ETHNICITY AND CRIMINAL JUSTICE IN THE ERA OF MASS INCARCERATION: A Critical Reader on the Latino Experience is designed as a Latino reader in criminal justice, covering a much broader spectrum of the Latino experience in criminal justice and society, while giving readers a broad overview of the Latino experience in a single book. Considering the shifting trends in demographics and the current state of the criminal justice system, along with the current political “climate,” this book is timely and of critical significance for the academic, political, and social arena. The authors report sound evidence that testifies to a historical legacy of violence, brutality, manipulation, oppression, marginalization, prejudice, discrimination, power, and control, and to white America’s continued fear about ethnic and racial minorities, a movement that continues in the twenty-first century—as we have been witnessing during the 2015-2016 presidential race, highly charged with anti-immigrant and anti-Mexican political rhetoric. A central objective of this book is to demystify and expose the ways in which ideas of ethnicity, race, gender, and class uphold the functioning and “legitimacy” of the criminal justice system. In this mission, rather than attempting to develop a single explanation for the Latino experience in policing, the courts, and the penal system, this book presents a variety of studies and perspectives that illustrate alternative ways of interpreting crime, punishment, safety, equality, and justice. The findings reveal that race, ethnicity, gender, class, and several other variables continue to play a significant role in the legal decision-making process. With the social control (from police brutality to immigration) discourse reaching unprecedented levels, the book will have broad appeal for students, police officers, advocates/activists, attorneys, the media, and the general public.

Catholic health care is one of the key places where the church lives Catholic social teaching (CST). Yet the individualistic methodology of Catholic bioethics inherited from the manualist tradition has yet to incorporate this critical component of the Catholic moral tradition. Informed by the places where Catholic health care intersects with the diverse societal injustices embodied in the patients it encounters, this book brings the lens of CST to bear on Catholic health care, illuminating a new spectrum of ethical issues and practical recommendations from social determinants of health, immigration, diversity and disparities, behavioral health, gender-questioning patients, and environmental and global health issues.

This major new study examines the developing practice of universal jurisdiction, as well as the broader phenomenon of "globalizing" justice, and its ramifications. With a detailed overview of the contemporary practice of universal jurisdiction, it discerns three trends at work: pure universal jurisdiction, universal jurisdiction "plus", and non-use. It also argues that these disparities in practice should raise serious concerns as to the legitimacy and perceived legitimacy of such globalized justice. It then turns to a further consideration, that of globalized justice, precisely because it takes place far from the locus of the crime, and is therefore "externalized" and may fail to achieve many of its putative goals. In addition, this is a key assessment of civil accountability, through the use of the Alien Tort Claims Act in the United States. It details how the use of civil penalties may offer new avenues for redress, particularly with relation to group accountability, whether that of armed groups or of corporations. However, it balances this approach to accountability with recognition of certain flaws within externalized criminal accountability. This study also focuses on mixed tribunals, or other methods of internationalized justice as viable alternatives, which may avoid some of the problems with external justice, but are themselves far from perfect. Mixed or hybrid tribunals in East Timor and Sierra Leone represent different models of hybrid justice and provide the reader with excellent examples of these new forms of justice in action. This book will be of great interest to all students and scholars of human rights international law and political science.

This book brings a new focus to the ongoing debate on holding perpetrators of massive humanitarian and human rights violations accountable in countries in transition. It provides a clear-cut and comprehensive legal analysis of the content and nature of a state's obligations to investigate and prosecute as enshrined in the most important humanitarian and human rights treaties; it disentangles the common fallacy that these procedural obligations are naturally rooted and clearly spelled out in the general human rights treaties; and it explains the flaws in an absolutist interpretation. This analysis serves to understand whether such procedural obligations, if narrowly construed, act as impediments to countries emerging from periods of conflict or systematic repression in the face of contingent circumstances and the formidable dilemmas raised by a univocal understanding of justice as retribution. In many churches, the work of evangelism and social justice is relegated to clergy, staff, or special committees. Rarely do most members of the laity believe they should or even want to engage in the tasks of evangelism and social justice.
