Cultural Heritage in the European Union provides a critical analysis of the laws and policies which address cultural heritage throughout Europe, considering them in light of the current challenges faced by the Union. Creating and Governing Cultural Heritage in the European Union: The European Heritage Label provides an interdisciplinary examination of the ways in which European cultural heritage is created, communicated, and governed via the new European Heritage Label scheme. Drawing on ethnographic field research conducted across ten countries at sites that have been awarded with the European Heritage Label, the authors of the book approach heritage as an entangled social, spatial, temporal, discursive, narrative, performative, and embodied process. Recognising that heritage is inherently political and used by diverse actors as a tool for re-imagining communities, identities, and borders, and for generating notions of inclusion and exclusion in Europe, the book also considers the idea of Europe itself as a narrative. Chapters tackle issues such as multilevel governance of heritage; geopolitics of border-crossings and border-making; participation and non-participation; and embodiment and affective experience of heritage. This book critically analyses the relationships between intangible cultural heritage (ICH), sustainable development and intellectual property rights (IPRs). The author argues that although the use of IPRs to safeguard ICH presents challenges and has impeded sustainable development in some cases, the adoption of these rights on ICH also presents opportunities and, fundamentally, is not contrary to the spirit of the UNESCO Convention for the Safeguarding of the Intangible Cultural Heritage (UNESCO 2003 Convention). The adoption of IPRs on ICH can form an important part of the development of sustainable safeguarding plans capable of benefitting the communities, groups and individuals (CGIs) that create, maintain and transmit such heritage. The book provides a nuanced analysis of the relationship between intellectual property (IP) law and ICH as well as examining the role of IPRs in safeguarding ICH through the lens of sustainable development. It analyses the relationship between IP law and ICH from environmental, social and economic perspectives. These perspectives allow a thorough evaluation of both the positive effects and potential pitfalls of adopting IPRs to safeguard ICH. The book addresses deeper structural matters that refer back to the safeguarding of social and environmental processes underlying ICH.

The massive intentional destruction of cultural heritage during the 1992-1995 Bosnian War targeting a historically diverse identity provoked global condemnation and became a seminal marker in the discourse on cultural heritage. It prompted an urgent reassessment of how cultural property could be protected in times of conflict and led to a more definitive recognition in international humanitarian law that destruction of a people's cultural heritage is an aspect of genocide. Yet surprisingly little has been published on the subject. This wide-ranging book provides the first comprehensive overview and critical analysis of the destruction of Bosnia-Herzegovina's cultural heritage and its far-reaching impact. Scrutinizing the responses of the international community during the war (including bodies like UNESCO and the Council of Europe), the volume also analyses how, after the conflict ended, external agendas impinged on heritage reconstruction to the detriment of the broader peace process and refugee return. It assesses implementation of Annex 8 of the Dayton Peace Agreement, a unique attempt to address the devastation to Bosnia's cultural heritage, and examines the treatment of war crimes involving cultural property at the International Criminal Tribunal for the former Yugoslavia (ICTY). With numerous case studies and plentiful illustrations, this important volume considers questions which have moved to the foreground with the inclusion of cultural heritage preservation in discussions of the right to culture in human rights discourse and as a vital element of post-conflict and development aid.

This volume constitutes selected and revised papers presented during the Third International Conference on Trandisciplinary Multispectral Modelling and Cooperation for the Preservation of Cultural Heritage, TMM_CH 2023, held in Athens, Greece, in March 2023. This book analyses the impact of participatory governance on cultural development, explaining why cultural participatory practices can lead to positive sustainable effects or to unexpected and controversial ones. It focuses on four projects realized in the two European Capitals of Culture of 2013 - Marseille-Provence (France) and Košice (Slovakia) – within the Programme ‘Quartiers Créatifs’ and the SPOTs Programme. By combining different strands of the Democratic Theory and applying the process tracing methodology, the book argues that participation produces cultural developmental processes only when a certain intensity of trust is reached among the various stakeholders. In the presence of fully-fledged trust, participation activates a reinforcing chain of capacity-building and social capital that nurture long-term cultural networks. On the contrary, in the absence of fully-fledged trust, participation can generate contestation movements or isolated cultural production. Uniquely, the book challenges the ‘optimistic aura’ of participatory governance of culture, showing its conflicting but always productive nature.
