This book takes stock of Belgium’s exceptional and – for some foreign observers –schizophrenic position in the political world and explains its idiosyncrasy to a non-Belgian audience. Offering a broad and comprehensive analysis of Belgian politics, the guiding questions throughout each of the chapters of this book are: Is Belgium a political enigma, and why? Along which axes is Belgium "exceptional" compared to other countries? And what insights does a comparative study of Belgian politics have to offer? The book therefore provides a critical assessment of how Belgian politics "stands out" internationally, both in good and bad ways – including consociationalism, federalism, democratic innovations, Euroscepticism, government formation, gender equality, among others – and which factors can explain Belgium’s exceptional position. For too long Belgium remained an unexplored terrain by comparative political scientists. Belgium's politics were best known through the writings of Arend Lijphart, who considered it a model case of consociationalism. Over the past ten to fifteen years, the analysis of consociationalism has been complemented by a more detailed coverage of Belgium's spectacular transformation process from a unitary into a federal state, moving rapidly now to disintegration. Likewise, several peculiar aspects of Belgian politics, such as the record fragmentation of its party system, have been covered in edited volumes or international journals. However, given the complexity of the Belgian configuration of political institutions and actors, any inclusion of particular aspects of the Belgian case in comparative work calls for an in depth and integrated understanding of the broader political system. This is the first book which provides such an analysis. It brings together a team of 19 political scientists and sociologists who aim to explain the dynamics and incentives of institutional change and seek to analyze the intricate interplay between the main institutional components of the Belgian body politic. The sociological, political and institutional determinants and the consequences of the "federalisation" process of Belgium is the central theme that links each of the individual chapters. This book explores how prison life is normalized in different countries, with a critical and detailed look at ‘Scandinavian exceptionalism’ — the idea that Scandinavian prisons have exceptionally humane conditions — and compares these prisons to ones in Belgium. It provides a more nuanced, systematic and contextualized comparison of normalization in two countries. Through analyzing policy and legislative documents, participant observation and interviews, it seeks to understand how normalization is implemented differently in prison legislation, policies and practices and compares the two societies for context. It also considers the material prison environment, security, the social environment and the use of time in prison. It provides insights into how normalization can be successfully and holistically implemented in both policy and practice, to contribute to a more ‘pure’ form of liberty deprivation as punishment without too many unintended effects.

This book focuses on the triadic relationship between electoral candidates and the two other poles of the delegation and accountability triangle—political parties and voters. The chapters rely mostly on the Belgian Candidate Survey (CCS project), gathering about 2000 candidates belonging to 15 parties represented in Parliament and running for the 2014 federal and regional elections, and the authors’ conclusions serve at answering broad political science questions linked with elite recruitment, party and candidate electoral strategies, personalisation, party cohesion, and descriptive and substantive representation. Its multilevel semi-open electoral system, atypical federal structure, extreme party system fragmentation and volatility make Belgium an exceptionally rich but complex case that offers findings highly relevant to research on candidates in other democracies.

The Belgian Constitution, once described as a model of consensus democracy, has now become an enigma in comparative federalism. On the one hand, it demonstrates features which suggest institutional instability as well as elements that enhance the probability of secession. On the other hand, Belgium continues to exist as a federal system, based upon linguistic bipolarity. This linguistic bipolarity dominates Belgian politics and has shaped the design of Belgium's institutions as well as the Constitution's fundamental organising principles: concepts of federalism, democracy, separation of powers, constitutionalism and the rule of law. In this book, the institutional structure and the principles governing the Belgian constitutional system are explained in the light of its historical, demographic and political context. Linguistic bipolarity and its historical evolution explain the establishment of the Belgian State structure as a dual federalism, with exclusive powers, instruments for consensus making and obstruction, and elements of confederal decision making. It also explains the evolution in the concept of principles of democracy and the rule of law. Besides describing the devolutionary process, the book also incorporates two other elements that have shaped the Belgian constitutional landscape: fundamental rights and Europeanisation.

Memories of Post-Imperial Nations presents the first transnational comparison of Great Britain, the Netherlands, Belgium, France, Portugal, Italy and Japan, all of whom lost or 'decolonized' their overseas empires after 1945. Since the empires of the world crumbled, the post-imperial nations have been struggling to come to terms with the present, and as recall sets in 'wars of memory' have arisen, leading to a process of collective 'editing'. As these nations rebuild themselves they shed old characteristics and acquire new ones, looking at new orientations. This book brings together varying perspectives with historians and political scientists of these nations attempting to bind memory and its experience of different post-imperial nations.

This is a study of marriage litigation (with some reference to sexual offenses) in the archiepiscopal court of York (1300–1500) and the episcopal courts of Ely (1374–1381), Paris (1384–1387), Cambrai (1438–1453), and Brussels (1448–1459). All these courts were, for the most part, correctly applying the late medieval canon law of marriage, but statistical analysis of the cases and results confirms that there were substantial differences both in the types of cases the courts heard and the results they reached. Marriages in England in the later middle ages were often under the control of the parties to the marriage, whereas those in northern France and southern Netherlands were often under the control of the parties' families and social superiors. Within this broad generalization the book brings to light patterns of late medieval men and women manipulating each other and the courts to produce extraordinarily varied results.

This book provides an in-depth guide to researchers and practitioners who are interested in analyzing the evolution of EU law from a national and comparative constitutional law perspective. The volume deals with questions of how EU Member States’ constitutional systems, including the subnational tier, interact with the supranational level. It maps the evolution over time of constitutional strategies in the face of multi-level governance and individuates contextual factors on an empirical basis. The volume includes twelve national reports written by leading experts in constitutional and EU law, and in political science. The countries discussed include the six founding Member States, together with a selection of Member States in which a clear-cut evolution in the national constitutional approach towards the EU can be observed. These include the Czech Republic, Denmark, Hungary, Poland, Portugal and the United Kingdom. The latter is included as an “extreme” case in which the change in constitutional strategy over time has resulted in withdrawing from the Union altogether.
