Aristotle S Ethics And Legal Rhetoric

eBook Download

BOOK EXCERPT:

Taking the novel position of dealing with law, classical rhetoric and feminism concurrently, this book considers the effects of beliefs about language on those who attempt to theorize about and use law to accomplish practical and political purposes. The author employs Aristotle's terminology to analyze economic and literary schools of thought in the US legal academy, noting the implicit language theory underlying claims by major thinkers in each school about the nature of law and its relationship to justice. The underlying assumption is that, as law can only work through language, beliefs about its relationship to justice are determined by assumptions about the nature of language. In addition, the author provides an alternative, feminist rhetoric that, being focused on the production of texts rather than their interpretation, offers a practical ethic of intervention.

Aristotle On Emotions In Law And Politics

eBook Download

BOOK EXCERPT:

In this book, experts from the fields of law and philosophy explore the works of Aristotle to illuminate the much-debated and fascinating relationship between emotions and justice. Emotions matter in connection with democracy and equity – they are relevant to the judicial enforcement of rights, legal argumentation, and decision-making processes in legislative bodies and courts. The decisive role that emotions, feelings and passions play in these processes cannot be ignored – not even by those who believe that emotions have no legitimate place in the public sphere. A growing body of literature on these topics recognizes the seminal insights contributed by Aristotle. This book offers a comprehensive analysis of his thinking in this context, as well as proposals for inspiring dialogues between his works and those written by a selection of modern and contemporary thinkers. As such, the book offers a valuable resource for students of law, philosophy, rhetoric, politics, ethics and history, but also for readers interested in the ongoing debate about legal positivism and the relevance of emotions for legal and political life in today’s world.

Aristotle S Practical Side

eBook Download

BOOK EXCERPT:

This volume focuses on Aristotle’s practical philosophy. His analysis of emotional response takes pride of place. It is followed by discussion of his moral psychology: the division of the human soul into emotional and deliberative parts. Moral virtue is studied in relation to emotion, and animals are shown to lack both emotion and virtue. Different kinds of friendship are analyzed, and the effects of vehemence, i.e., temperament are given special attention. Aristotle’s justification for assigning natural slaves and women subordinate roles receives detailed consideration. The same is true of his analysis of correct and incorrect constitutions. Finally, persuasion is taken up from several angles including Aristotle’s emphasis on the presentation of character and his curious dismissal of delivery in speech.

Notes To Aristotle S Ethics Classic Reprint

eBook Download

BOOK EXCERPT:

Excerpt from Notes to Aristotle's Ethics IT is not my purpose in this edition to set forth a complete system of moral philosophy, or to compare and reconcile dif ferent views, but simply to assist the student of the Ethics in understanding Aristotle's meaning, and in following his arguments in the book before us. There is, indeed, scarcely a page of the work which might not have served as a peg on which to hang a dissertation on some point of the theory and practice of morals; but to do so would have interfered with, rather than furthered, my main aim: and I have therefore ah stained from general disquisitions, and have neither referred to ancient systems of philosophy, except where Aristotle's meaning would have been obscure without such reference nor to modern views, except where they directly illustrate, in more familiar language, and thus enable us more completely to apprehend what Aristotle meant to say. And this was the less necessary, as I believe what I have left undone will be performed by able hands. I wish rather to guide students, as far as I am able, to an understanding of what Aristotle says, before they proceed to compare him with, or judge him by, what has been advanced by those who went before or came after him, I am sure that he who carefully and patiently studies his ethical writings, (in which I would include the Rhetoric, ) will gain a knowledge of many of the secrets of man' s%ature, as it practically exists, and of men as they practically act, which will be found of great service, as well in the abstract study of the subject, as in practical dealing with, or guidance of, men. For Aristotle, looking with a curious and careful eye on the realities of human life, saw the elements of man's nature, the motives and springs of action. Essays On Aristotle S Rhetoric

eBook Download

BOOK EXCERPT:

Essays on Aristotle's Rhetoric offers a fresh and comprehensive assessment of a classic work. Aristotle's influence on the practice and theory of rhetoric, as it affects political and legal argumentation, has been continuous and far-reaching. This anthology presents Aristotle's Rhetoric in its original context, providing examples of the kind of oratory whose success Aristotle explains and analyzes. The contributors—eminent philosophers, classicists, and critics—assess the role and the techniques of rhetorical persuasion in philosophic discourse and in the public sphere. They connect Aristotle's Rhetoric to his other work on ethics and politics, as well as to his ideas on logic, psychology, and philosophy of language. The collection as a whole invites us to reassess the place of rhetoric in intellectual and political life.
