Building Justice In Post Transition Europe

eBook Download

BOOK EXCERPT:

After the collapse of the Berlin wall in 1989 and disintegration of the Soviet Union, scholars focused on the problems of legal transitions within the newly emerging democracies. Two decades on, these states are in ‘post-transition’ conditions; having undergone and continuing to experience political, economic and constitutional upheavals to varying degrees. This book provides an interdisciplinary perspective on this largely unexamined topic. Part I of the book sets the scene with a socio-historical overview and a theoretical chapter; both of which contextualise the book within current debates and provide the theoretical direction of the book as a whole. The later chapters set out contrasting perspectives and consist of themed essays on individual legal systems, investigating these through approaches ranging from socio-legal study to political economy. The book aims to refine important directions for the comparative conceptual study of criminal law policy and processes of criminalisation in emerging democratic states. The result is a significant contribution to the understanding of this subject in the fields of criminology, law, philosophy and political science. The book will appeal to academics, policy-makers and practitioners who are attempting to grapple with the area of "transitions" in the fields of criminology, law, philosophy and political science. As a distinctively interdisciplinary text, it brings together analysis of both the social processes of creating (and abandoning) criminal law and a philosophical reflection. The book provides a comprehensive and critical analysis which points to future directions in criminalisation in the emerging democratic states of Eastern Europe.

Criminology And Criminal Justice In Russia

eBook Download

BOOK EXCERPT:

Though criminology took root in Russia in the early 1800s and has gone through various stages of maturation—paralleling developments of the discipline in Europe and North America over the last two centuries—its contributions and presence in the field is hardly noticeable in the English-speaking world. The objective of this book is by no means to fill that void, but rather to bring together the recent developments in Russia, keeping in context its rich history of criminological legacies, traditions, and its current experiences and growth since the restructuring of Soviet Union. This book was originally published as a special issue of the International Journal of Comparative and Applied Criminal Justice.

The Prediction And Control Of Organized Crime

eBook Download

BOOK EXCERPT:

Like most former Soviet republics, Ukraine has experienced a formidable proliferation of crime and corruption as it struggles with economic reform and the establishment of democracy.During the early 90s, Ukraine became one of the primary recipients of foreign assistance from the United States and its crime and corruption situation was increasingly seen as an impediment to economic transition and achieving a more democratic way of life. Thus in 1998, as part of a larger U.S. law enforcement assistance effort in Ukraine, the idea for a research partnership between criminologists and legal scholars in the two countries was born in this volume. The original research papers contained are the products of this ambitious research project. The realities of crime in post-Soviet Ukraine, as well as divergent methodological approaches and communication problems, presented the research partners with enormous challenges. This volume represents the culmination of that collaborative effort, and provides a singular look into the current crime situation in Ukraine, and into the potential global threat presented by Ukrainian organized crime.Contributions include analyses of the prediction and control of organized crime, trafficking in women and children for sexual exploitation, international money laundering, the transnational political criminal nexus of trafficking in women, countermeasures against economic crime and corruption, heroin trafficking, business victimization by organized crime, and understanding and combating organized crime. The Prediction and Control of Organized Crime will be critical reading for security planners, policymakers, and criminal justice officials, as well as comparative criminologists, legal scholars, and political scientists interested in organized crime and political corruption.

Historical Legacies Of Communism In Russia And Eastern Europe

eBook Download

BOOK EXCERPT:

This book takes stock of arguments about the historical legacies of communism that have become common within the study of Russia and East Europe more than two decades after communism's demise and elaborates an empirical approach to the study of historical legacies revolving around relationships and mechanisms rather than correlation and outward similarities. Eleven essays by a distinguished group of scholars assess whether post-communist developments in specific areas continue to be shaped by the experience of communism or, alternatively, by fundamental divergences produced before or after communism. Chapters deal with the variable impact of the communist experience on post-communist societies in such areas as regime trajectories and democratic political values; patterns of regional and sectoral economic development; property ownership within the energy sector; the functioning of the executive branch of government, the police, and courts; the relationship of religion to the state; government language policies; and informal relationships and practices.

Defendant Rights

eBook Download

BOOK EXCERPT:

A unique handbook comparing defendant rights in legal traditions around the world in light of fast-changing developments in U.S. law since September 11, 2001, and the USA PATRIOT Act. Written for the general reader, this book examines the scope of the legal rights granted by the U.S. Constitution to those accused of a crime. Defendant Rights examines the history of the Anglo-American legal tradition and compares and contrasts this with the major international systems of the world. Of special significance are the book's sections on the development of the British Dooms Law books under the Anglo-Saxon kings, and the Magna Carta's impact on American legal thought. Especially important in today's political climate is the coverage of Islam's sacred text, the Koran, and the role of the Islamic Kadi.
