Rape, traditionally a spoil of war, became a weapon of war in the ethnic cleansing campaign in Bosnia. The ICTY Kunarac court responded by transforming wartime rape from an ignored crime into a crime against humanity. In its judgment, the court argued that the rapists violated the Muslim women’s right to sexual self-determination. Announcing this right to sexual integrity, the court transformed women’s vulnerability from an invitation to abuse into a mark of human dignity. This close reading of the trial, guided by the phenomenological themes of the lived body and ambiguity, feminist critiques of the autonomous subject and the liberal sexual/social contract, critical legal theory assessments of human rights law and institutions, and psychoanalytic analyses of the politics of desire, argues that the court, by validating women’s epistemic authority (their right to establish the meaning of their experience of rape) and affirming the dignity of the vulnerable body (thereby dethroning the autonomous body as the embodiment of dignity), shows us that human rights instruments can be used to combat the epidemic of wartime rape if they are read as de-legitimating the authority of the masculine autonomous subject and the gender codes it anchors.

What do we know about these children and their life chances? This book provides a persuasive account of how identity and difference factor in the debate on the self in the humanities. This book examines how South Asian women’s collective agency is operationalized through civic organizations in the UK. Drawing on black feminist theory and third world feminism, it shows the complexity of political agency and its relationship to identity and subjectivity, and uses empirical research to demonstrate how women are empowered to resist domination. The historically racialized image of the South Asian woman as lacking in political agency is challenged through their long history of activism on the Indian subcontinent. The creation of "critical spaces" by South Asian women in the diaspora places them as active agents who have successfully influenced social policy on important issues such as forced marriage, domestic violence and sexuality. The engagement with the empirical data demonstrates the significance and impact of race, racism, sexism and religion on the lives of the women. The book brings to the fore the pursuit of equality, rights and justice, including multiculturalism and the often debated emancipatory role of religion.

Essays on Beauvoirs influences, contemporary engagements, and legacy in the philosophical tradition. Despite a deep familiarity with the philosophical tradition and despite the groundbreaking influence of her own work, Simone de Beauvoir never embraced the idea of herself as a philosopher. Her legacy is similarly complicated. She is acclaimed as a revolutionary thinker on issues of gender, age, and oppression, but although much has been written weighing the influence she and Jean-Paul Sartre had on one another, the extent and sophistication of her engagement with the Western tradition broadly goes mostly unnoticed. This volume turns the spotlight on exactly that, examining Beauvoirs dialogue with her influences and contemporaries, as well as her impact on later thinkersconcluding with an autobiographical essay by bell hooks discussing the influence of Beauvoirs philosophy and life on her own work and career. This book presents humiliation as a key harm of sexual violence against women, showing that humiliation manifests within the relation of self to itself, and that Foucault’s critique of subjectivity provides resources for feminist conceptualization and countering of sexual violence and humiliation. Within feminist philosophy and theory, rape and sexual assault are often described as humiliating to victims, yet relatively few in-depth feminist philosophical accounts and analyses exist of humiliation as a harm of sexual violence against women. This book provides such an account and analysis of both humiliation generally and sexual humiliation resulting from sexual violence more specifically. The book’s elucidation of possibilities for countering sexual violence and humiliation, moreover, breaks with standard feminist approaches by critiquing rather than appealing to subjectivity. Through analysing specific instances of anti-sexual violence protest, it shows that cultivation of alternative modes of self-relation furthers rather than undermines feminist efforts to combat sexual violence. Throughout, the book draws upon concrete, recent and contemporary instances of sexual violence against women and feminist anti-sexual violence protest to illustrate and support its arguments. This will become a key text for feminist scholars and Foucault scholars in the humanities and social sciences, and for graduate and advanced undergraduate students. It will also be of interest to feminist anti-sexual violence activists.
