A landmark achievement of the Uruguay Round, and notably, the Agreement on Agriculture, was the full inclusion of agriculture in multilateral rules and disciplines. Since the birth of World Trade Organization (WTO), a significant number of member countries have used the dispute settlement mechanism (DSM) for resolving the disputes in agriculture. The DSM has played an important role not only for those parties involved in the disputes, but also by helping member countries to better understand the WTO rules, and therefore help guide them in developing domestic policies and trade policies that are consistent with WTO requirements. This paper examines trade disputes involving the Agreement on Agriculture since the WTO was formed in 1995 through December 2019. It analyzes who brought the disputes and against whom disputes were brought, and provides details on the natures of the disputes, the duration of disputes, and, the outcome of those disputes.

This book examines how a World Trade Organization (WTO) dispute settlement panel formulates its conclusions with respect to the facts of a dispute brought before it. It does so by discussing the legal concepts which shape the process of fact-finding, analysing the approach taken by panels thus far and offering suggestions for improvement.

In Nov. 2001, the WTO launched a new set of multilateral negotiations. It laid out an ambitious agenda for a broad set of new multilateral trade negotiations, which calls for a continuation of discussions on liberalizing trade in ag. and services, which began in 2000. It also provides for new talks on market access for non-ag. products, trade and the environ., trade-related aspects of intellectual property rights, and other issues. This volume gives a detailed account of the parameters for technical standards and measures seeking to protect health and environment

Technical standards are increasingly determining the development, production, trade in and marketing of goods and services. In order to ensure that technical regulations and product standards which vary from country to country do not create unnecessary obstacles to trade the Agreement on Technical Barriers to Trade was adopted during the Uruguay Round. It is paralleled by the Agreement on Sanitary and Phytosanitary Measures which sets out the basic rules on how governments can apply food safety as well as animal and plant health measures without, however, using them as an excuse for protecting domestic producers. Prominent decisions under the WTO Dispute Settlement have interpreted those provisions. This volume gives a detailed account of the necessary parameters for technical standards and measures seeking to protect health and environment. Included are commentaries on Articles III, XI and XX of GATT 1994 which are equally relevant in this context. The article by article commentaries draw from a considerable body of case law, the work by the TBT and SPS Committee and the relevant legal literature.
