This book assesses the extent to which two specialized UN agencies – the International Maritime Organization (IMO) in London and the International Civil Aviation Organization (ICAO) in Montreal – have been able to regulate environmental pollution in the global commons. Since the Kyoto Protocol and its tasking of these two public International Organizations (IOs) in 1997 to regulate greenhouse gas emissions from the fast-growing international shipping and aviation sectors, they have struggled with the assignment even as the external pressure has mounted for them to act. David Deese examines why these two UN agencies have largely failed to execute their critical missions to date and explores the most promising emerging and feasible routes to control and reduce these emissions by other means. Drawing on a range of sources including interviews with key actors in the IMO and ICAO, as well as from industry and national governments, Deese looks at the multifaceted politics that drive these IOs and considers how this has delayed and frustrated the execution of their assigned climate mitigation missions. He also explains how the limitations of the IMO and ICAO are likely to be found to a degree in other UN specialized agencies and examines how lessons learned here will be helpful in understanding the operations of other IOs. National governments and private stakeholders have long recognized that protecting the global environment requires international cooperation. Climate change, tropical deforestation, biodiversity loss, ozone depletion, hazardous wastes, and ocean pollution are among several issues that have brought national governments together in common purpose. As they have worked to mitigate these global problems, governments have developed a wide variety of environmental regime designs. Some global environmental regimes are more institutionally integrated than others. Some regimes impose legally binding obligations on countries while others involve non-binding commitments. And some regimes involve global standards and rules while others leave national commitments up to countries' discretion. What explains the pattern of regime design in global environmental governance? Alexander Ovodenko demonstrates that national governments have developed different institutional responses to global issues because the markets producing environmental pollution impose varying constraints and create varying opportunities for governments. Contrary to the prevailing literature, governments are more inclined to impose stringent rules and regulations on oligopolistic industries than on competitive ones. The capital resources and innovation potential of oligopolistic businesses make them more cost-effective and economical in reducing pollution and meeting global standards than businesses in competitive industries. In global governance, oligopolistic businesses face a "double-edged sword" arising from their wealth and market concentrations. Regulating the Polluters inverts the literature on regulatory capture and collective action by presenting empirical evidence of the irony of market power in global environmental politics.

The maritime industry plays an important role in international trade activities and the global economy. It is estimated that international shipping carries approximately 80% of global trade by volume and more than 70% by value. However, increasing maritime activities have had a negative impact on the marine environment and human health. For example, in November 2002, a tanker carrying 77000 tons of fuel oil sank in the Bay of Biscay, which polluted thousands of kilometers of Western European coasts, rivers, streams and swamps. Oil spills caused by ship accidents and other pollution associated with maritime activities have attracted considerable attention in the research community. A large number of studies on shipping pollution have been conducted across different disciplines. However, new challenges are emerging in maritime operation and management, leading to research questions related to intelligent technology and environmental protection, maritime pollution and governance, maritime accidents and environmental emergency.

International trade has grown rapidly over the past half century, accommodated by the transportation industry through concomitant growth and technological change. But while the connection between transport and trade flows is clear, the academic literature often looks at these two issues separately. This Handbook is unique in pulling together the key insights of each field while highlighting what we know about their intersection and ideas for future research in this relatively unexamined but growing area of study.

This book provides a range of perspectives on some of the most pressing contemporary challenges in EU environmental law and governance from some of today’s leading European environmental academics and practitioners. The 1982 United Nations Convention on the Law of the Sea (UNCLOS) remains the cornerstone of global ocean governance. However, it lacks effective provisions or mechanisms to ensure that all ocean space and related problems are dealt with holistically. With seemingly no opportunity for revision due to the Conventions burdensome amendment provisions, complementary mechanisms dealing with such aspects of global ocean governance including maritime transport, fisheries, and marine environmental sustainability, have been developed under the aegis of the United Nations and other relevant international organizations. This approach is inherently fragmented and unable to achieve sustainable global ocean governance. In light of the Sustainable Development Goals (SDGs), particularly Goal 14, the IMLI Treatise proposes a new paradigm on the basis of integrated and cross-sectoral approach in order to realise a more effective and sustainable governance regime for the oceans. This volume focuses on the role of UN as the central intergovernmental organization responsible for global ocean governance. It examines the ocean governance challenges and how the present legal, policy, and institutional frameworks of the UN have addressed these challenges.
