With Church establishment largely locked in the geopolitics of the late 17th century, this study examines the case for change. How should the constitution respond to an ever more pluralized society; what are the implications for the religious character of the monarchy? The Church of England finds itself colliding with society at large on regular occasion. Has the time come, therefore, where the advantages of being the established church are at last outweighed by the disadvantages? Is there a case for disestablishment, and if so, what might a fresh vision of the church’s relationship with wider society be? Separating the question of establishment, from the question of presence in the community, Jonathan Chaplin argues that the time has come for the ending of privileged constitutional ties between the Church of England the British state. The book retraces the history of the Church of England from the Henrician schism (1533–34) to the present day, and focuses on the complex relations between the Church and the State which, in the case of an established Church, are of paramount importance. Theological questions, and in particular the conflicting influences of Catholicism and Protestantism, in its various forms, are also examined. The religious settlement engineered by Elizabeth I and her advisers in the 16th century saved England from the atrocities of religious war. However, the countless theological battles and party feuds which have punctuated the history of the Church suggest that the Elizabethan settlement was not entirely successful. The Church of England today is a “broad Church”, hosting within its fold a wide range of traditions and beliefs. The coexistence between liberals and conservatives and, to a lesser extent, between Anglo-Catholics and Evangelicals, remains uneasy and the unity of the Church is fragile. The Church of England, whose increasingly vague doctrine and multifaceted liturgy can be baffling, is furthermore confronted with other pressing challenges, such as the rapidly growing secularization of British society and the issue of disestablishment, which are seriously undermining its role and influence as a national Church.

Should an employee be allowed to wear a religious symbol at work? Should a religious employer be allowed to impose constraints on employees' private lives for the sake of enforcing a religious work ethos? Should an employee or service provider be allowed, on religious grounds, to refuse to work with customers of the opposite sex or of a same-sex sexual orientation? This book explores how judges decide these issues and defends a democratic approach, which is conducive to a more democratic understanding of our vivre ensemble. The normative democratic approach proposed in this book is grounded on a sociological and historical analysis of two national stories of the relationships between law, religion, diversity and the State, the British (mainly English) and the French stories. The book then puts the democratic paradigm to the test, by looking at cases involving clashes between religious freedoms and competing rights in the workplace. Contrary to the current alternative between the “accommodationist view”, which defers to religious requests, and the “analogous” view, which undermines the importance of religious freedom for pluralism, this book offers a third way. It fills a gap in the literature on the relationships between law and religious freedoms and provides guidelines for judges confronted with difficult cases.

This study commends the public theology of the English Reformation as a fruitful though neglected resource for a critical analysis of the contradictions of freedom that riddle late-modern liberal democracies and a constructive response to them. Drawn from the key legal, liturgical, homiletic and confessional elements of the English Reformation, this foundational Anglican tradition provides a theological vantage point for understanding current moral and political impasses in the western legacy of natural rights. The extensive development of natural rights in pre-modern scholastic theory and practice and its continuity with theoretical development from the 17th century onward make the Reformers' criticisms of scholastic moral, political, and ecclesial thought germane to identifying the problematic features of the prevailing modern tradition and to furnishing a theological alternative to them. These features are: an individualistic and voluntarist conception of moral agency, a regulative and juridical orientation to human relationships, and an anthropocentric concentration on human rather than on divine right, judgement, and freedom. The humanity they portray is detached from its created ordering to Christological perfection and bound within a self-enclosed ethical and political self-understanding. This is effectively countered by the English reformers' presentation of the salvation of creation in Christ, faith working through love, the spiritual fellowship of the church, and the provisional character of political jurisdiction.

The Anglican Communion is the third largest Christian denomination and claims a membership of some 80 million members in about 164 countries. Given that there are only around two hundred countries in the world, this makes the churches of the Anglican Communion the most geographicallywidespread denomination after Roman Catholicism. The 44 essays in this volume embrace a wide range of academic disciplines: theological; historical; demography and geography; and different aspects of culture and ethics.
