Art, Crime and Madness explores the relationship between creative innovation, deviance and morbidity. To innovate, one has to be able to view the medium and the object of creativity in a different, hitherto unexplored manner. The essence of art is creative innovation, coupled with an ability, in varying degrees, to transcend the boundaries of consciousness. But this 'ability' is also the prerogative of the mentally deranged. Likewise, the criminal and the deviant are more likely to transcend normative barriers while creating, hence the wide range of criminal and deviant behaviour in society. Although the inverse hypothesis does not hold -- the mere existence of deviance or morbidity does not predispose the individual to creativity -- nevertheless criminal and mad behaviour are often very innovative. This thesis is illustrated by historical case histories of creative deviance and genius madness, and contemporary observations. The painter Michelangelo Merisi Caravaggio killed a man while still a teenager, and a second victim during a ball game. In his lifetime he was considered degenerate, but today he is considered the greatest painter of the Italian Settecento, and his portrait adorns the Hundred-Thousand Lira note. Jean Genet the homosexual thief was born out of wedlock and as a teenager he transgressed almost all the paragraphs of the French criminal code. But he became a famous French playwright, the mouthpiece for criminals and deviants. His plays built up a philosophical apology for the raison d'etre of the criminal group.

This collection of essays explores the changing history, rhetoric, politics and representation of crime and madness in modern Austria. From the emergence of Viennese modernism to the post-modern moment, the myths, metaphors and realities of crime and madness have unfolded in the shadow of larger cultural questions regarding cultural norms, gender, war, and national identity. Historically based contributions illuminate such diverse cultural realities as the evolution of psychiatry as medical practice, asylum practices in the early twentieth century, and Austrian participation in and responses to terror and war crimes. From these investigations proceeds the clear insight that cultural responses to crime and madness are often steeped in mythmaking as much as objective policy and practice. Conversely, literary and metaphorical representations of crime and madness reveal attitudes and cultural realities about the Austrian society that produced them and which they reflect. Drawing connections between madness, philosophy and autobiography, this book addresses the question of how Nietzsche's madness might have affected his later works. It also explores why continental philosophy after Nietzsche is so fascinated with madness, and how it (re)considers, (re)evaluates and (re)valorizes madness. To answer these questions, the book analyzes the work of three major figures in twentieth-century French philosophy who were significantly influenced by Nietzsche: Bataille, Foucault and Derrida, examining the ways in which their responses to Nietzsche’s madness determine how they understand philosophy as well as philosophy’s relation to madness. For these philosophers, posing the question about madness renders the philosophical subject vulnerable and implicates it in a state of responsibility towards that about which it asks. Out of this analysis of their engagement with the question of madness emerges a new conception of 'autobiographical philosophy', which entails the insertion of this vulnerable subject into the philosophical work, to which each of these philosophers adheres or resists in different ways.

Bringing together previously disparate discussions on criminal responsibility from law, psychology, and philosophy, this book provides a close study of mental incapacity defences, tracing their development through historical cases to the modern era.

Beginning with Victoria's enthronement and an exploration of sensationalist accounts of attacks on the Queen, and ending with the notorious case of a fin-de-siècle killer, Victorian Crime, Madness and Sensation throws new light on nineteenth-century attitudes toward crime and 'deviance'. The essays, which draw on both canonical and liminal texts, examine the Victorian fascination with criminal psychology and pathology, engaging with real life cases alongside fictional accounts by writers as diverse as Ainsworth, Stevenson, and Stoker. Among the topics are shifting definitions of criminality and the ways in which discourses surrounding crime changed during the nineteenth century, the literal and social criminalization of particular sex acts, and the gendering of degeneration and insanity. As fascinated as they were with criminality, the Victorians were equally concerned with solving crime, and this collection also focuses on the forces of law enforcement and nineteenth-century attempts to "read" the criminal body as revealed in Victorian crime fiction and reportage. Contributors engage with the detective figure and his growing professionalization, while examining the role of science and technology - both at home and in the Empire - in solving cases.

This is the first monograph to consider the significance of madness and irrationality in both Spanish and Spanish American literature. It considers various definitions of ‘madness’ and explores the often contrasting responses, both positive (figural madness as stimulus for literary creativity) and negative (clinical madness representing spiritual confinement and sterility). The concept of national madness is explored with particular reference to Argentina: while, on the one hand, the country’s vast expanses have been seen as conducive to madness, the urban population of Buenos Aires, on the other, appears to be especially dependent on psychoanalytic therapy. The book considers both the work of lesser-known writers such as Nuria Amat, whose personal life is inflected by a form of literary madness, and that of larger literary figures such as José Lezama Lima, whose poetic concepts are suffused with the irrational. The conclusion draws attention to the ‘other side’ of reason as a source of possible originality in a world dominated by the tenets of logic and conventionalised thinking.

The role of private actors in policing has become a topic in both research and policy, as police forces face budgetary and expertise-related constraints. These challenges are evident in art crime policing, where a lack of prioritisation often means limited resources are allocated for a crime that requires significant expertise to tackle. Cooperating with private actors has been mooted as a solution to this deficit, but empirical research to support this suggestion is scarce. This book helps fill this gap by examining the interaction between specialist art crime police units and private actors in Belgium, the United Kingdom, and France. Its central questions are whether cooperation already exists in art crime policing, and why, or not. It was found that while limits to police capacity are an important driver for private outreach, several other factors also significantly affect cooperation. This book is relevant for policy, practice, and research, as it examines a hitherto less discussed topic which is nonetheless urgent as art crime shows little signs of abating.

The Limits of Criminological Positivism: The Movement for Criminal Law Reform in the West, 1870-1940 presents the first major study of the limits of criminological positivism in the West and establishes the subject as a field of interest. The volume will explore those limits and bring to life the resulting doctrinal, procedural, and institutional compromises of the early twentieth century that might be said to have defined modern criminal justice administration. The book examines the topic not only in North America and western Europe, with essays on Italy, Germany, France, Spain, the United Kingdom, Belgium, and Finland but also the reception and implementation of positivist ideas in Brazil. In doing so, it explores three comparative elements: (1) the differing national experiences within the civil law world; (2) differences and similarities between civil law and common law regimes; and (3) some differences between the two leading common-law countries. It interrogates many key aspects of current penal systems, such as the impact of extra-legal scientific knowledge on criminal law, preventive detention, the ‘dual-track’ system with both traditional punishment and novel measures of security, the assessment of offenders’ dangerousness, juvenile justice, and the indeterminate sentence.
