This book analyzes William of Ockham's early theory of property rights alongside those of his fellow dissident Franciscans, paying careful attention to each friar's use of Roman and civil law, which provided the conceptual building blocks of the poverty controversy.

William of Ockham's (ca. 1288-1347) Opus nonaginta dierum has long been of interest to historians for his theory of rights. Yet the results of this interest has been uneven because most studies do not take sufficient account of the defences of Franciscan poverty already articulated by his fellow Franciscans, Bonagratia of Bergamo, Michael of Cesena, and Francis of Marchia. This book therefore presents and analyzes Ockham's account of property rights alongside those of his confreres. This contextualization of Ockham’s theory corrects many misconceptions about his theory of property, natural law, and natural rights, and therefore also provides a new foundation for studies of his political oeuvre, intellectual development, and significance as a political theorist.

Rights language is a fundamental feature of the modern world. Virtually all significant social and political struggles are waged, and have been waged for over a century now, in terms of rights claims. In some ways, it is precisely the birth of modern rights language that ushers in modernity in terms of moral and political thought, and the struggle for a modern way of life seems for many synonymous with the fight for a universal recognition of equal, individual human rights. Where did modern rights language come from? What kinds of rights discourses is it rooted in? What is the specific nature of modern rights discourse; when and where were medieval and ancient notions of rights transformed into it? Can one in fact find any single such transformation of medieval into modern rights discourse? In a wide arc from the Paleolithic to the present day, this book explores the changing structure of human experience and its impact on the dynamics of cultures, civilizations, and political ideas. The main thesis is a paradigm shift: the structure of human experience is not a universal constant but changes over time. The Knight's Tale is one of the most controversial of all the Canterbury Tales. Does Chaucer portray Theseus, the duke of Athens whose actions dominate the tale, as an ideal ruler, one who is noble, wise and chivalrous, or does the duke's behaviour reveal him to be immoral, self-seeking and tyrannical? This book (now in a corrected second printing) assesses the duke's conduct and thought in terms of the ideals set out in medieval mirrors for princes, particularly in Giles of Rome's De Regimine Principum. It argues that, when judged by the standards of these works, Theseus can be seen as a model prince in terms of his self-government ('ethics'), his rule of his household ('economics'), his governance of his realm ('politics) and his cosmography and philosophy.

In this historical study, Jonathon D. Beeke considers the various sixteenth- and seventeenth-century Reformed expressions regarding the duplex regnum Christi (the twofold kingdom of Christ), or, as especially denominated in the Lutheran context, the “doctrine of the two kingdoms.” While a sampling of patristic and medieval sources is considered, the focus is on select magisterial Reformers of the sixteenth century and representative intellectual centers of the seventeenth century (Leiden, Geneva, and Edinburgh). A primary concern is to examine the development of these formulations over the two centuries in question, and relate its maturation to the theological and political context of the early modern period.
