Forced Mobility of EU Citizens is a critical evaluation from an empirical perspective of existing practices of the use of transnational criminal justice instruments within the European Union. Such instruments include the European Arrest Warrant (EAW), prisoner transfer procedures and criminal law-related deportations. The voices and experiences of people transferred across internal borders of the European Union are brought to the fore in this book. Another area explored is the scope and value of EU citizenship rights in light of cooperation not just between judicial authorities of EU Member States, but criminal justice systems in general, including penitentiary institutions. The novelty of the book lays not only in the fact that it brings to the fore a topic that so far has been under-researched, but it also brings together academics and studies from different parts of Europe – from the west (i.e. the expelling countries) and the east (the receiving countries, with a special focus on two of the jurisdictions most affected by these processes – Poland and Romania). It therefore exposes processes that have so far been hidden, shows the links between sending and receiving countries, and elaborates on the harms caused by those instruments and the very idea of ‘justice’ behind them. This book also introduces a new element to deportation studies as it links to them the institution of the European Arrest Warrant and EU law transfers targeting prisoners and sentenced individuals. With a combination of legal, criminological, and sociological perspectives, this book will be of great interest to scholars and students with an interest in EU law, criminal law, transnational criminal justice, migration/immigration, and citizenship. What does it mean to be a European citizen? The rapidly changing politics of citizenship in the face of migration, diversity, heightened concerns about security and financial and economic crises, has left European citizenship as one of the major political and social challenges to European integration. Enacting European Citizenship develops a distinctive perspective on European citizenship and its impact on European integration by focusing on 'acts' of European citizenship. The authors examine a broad range of cases - including those of the Roma, Sinti, Kurds, sex workers, youth and other 'minorities' or marginalised peoples - to illuminate the ways in which the institutions and practices of European citizenship can hinder as well as enable claims for justice, rights and equality. This book draws the key themes together to explore what the limitations and possibilities of European citizenship might be.

Narratives of Forced Mobility and Displacement in Contemporary Literature and Culture: Border Violence focuses on the evidence of the effects of displacement as seen in narratives—cinematic, photographic, and literary—produced by, with, or about refugees and migrants. The book explores refugee journeys, asylum-seeking, trafficking, and deportation as well as territorial displacement, the architecture of occupation and settlement, and border separation and violence. The large-scale movement of people from the global South to the global North is explored through the perspectives of the new mobilities paradigm, including the fact that, for many of the displaced, waiting and immobility is a common part of their experience. Through critical analysis drawing on cultural studies and literary studies, Roger Bromley generates an alternative “map” of texts for understanding displacement in terms of affect, subjectivity, and dehumanization with the overall aim of opening up new dialogues in the face of the current stream of anti-refugee rhetoric.

This collective volume examines how EU citizenship reconstructs in unexpected ways what citizenship as a status means and stands for. EU citizenship can neither be accurately described as a citizenship status similar to national citizenship, nor as an immigration one. The book examines the tension at the heart of attempts to grasp the nature of EU citizenship as supranational status in relation to family reunification, social rights and expulsion. It shows that while events such as Brexit stress the importance of EU citizenship, the construction of supranational citizenship along the axis of non-discrimination and equality remains a work in progress that requires the efforts of all actors involved - institutions, implementing authorities, courts and citizens.

In Deporting Europeans, Ioana Vrăbiescu examines how states within the European Union (EU) collaborate in the policing and deportation of EU citizens within EU territory. Vrăbiescu argues that the deportation of EU citizens reifies existing inequalities between central states, like France, and peripheral states, like Romania. By highlighting the massive deportation of Romanians from France, Vrăbiescu showcases these inequalities and the intricacies of EU geopolitics.

Working from an interdisciplinary perspective that draws on the social sciences, legal studies, and the humanities, this book investigates the causes and effects of the extremities experienced by migrants. Firstly, the volume analyses the development and political-cultural conditions of current practices and discourses of “bordering,” “illegality,” and “irregularization.” Secondly, it focuses on the varieties of irregularization and on the diversity of the fields, techniques and effects involved in this variegation. Thirdly, the book examines examples of resistance that migrants and migratory cultures have developed in order to deal with the predicaments they face. The book uses the European Union as its case study, exploring practices and discourses of bordering, border control, and migration regulation. But the significance of this field extends well beyond the European context as the monitoring of Europe’s borders increasingly takes place on a global scale and reflects an internationally increasing trend.

Christiane Heimann provides insights on how the economic and political situation in Spain, Germany and the UK affects the institutional implementation of free labour movement and how mobile EU citizens navigate the institutional policies strategically. The study examines different profiles of EU citizens exercising free labour movement and shows ways of EU labour recruitment and transnational labour integration taking into account the institutional implementation of related EU policies. Intra-Community mobility policies and practices will be assessed in terms of their effectiveness for international recruitment and labour integration.

