Perspectives On Deep Sea Mining

eBook Download

BOOK EXCERPT:

This book is a sequel to ’Deep-Sea Mining: Resource Potential, Technical and Environmental Considerations’ (2017) and ‘Environmental Issues of Deep-Sea Mining: Impacts, Consequences and Policy Perspectives’ (2019), and aims to provide a comprehensive volume on different perspectives of deep-sea mining from specialists around the world. The work is timely, as deep-sea minerals continue to enthuse researchers involved in activities such as ascertaining their potential as alternative sources for critical metals for green energy and other industrial applications, as well as technology development for their sustainable exploration and exploitation, while addressing environmental concerns. With a steady increase in the number of contractors having exclusive rights over large tracts of seafloor in the ‘Area’, i.e. area beyond national jurisdictions, the International Seabed Authority, mandated with the responsibility of regulating such activities, is in the process of developing a code for exploitation of deep-sea minerals. These, coupled with growing interest among private entrepreneurs, investment companies and policy makers, underscore the need for updated information to be made available in one place on the subject of deep-sea mining. The book evaluates the potential and sustainability of mining for deep-sea minerals compared to other land-based deposits, the technologies needed for mining and processing of ores, the approach towards environmental monitoring and management, as well as the regulatory frameworks and legal challenges to manage deep-sea mining activities. The book is expected to serve as an important reference for all stakeholders including researchers, contractors, mining companies, regulators and NGOs involved in deep-sea mining.

Deep Sea Mining Balancing Environmental Concerns With Renewable Energy Needs

eBook Download

BOOK EXCERPT:

(This book is Part I in the Regulatory Dilemma Series which tries to address the question of 'How much Regulation?') This part I of the Regulatory Dilemma Series deals specifically with the issue of Deep-Sea Mining. Mining deep sea minerals can serve a lot of growing energy needs, especially renewable energy demands to fuel electrical vehicles. But they are an environmental hazard to the marine ecosystem. UNCLOS under Part XI on Deep Sea Mining and other International Law principles emphasize on Equitable Sharing and Technology Transfer which is not amenable to a lot of companies and countries like USA. Interestingly, no exploration or mining contract for Deep Sea Mining can be given to a private company without being sponsored by a Sponsoring State guaranteeing compliance with the UNCLOS obligations and corresponding liabilities and other requirements. This raises an interesting question in relation to US Companies as US is currently not a signatory to Part XI of UNCLOS. This part will look at the recent developments at the International Level and internally within various nation states and try to figure a way out of this Regulatory Dilemma related to Deep Sea Mining.

International Law And Corporate Actors In Deep Seabed Mining

eBook Download

BOOK EXCERPT:

The deep seabed beyond national jurisdiction (known as the Area) comprises almost three-quarters of the entire surface area of the oceans, and is home to an array of prized commodities including valuable metals and rare earth elements. In recent years, there has been a marked growth in deep seabed investment by private corporate actors, and an increasing impetus towards exploitation. This book addresses the unresolved legal challenges which this increasing corporate activity will raise over the coming years, including in relation to matters of common management, benefit-sharing, marine environmental protection, and investment protection. Acting under the United Nations Convention on the Law of the Sea (UNCLOS), the International Seabed Authority is responsible for regulating the Area for the benefit of humanity and granting mining contracts. A product of its history, the UNCLOS deep seabed regime is an unlikely hybrid of capitalist and communist values, embracing the role of private actors while enshrining principles of resource distribution. As technological advances begin to outstrip legal developments, this book assesses the tension between corporate commercial activity in the Area and the achievement of the common heritage.

Routledge Handbook Of Seabed Mining And The Law Of The Sea

eBook Download

BOOK EXCERPT:

For years, exploration of seabed natural resources has been ongoing while exploitation in deep marine areas remained unrealistic due to land-based mineral availability and costs. However, mounting pressures from the green transition, climate change, and long-lasting fears of terrestrial minerals scarcity now bring exploitation prospects closer to reality. This has caused concern to a growing chorus of States, scientists, industries, NGOs, and parts of civil society due to the potential environmental and social impacts of these activities. As a result, the idea of a moratorium or ‘precautionary pause’ is gaining ground. Yet, an important number of interpretation and implementation issues of the United Nations Convention on the Law of the Sea (UNCLOS) and the 1994 Agreement remain to be answered as a means to move forward in accordance with international law. This multidisciplinary book, designed to become the essential handbook on the matter, provides a global overview of the national, regional, and international regulatory frameworks applicable to the exploration and exploitation of seabed minerals on the continental shelf and the Area, as well as the related state of the science on the matter. By presenting historical and geopolitical context crucial to understanding regulation evolution, the book equips readers with foundational legal and policy knowledge. It furthermore addresses contemporary and prospective issues and offers unique insights into regional and national practices, including non-Party States to UNCLOS. Mining Law And Governance In Africa

eBook Download

BOOK EXCERPT:

This book explores the various issues that characterise the African mining sector, drawing examples from different African countries and regional organisations. Although there is a massive literature on the subject, some issues have been neglected, including the crucial role of digitalisation and technological advancement in resolving the environmental and social challenges faced in Artisanal and Small-Scale Mining (ASM), deep-sea mining, mining contract negotiations and modernising mining laws to reflect the increasing role of critical minerals, to mention but a few. Therefore, the book unpacks the critical issues associated with the mining sector, explicitly reflecting on the practical solutions needed to address the challenges in the African mining sector. This book uniquely analyses and adds flavour to international mining’s fundamental concepts by describing a simulated annealing-based approach appropriate for complex mining projects in Africa. Book contributors comprise of academics from different universities including professors, practitioners, government policymakers, NGO executives and a variety of different experts. This multidisciplinary book will be of interest to African policymakers, governments, academics, industry professionals, energy and mining institutions, international organisations, universities across the globe and companies.
