This book considers the Optional Protocol to the Convention on the Rights of the Child on a communication procedure as a key contributor to the realization of children’s Article 12 Convention on the Rights of the Child participation rights. Weaknesses in the current formulation of the CRC communication procedure (its first iteration since entry into force 14 April, 2014) are examined and suggestions for strengthening of the mechanism in various respects considered. Actual cases concerning children’s fundamental human rights in various domains and brought under various international human rights mechanisms are considered as hypothetical OP3-CRC communications/complaints. In addition certain domestic cases brought to the highest State Court are considered as hypothetical OP3-CRC communications brought after exhaustion of domestic remedies. In this way various significant weaknesses of the OP3-CRC are illustrated in a compelling meaningful case context and needed amendments highlighted.

This book addresses the intersection of various domains of international law (refugee law, human rights law including child rights international law and humanitarian law) in terms of the implications for State obligations to child refugee asylum seekers in particular; both as collectives and as individual persons. This book takes a holistic approach by capturing the various perspectives and viewpoints concerning the theory and practice of Human Rights Journalism. Firstly, this book helps fill the epistemological vacuum present in Human Rights Journalism by proposing ‘pragmatic objectivity’ within the critical constructivist epistemology. Secondly, it defines the Human Rights Journalism-Responsibility to Protect nexus by identifying five key elements. Thirdly, it proposes a Human Rights Journalism-Responsibility to Protect conceptual model, which illustrates how an embedded human rights focussed media strategy can be designed. Fourthly, this book proposes two novel quantitative analysis tools called the ‘Framing Matrix’ and the ‘Multimodal Discourse Analysis Matrix’ that are equipped to deal with a big sample size over a long period of time. This collection brings together a range of international contributors to stimulate discussions on time and international human rights law, a topic that has been given little attention to date. The book explores how time and its diverse forms can be understood to operate on, and in, this area of law; how time manifests in the theory and practice of human rights law internationally; and how specific areas of human rights can be understood via temporal analyses. A range of temporal ideas and their connection to this area of law are investigated. These include collective memory, ideas of past, present and future, emergency time, the times of environmental change, linearity and non-linearity, multiplicitous time, and the connections between time and space or materiality. Rather than a purely abstract or theoretical endeavour, this dedicated attention to the times and temporalities of international human rights law will assist in better understanding this law, its development, and its operation in the present.
