In the public imagination, drones are tools of the military and law enforcement. However, there are many sectors in which government at all levels—local, state, and federal—has the potential to leverage drone technology. Through an analysis of the use of drones, Rebecca Mignot-Mahdavi explores the ways in which, in the context of counterterrorism, war, technology and the law interact and reshape one another. She demonstrates that drone programs are techno-legal machineries that facilitate and accelerate the emergence of a new kind of warfare. This new model of warfare is individualized and de-materialized in the sense that it focuses on threat anticipation and thus consists in identifying dangerous figures (individualized warfare) rather than responding to acts of hostilities (material warfare). Revolving around threat anticipation, drone wars endure over an extensive timeframe and geographical area, to the extent that the use of drones may even be seen, as appears to be the case for the United States, as part of the normal functioning of the state, with profound consequences for the international legal order.

In warzones, ordinary commercially-available drones are used for extraordinary reconnaissance and information gathering. They can also be used for bombings - a drone carrying an explosive charge is potentially a powerful weapon. At the same time asymmetric warfare has become the norm - with large states increasingly fighting marginal terrorist groups in the Middle East and elsewhere. Here, Nicholas Grossman shows how we are entering the age of the drone terrorist - groups such as Hezbollah are already using them in the Middle East. Grossman will analyse the ways in which the United States, Israel and other advanced militaries use aerial drones and ground-based robots to fight non-state actors (e.g. ISIS, al Qaeda, the Iraqi and Afghan insurgencies, Hezbollah, Hamas, etc.) and how these groups, as well as individual terrorists, are utilizing less advanced commercially-available drones to fight powerful state opponents. Drones and the Law: International Responses to Rapid Drone Proliferation presents innovative solutions to the controversial issues raised by the drones and a critical assessment of its growing use as a weapon system in modern warfare and privacy issues.

This study assessed the existence of policies, rules and regulations governing the use of ‘unmanned aerial vehicles’ (UAVs) – or drones – in all 79 African, Caribbean and Pacific (ACP) Group countries. The results are quite telling: as of April 2016, 73% of ACP countries did not have any rules or regulations in place; 19% had some regulations in place; and 8% were in the process of formulating them. The data gathered in the course of the study have been published on a site hosted by The Swiss Foundation for Mine Action (FSD) and are accessible at www.droneregulations.info. CTA hopes that this database will help to increase awareness of the rules and regulations surrounding UAV use, promote their responsible use and help to fully realise their potential in the management of crops, fisheries and other resources.

Drone strikes have become a key feature of counterterrorism operations in an increasing number of countries. This work explores the different domestic and international legal regimes that govern the manufacture, transfer, and use of armed drones. Chapters assess the legality of armed drones under jus ad bellum, the law of armed conflict, the law of law enforcement, international human rights law, international criminal law and domestic civil and criminal law. The book also discusses the application of law to fully autonomous weapons systems where computer algorithms decide who or what to target and when to fire.

Combat drones are transforming attitudes about the use of military force. Military casualties and the costs of conflict sap public support for war and for political and military leaders. Combat drones offer an unprecedented ability to reduce these costs by increasing accuracy, reducing the risks to civilians, and protecting military personnel from harm.
