In Counterinsurgency Law, William Banks and several distinguished contributors explore from an interdisciplinary legal and policy perspective the multiple challenges that counterinsurgency operations pose today to the rule of law - international, humanitarian, human rights, criminal, and domestic. Addressing the considerable challenges for the future of armed conflict, each contributor in the book explores the premise that in COIN operations, international humanitarian law, human rights law, international law more generally, and domestic national security laws do not provide adequate legal and policy coverage and guidance for multiple reasons, many of which are explored in this book. A second shared premise is that these problems are not only challenges for the law in post-9/11 security environments-but matters of policy with implications for the international community and for global security more generally.

This book is about how distinctions are drawn between civilians and combatants in modern warfare and how the legal principle of distinction depends on the technical means through which combatants make themselves visibly distinguishable from civilians. The author demonstrates that technologies of visualisation have always been part of the operation of the principle of distinction, arguing that the military uniform sustained the legal categories of civilian and combatant and actively set the boundaries of permissible and prohibited targeting, and so legal and illegal killing. Drawing upon insights from the theory of legal materiality, visual studies, critical fashion studies, and a dozen of military manuals he shows that far from being passive objects of regulation, these technologies help to draw the boundaries of the legitimate target. With its attention to the co-productive relationship between law, technologies of visualisation and legitimation of violence, this book will be relevant to a large community of researchers in international law, international relations, critical military studies, contemporary counterinsurgency operations and the sociology of law

This book analyses the various ways counterinsurgency in Afghanistan is gendered. The book examines the US led war in Afghanistan from 2001 onwards, including the invasion, the population-centric counterinsurgency operations and the efforts to train a new Afghan military charged with securing the country when the US and NATO withdrew their combat forces in 2014. Through an analysis of key counterinsurgency texts and military memoirs, the book explores how gender and counterinsurgency are co-constitutive in numerous ways. It discusses the multiple military masculinities that counterinsurgency relies on, the discourse of ‘cultural sensitivity’, and the deployment of Female Engagement Teams (FETs). Gendering Counterinsurgency demonstrates how population-centric counterinsurgency doctrine and practice can be captured within a gendered dynamic of ‘killing and caring’ – reliant on physical violence, albeit mediated through ‘armed social work’. This simultaneously contradictory and complementary dynamic cannot be understood without recognising how the legitimation and the practice of this war relied on multiple gendered embodied performances of masculinities and femininities. Developing the concept of ‘embodied performativity’ this book shows how the clues to understanding counterinsurgency, as well as gendering war more broadly are found in war’s everyday gendered manifestations. This book will be of much interest to students of counterinsurgency warfare, gender politics, governmentality, biopolitics, critical war studies, and critical security studies in general.

Insurgency and Counterinsurgency in the Nineteenth Century examines insurgency and counterinsurgency across the globe in the nineteenth century. The volume includes chapters from distinguished and rising historians from Europe, North and South America and covers irregular wars in Spain, Ireland, France, Latin America, China, USA, Africa, Central Asia and Burma. The authors explore links between insurgencies and nationalism, including learning curves and emulation in counterinsurgency. With a special emphasis on non-Western warfare, this volume includes case studies such as the Katanga and White Lotus rebellions largely unknown to Western readers. Powers to outlaw or proscribe terrorist organisations have become cornerstones of global counter-terrorism regimes. In this comprehensive volume, an international group of leading scholars reflect on the array of proscription regimes found around the world, using a range of methodological, theoretical and disciplinary perspectives from Political Science, International Relations, Law, Sociology and Criminology. This edited collection examines the British ‘way’ in counter-insurgency. It brings together and consolidates new scholarship on the counter-insurgency associated with the end of empire, foregrounding a dark and violent history of British imperial rule, one that stretched back to the nineteenth century and continued until the final collapse of the British Empire in the 1960s. The essays gathered in the collection cover the period from the late nineteenth century to the 1960s; they are both empirical and conceptual in tone. This edited collection pivots on the theme of the nature of the force used by Britain against colonial insurgents. It argues that the violence employed by British security forces in counter-insurgency to maintain imperial rule is best seen from a maximal perspective, contra traditional arguments that the British used minimum force to defeat colonial rebellions. Case studies are drawn from across the British Empire, covering a period of some hundred years, but they concentrate on the savage wars of decolonisation after 1945. The collection includes a historiographical essay and one on the ‘lost’ Hanslope archive by the scholar chosen by the Foreign and Commonwealth Office to manage the release of the papers held.
