The Labour Government's proposals for reform of the UK's internal constitutional arrangements promise the most wide-ranging and substantial overhaul of the constitution this century. Their plans,which include devolution for Scotland and Wales, incorporation of the ECHR, a Freedom of Information Bill and reform of both houses of Parliament are already far progressed, but critical choices have still to be made. Against this background, and in view of these historical events, the Directors of the Centre for Public Law at the University of Cambridge recently organised a major conference to discuss the legal and practical implications of the proposed reforms. Speakers at the conference included leading academics, barristers, solicitors, judges and politicians. The results, which are reproduced in this volume of conference proceedings, will be essential reading for all those interested in constitutional reform and in British political history.

Any attempt at comparing contemporary change in the UK and France is a bold one, since it means discussing two very different countries with strong distinctive constitutional identities. This book places its emphasis on the shared historical, political and cultural background of the UK and France, before focusing on the sweeping transformation of their constitutional frameworks in the past quarter of a century at a national and regional level – with a particular emphasis on Wales and Scotland – which culminated in the June 2016 referendum on Britain’s EU membership. Instead of examining each country separately, however, as is traditional, this study breaks new ground by explaining the pattern of institutional development in Britain and France from a comparative Franco-British perspective. It explores the complexities of recent constitutional change in both countries in an original and comprehensive way, and gives both British and French readers a deeper understanding of the two countries that have some much in common even though Brexit could drive them apart.

This book examines the extent to which Brexit has impacted upon the operation of the British Constitution, prompting in turn consideration of how some of the factors which contributed to the outcome of the 2016 referendum, as well as the event of Brexit itself, might inform debates surrounding constitutional reform moving forward. The work seeks to make sense of the constitutional implications of Brexit and to revisit some of the key debates that have taken place in respect of particular constitutional reform proposals in order to assess the extent to which recent Brexit-related developments inform the perspectives which are taken upon their merits and prospects. The book is divided into two parts. The first provides some context for the substantive treatment of the potential impact of Brexit on constitutional reform debates which forms the focus of Part II. Part II centres on various specific constitutional reform themes or issues, which are explored further within the context of Brexit. For each such issue, the main parameters of the debates which have taken place are sketched out before moving on to consider how it has informed, or may come to be informed, by the phenomenon of Brexit. By so doing, it looks to some future directions for constitutional reform which take account of the factors driving the discourses which gave rise to the referendum outcome and subsequent developments, as well as offering meaningful responses to these. The book will be of interest to academics, researchers and policy-makers working in the areas of constitutional law, constitutional politics, philosophy and history.

The years since New Labour came to power in 1997 have seen changes to the British institutions of political power on an unprecedented scale. The reforms have been widespread, ranging from devolution of power in Scotland, Wales and Northern Ireland, to the reform of the House of Lords and the changing role of the Monarchy. This book is the first to examine these changes collectively and in detail, placing each in its historical context, analysing problems, solutions and what the future holds for this ambitious period of reforms. Places constitutional law in its legal, historical and political context using contemporary examples.

The first five editions of this well established book were written by Colin Turpin. This new edition has been prepared jointly by Colin Turpin and Adam Tomkins. This edition sees a major restructuring of the material, as well as a complete updating. New developments such as the Constitutional Reform Act 2005 and recent case law concerning the sovereignty of Parliament, the Human Rights Act, counter-terrorism and protests against the Iraq War, among other matters, are extracted and analysed. While it includes extensive material and commentary on contemporary constitutional reform, Turpin and Tomkins is a book that covers the historical traditions and the continuity of the British constitution as well as the current tide of change. All the chapters contain detailed suggestions for further reading. Designed principally for law students the book includes substantial extracts from parliamentary and other political sources, as well as from legislation and case law. As such it is essential reading also for politics and government students. Much of the material has been reworked and with its fresh design the book provides a detailed yet accessible account of the British constitution at a fascinating moment in its ongoing development.

The ability of the foundations and rules of the UK to evolve and in doing so adapt to changing circumstances has been a great strength. England, despite being home to 83% of the population of the UK, is yet to join the other nations of the Union in having effective devolution. Outside London, most decisions about England are still taken centrally by the UK Parliament though many decisions in the devolved parts of the Union are also taken centrally in the sense that they are made by the devolved Administrations and Legislatures for the whole of that part of the Union. 'Prospects for codifying the relationship between central and local government' (HC 656-I, ISBN 9780215052544) outlined a way in which devolution for England could be taken forward using local councils as the vehicle. Among the options is a national forum, or pre-convention, for England to discuss the most appropriate method to address the English Question. A strong, lasting democratic settlement for the UK must be built upon two principles: those of devolution and union. That is to say, a broad acceptance of the role and powers of the Union, allied to a respect for different but agreed forms of devolution for the nations that make up the Union.
