Elections in Africa are competitive in nature and can be manipulated by incumbents to extend and entrench their rule through changes to constitutions, intimidation of opponents, excess use of police force and, in some cases, assassinations of dissident voices. Ethnic cleavages are also exploited by contestants to incite and mobilize unsuspecting masses to pursue their electoral ambitions which can lead to political instability. In many African countries, violence before, during and after elections has become a regrettable norm rather than the exception. The function of transitional justice is to address the legacy of human rights atrocities, political violence and societal harm resulting from prior misrule or violent conflicts, with a view to establishing fair, democratic and inclusive societies. This book interrogates the potential intersection between transitional justice and electoral processes. Specifically, it examines the hypothesis that transitional justice interventions that strive to address historical injustices perpetrated by violence, conflict and entrenched by socio-political impunity, can initiate preventive measures against electoral violence through redress, accountability and institutional reforms. The contributors to this volume have engaged with country case studies from across Africa, while examining the intersection between transitional justice and electoral processes. How and why did Kenya's transitional justice efforts fail, and what does this say about the persistence of the past?

Forgiveness and reconciliation are important moments for the stability of a society and a state. Many African countries have gone through serious social crises in the post-colonial period: genocide, post-election crises, civil and internal conflicts, and outright war. Forgiveness and reconciliation have been necessary to reweave the social fabric and restart the construction of peaceful and prosperous societies. Chapters in this book examine the Truth and Reconciliation Commissions and religious councils aimed at peace, along with African traditional approaches, mediation and arbitration councils, post-conflict contexts, and the roles of women and gender, philosophy and theology, and programs of education for peace.

This Handbook explores the ways in which religion among the African people has been applied in situations of conflict and violence to contribute to sustainable peace and development. It analyzes how peacebuilding inspired and enabled by religion serves as the foundation for sustainable development in Africa, while also acknowledging that religion can also be a tool of destruction, and can be used to fuel violence and underdevelopment. Contributors to this volume offer theoretical discussions from existing literature, as well as experiences of practitioners, to deepen the readers’ understanding on the role of religion and religious institutions in peacebuilding and development in Africa. Kenya’s 2007 General Election results announcement precipitated the worst ethnic conflict in the country’s history; 1,133 people were killed, while 600,000 were internally displaced. Within 2 months, the incumbent and the challenger had agreed to a power-sharing agreement and a Government of National Unity. This book investigates the role of socio-cultural origins of ethnic conflict during electoral periods in Kenya beginning with the multi-party era of democratization and the first multi-party elections of 1992, illustrating how ethnic groups construct their interests and cooperate (or fail to) based on shared traits. The author demonstrates that socio-cultural traditions have led to the collaboration (and frequent conflict) between the Kikuyu and Kalenjin that has dominated power and politics in independent Kenya. The author goes onto evaluate the possibility of peace for future elections. This book will be of interest to scholars of African democracy, Kenyan history and politics, and ethnic conflict.

This book examines the concept of witness protection which is still at an early developmental stage in several African countries including Nigeria, from a legal and institutional perspective. Recent developments in Nigeria highlight the need to clarify legal and conceptual issues within the existing legal framework for protecting witnesses. Using the Nigerian case study, the book illustrates some obscurities inherent in the concept of witness protection. These are highlighted around five critical areas: the definition of witness protection; the scope of beneficiaries requiring protection; the nature of crimes necessitating protection; the nature of protective measures; and the administrative control of witness protection. Specifically, this book draws from the existing literature and practices of witness protection and adopts two distinct perspectives: the criminal justice perspectives and human rights perspectives as heuristic tools for analysing the concept and to separate the disparate influences that shape how it is construed. These distinctions are utilised throughout the book as an integrated way of conceptualising the concept of witness protection. By discussing the practice of witness protection within the Nigerian context, the book contributes to African conversations on the topic of witness protection. The clarifications made in this book are utilised in making normative proposals for developing a legal framework for witness protection in Nigeria. They are also useful for other African countries interested in developing a witness protection framework as part of criminal justice reform. This book will serve as a reference point for legal scholars, researchers, academics, (postgraduate) students and policy makers interested in the concept of witness protection. Since the historic Nuremberg Trial of 1945 an international customary law principle has developed that commission of a core crime under international law – war crimes, genocide, crimes against humanity and aggression – should not go unpunished. History shows, that when in Africa such violations occurred, especially as a result of election disputes, national and regional actors, including the African Union, resorted to political rather than legal responses. However, when crimes against humanity were alleged to have been committed in Kenya during the 2007-2008 post-election violence, a promising road map for criminal accountability was agreed upon alongside a political solution. In the spirit of this road map, the author analyzes the post-election violence in Kenya from a legal point of view. He extensively examines legal options for domestic criminal accountability and discusses both retributive (prosecutions) and restorative justice (mainly truth commission) mechanisms, being the main legal responses to the gross violations of human rights.
