy, security and fundamentalism, issues that are linked to the common themes of secularism and globalization. Although these subjects are not new to the academic debate, they have become prominent in law and religion circles as a result of recent and rapid changes in society. The essays in this volume present multiple points of view, facilitate scholars in understanding this evolving discipline and act as a stimulus for further research.This collection gives the reader a sense of the key topics and current debates in law and religion and is of interest to law, politics, human rights, and religion scholars.

The relationship between law and religion is evident throughout history. They have never been completely independent from each other. There is no doubt that religion has played an important role in providing the underlying values of modern laws, in setting the terms of the relationship between the individual and the state, and in demanding a space for the variety of intermediate institutions which stand between individuals and the state. However, the relationships between law and religion, and the state and religious institutions differ significantly from one modern state to another. There is not one liberalism but many. This work brings together reflections upon the relationship between religion and the law from the perspectives of different sub-traditions within the broader liberal project and in light of some contemporary problems in the accommodation of religious and secular authority.

This book examines law and religion from the perspective of its case law. Each chapter focuses on a specific case from a Commonwealth jurisdiction, examining the history and impact of the case, both within the originating jurisdiction and its wider global context. The place of the Law and its relationship to religious observance and faith is a contested topic in the study of both the Old and New Testament. In Law and Religion, members of the Erhardt Seminar group provide an insight into the debate, probing key topics and offering new contributions to the subject. Their essays are grouped into three sections, focussing in turn on the Law’s place in Israelite religion, in the Jesus tradition, and in Paul and the Apostolic tradition. Thus, the foundation of the connection between law and religion in ancient Israel is explored, along with the decisive influence of the Deuteronomic reform and the radical new understanding now emerging of the later development in Judaism of the New Testament Period. This book examines the question of how the mode of state–religion identification affects the state’s scope for compliance with human rights law. It presents a human rights-based assessment of the various modes of state–religion identification and of the various forms of state practice that surround and characterize these different state–religion models. A close assessment of norms of human rights law substantiates that, although human rights law on the face of it is seemingly neutral to the issue of state–religion identification, legal principles can be extrapolated that have a profound bearing on the question of legitimacy of the possible diverse relationships that may exist between the state and religion. A range of thematic case studies on, among other issues, Establishment of Religion & the ‘Equal Religious Rights of Others’, Religion & Freedom of Expression, Religion & Political Rights, Religion & Educational Rights, Religion & Freedom of Association and Religion & Equal Employment Opportunities, demonstrates that existing regimes of positive state identification with religion are not devoid of forms of institutionalised discrimination and de facto practices of discrimination on grounds of religion or belief (or lack thereof). At the same time, it is observed by the author that in some secular or separationist states the ideals of state secularism and separationism have come to be considered ends in themselves. This has given rise to situations where the principles of secularism and separationism are construed so as to impose illegitimate limits on the activities of religions or illegitimate limits on the individual manifestation of certain beliefs. This book makes a case for the recognition of a state duty to remain impartial with respect to religion or belief in all regards so as to comply with people’s fundamental right to be governed, at all times, in a religiously neutral manner.
