The United States has a hate problem. In recent years, hate speech has led not only to deep division in our politics but also to violence, murder, and even insurrection. And yet established constitutional jurisprudence holds that all speech is protected as “content neutral” and that the proper democratic response to hateful expression is not regulation but “more speech.” So how can ordinary citizens stand up to hate groups when the state will not? In Combating Hate, Billie Murray proposes an answer to this question. As a participant in anti-racist and anti-fascist protests, including demonstrations against the Ku Klux Klan, neo-Nazis, and the Westboro Baptist Church, Murray witnessed firsthand the limitations of the “more speech” approach as well as the combative tactics of anti-fascist activists. Tools to counter hate speech that undermines free electoral competition. “Everyone has the right to freedom of expression. This right shall include freedom to hold opinions and to receive and impart information and ideas without interference by public authority and regardless of frontiers.” (Article 10 of the European Convention on Human Rights) Freedom of expression is enshrined in the European Convention on Human Rights and protects citizens from interference with their right to freely express their opinions. This freedom is essential when it comes to the electoral process which, like any competition, has a strict framework of rules. Freedom of expression must not give rise to hate speech that would undermine the electoral process by polluting the campaign and political debate necessary for voters to make an informed choice. This toolkit is intended to explain the international standards applicable in this respect, provide tools and strategies that can be used by election management bodies to counter hate speech harmful to free electoral competition and describe the Georgian experience in this area.

Combating Hatred for the Soul of America: Watershed Moments for Transformational Educators raises important questions concerning the survival of our American democracy and the roles that educators can play in saving it. The January 6th Capitol riots brought to the surface deep-seated hatreds and cultural divisions that threaten our very soul as a nation. This book presents specific examples of hatred based on racism and social injustices found at both the national and local levels. It also describes specific actions taken by educators to combat such hatred. In doing this these educators actually became transformational leaders.

The opportunities afforded by the Internet greatly overshadow the challenges. While not forgetting this, we can nevertheless still address some of the problems that arise. Hate speech online is one such problem. But what exactly is hate speech online, and how can we deal with it effectively? As with freedom of expression, on- or offline, UNESCO defends the position that the free flow of information should always be the norm. Counter-speech is generally preferable to suppression of speech. And any response that limits speech needs to be very carefully weighed to ensure that this remains wholly exceptional, and that legitimate robust debate is not curtailed.

The three-prong theory is applied to identify public goods and values underlining the regulation of hate speech in the Czech Republic and Slovakia, two countries that share a political, sociological, and legal history, as an example of the differing approaches to hate speech regulation in post-communist societies due to divergent social values, despite identical legal frameworks. This book will be of great interest to scholars of human rights law, lawyers, judges, government, NGOs, media and anyone who would like to understand values that underpin hate speech regulations which reflect values that society cherishes the most.
