Armed conflict and military activities have serious adverse impacts on the environment. Modern weaponry, troop movements, landmines, hazardous military waste, and the destruction of forests for military use are a few sources of harm to the environment both during armed conflict and peacetime military activities. Ecological assaults in combat areas are often kept a secret by the government, resulting in even greater humanitarian and environmental harm. Environmental degradation is increasingly being recognized as one of the most significant challenges of the 21st century and its effects are being felt worldwide. Both domestic and international legislations have been inadequate in mitigating the impact of military activities. This book provides details of the environmental destruction wreaked during international and non-international armed conflicts and argues that the existing legal regime for the protection of the environment during armed conflict requires substantial modification. It puts forward the view that though it is inconceivable to impose an absolute ban on environmental damage during military operations, strengthening and clarifying the existing laws protecting the environment in times of conflict, and enforcing environment-friendly practices among military forces could go a long way in protecting natural assets of our earth.

Animals are the unknown victims of armed conflicts. Wildlife populations usually decline during warfare, with disastrous repercussions on the food chain, on fragile ecosystems and precarious habitats. Belligerents take advantage of the chaos of war for poaching and trafficking of animal products. Livestock, companion, and zoo animals, highly dependent on human care, are direct victims of hostilities. The book is the first legal analysis of these issues. It maps the framework of international humanitarian law, examining which and how the concepts, principles, and rationales can be applied and adapted for a better protection of animals. The contributions inter alia discuss precautions for animal civilians, problems of animal combatants and prisoners, a specific status for veterinarian personnel, the recognition of biodiversity hotspots as specially protected zones, and the potential of enforcement mechanisms. The concluding chapter draws together novel interpretations and reform proposals.

This timely study examines how the environmental impact of modern warfare violates fundamental principles of international environmental and humanitarian laws and why these consideration need to be included in rules of armed conflict. If direct attacks on innocent civilians are universally recognized as unacceptable then environ-mental devastation of their habitat by acts of war must also be recognized as an unacceptable consequence of armed conflict. This collection addresses the impact of armed conflict and explores pathways to peace across the world. Topics range from geopolitics to the effects of armed conflict on the environment, resources, health, children, and transnational migration. Others explore the social processes involved in post-conflict situations, and others still the lessons for achieving effective peace. The geographical concepts addressed include the notion of "conflict space," landscapes of terror, the relationship between violence and justice, the conditions for peace, and the dynamics of post-conflict. Methods include landscape analysis, interviews with a range of citizens, mapping and geographic information science, and policy analysis. Several papers address the situation of children in conflict zones, the impact of conflict on patterns of migration, the role of gender in achieving peace, the concept of territory as a basis for conflict and for negotiation of peace, as well as the economic impact of conflict. The studies cover several world regions, including Africa, the Middle East, South and Southeast Asia, and eastern Europe. This book provides an empirically formulated foundation for conflict-sensitive conservation, a field in which the existing literature relies primarily on anecdotal evidence. Seeking to better understand the impact of conflict on the implementation and outcomes of environmental projects, the Global Environment Facility (GEF) Independent Evaluation Office and the Environmental Law Institute undertook an evaluation of GEF support to fragile and conflict-affected contexts. Following a qualitative and quantitative analysis of documents from more than 4,000 projects, the research team discovered a statistically significant negative correlation between a country’s Fragile States Index score and the implementation quality of environmental projects in that country. In this book, the evaluation and research team explain these groundbreaking findings in detail, highlighting seven key case studies: Afghanistan, Albertine Rift, Balkans, Cambodia, Colombia, Lebanon, and Mali. Drawing upon additional research and interviews with GEF project implementation staff, the volume illustrates the pathways through which conflict and fragility frequently impact environmental projects. It also examines how practitioners and sponsoring institutions can plan and implement their projects to avoid or mitigate these issues and find opportunities to promote peacebuilding through their environmental interventions. Examining data from 164 countries and territories, this innovative book will be of great interest to students and scholars of environmental management, conservation, international development, and the fast-growing field of environmental peacebuilding. This book focuses on the management and conservation of architectural heritage with the aim of increasing awareness about the value of such conservation and of saving what is left of history, which in turn rewards societies by supporting the tourism industry, generating economic return, and preserving communities’ identities. Since it has become an essential need to manage and conserve the architectural heritage in order to protect the identity and heritage of a city, there appeared a gap between the theory and its application. Therefore, a considerable amount of attention has been directed by experts in this field toward emphasizing the contribution of heritage conservation in order to inspire the development of imaginative, useful high-quality design.

This report inventories and analyses the range of international laws that protect the environment during armed conflict. With a view to identifying the current gaps and weaknesses in this system, the authors examine the relevant provisions within four bodies of international law - environmental humanitarian (IHL), international criminal law (ICL), international environmental law (IEL), and international human rights law (HRL). The report concludes with twelve concrete recommendations on ways to strengthen this legal framework and its enforcement. The Environment and Natural Resources are crucial for building and consolidating peace, it is urgent that their protection in times of armed conflict be strengthened. There can be no durable peace if the natural resources that sustain livelihoods are damaged or destroyed. This report provides a basis upon which Member States can draw upon to clarify, expand and enforce international law on environmental protection in times of war.

Environmental protection is fundamental for the establishment of sustainable peace. Applying traditional legal approaches to protection raises particular challenges during the transition from conflict to peace. In the jus post bellum context, protection of the environment and natural resources needs to be considered in tandem with a broad range of simultaneously applicable normative frameworks, such as human rights, transitional justice, arms control/disarmament, UN law and practice, development, and domestic law. While certain multilateral environment agreements, such as the Convention Concerning the Protection of the World Cultural and Natural Heritage protect the environment; international humanitarian law and international criminal law continue to treat environmental protection largely from an anthropocentric perspective. This book is the first targeted work in the legal literature that investigates environmental challenges in the aftermath of conflict. Addressing these challenges, it brings together academics, policy-makers, and practitioners from different disciplines to clarify policies and practices of environmental protection and key normative frameworks. It draws on experiences and practices in post-conflict settings to specify substantive principles and techniques to remedy and prevent harm.