This thesis seeks to make both theoretical and empirical contributions to the understanding of intra-EU mobility, with a focus on labour migration from Lithuania to Sweden. Inspired by a critical realist perspective, the thesis aims to help to explain the dynamics and individual decision-making behind mass labour emigration from the Baltic states, its socioeconomic consequences and policy responses. Theoretically, the thesis proposes a model that synthesizes a social transformation approach with an extended version of Hirschman’s analytical framework of exit, voice and loyalty. The three empirical articles, based mainly on semi-structured interviews, are situated within this framework. Two of the articles seek to explain the migrants’ decision-making process of stay-exit-entrance in the context of the structural-institutional social changes that followed (1) independence from the Soviet Union in 1990; (2) EU accession in 2004; and (3) the 2008/2009 economic crisis with austerity. The third article brings into the debate the perspective of the sending Baltic countries, in a broader context of the East-West migration debate. The dissertation shows that the consequences of the neoliberal policies of the post-communist and post-crisis transformations, together with the construction of formal migration channels after EU accession, constitute various migrant categories. Individual strategies of actively looking for channels to exit and enter, combining them in different ways at various points of the migratory process and establishing informal social networks are re-constituting who can be and who is a migrant. Furthermore, following the economic crisis and austerity measures, the decision to emigrate extends beyond individual survival strategies, instead becoming bound to an individual’s perception of the (ine)quality of life and pursuit of a better quality of life for oneself and one’s family across time and in different places. Finally, as the interviewed Baltic experts agree, the EU’s policy of the free movement is socially and economically problematic, although the official Baltic states’ policy responses focus primarily on ‘talented’ and ‘needed’ diaspora members’ return or engagement. These policies have proved to be inadequate to address demographic and socioeconomic challenges in part brought about by emigration. The structural-institutional conditions, states’ and migrants’ strategies engender mobility as a social norm in the sending countries and promote and constitute the perpetuation of migration of both ‘precarious labour migrants’ and ‘active talented EU mobile citizens’. Avhandlingen avser att bidra både teoretiskt och empiriskt till ökad kunskap om den fria rörligheten inom EU med fokus på arbetskraftmigration från Litauen till Sverige. Inspirerad av kritisk realism som samhällsvetenskaplig metod är syftet att bidra till att förklara såväl dynamiken i som det individuella beslutsfattandet bakom den omfattande arbetsutvandringen från de baltiska staterna samt att diskutera dess socioekonomiska konsekvenser och politiska inverkan. Teoretiskt utgår avhandlingen från en modell som syntetiserar social transformation med en utsträckt version av Hirschmans analytiska ramverk för ‘sorti’, ‘protest’ och ‘lojalitet’. De tre empiriska artiklarna, som huvudsakligen bygger på semistrukturerade djupintervjuer, ligger inom detta ramverk. Två av artiklarna syftar till att förklara migranternas beslutsprocess i fråga om stay-exit-entrance mot bakgrund av de strukturella och institutionella sociala förändringarna som följde av: (1) självständighetsförklaringen från Sovjetunionen 1990; (2) anslutningen till EU 2004; och (3) den ekonomiska krisen 2008/2009 med följande åtstramningar. Den tredje artikeln för in de baltiska ländernas eget perspektiv i den bredare öst-västliga migrationsdebatten. Avhandlingen visar att följderna av den postkommunistiska neoliberala politiken och omvandlingen efter den ekonomiska krisen, tillsammans med uppbyggnaden av formella migrationskanaler efter anslutningen till EU, bidrar till att skapa olika migrantkategorier. Individuella strategier för att aktivt leta efter kanaler för exit och enter, kombinera dem på olika sätt och utifrån olika stadier i migrationsprocessen samt etablera informella sociala nätverk bidrar till att (re)konstituera vem som kan vara och vem som är en migrant. Vidare, efter den ekonomiska krisen och de införda åtstramningsåtgärderna, handlar beslutet om att emigrera inte bara om individuella överlevnadsstrategier, utan också om individuella uppfattningar om vad som är livskvalitet och inte, (på engelska – (ine)quality of life), liksom strävan efter en bättre livskvalitet för sig själv och sin familj över tid och rum. Slutligen, som de intervjuade baltiska experterna är överens om, är EU:s politik för fri rörlighet socialt och ekonomiskt problematiskt, även om den officiella baltiska politiken i första hand fokuserar på ‘begåvade’ och ‘nödvändiga’ diasporamedlemmars engagemang eller återvändande. Denna politik har visat sig vara otillräcklig för att ta itu med demografiska och socioekonomiska utmaningar som delvis orsakades av utvandring. De strukturella institutionella förhållandena och staternas och migranternas strategier skapar rörlighet som en social norm i länder med framträdande utvandring och bidrar till fortsatt migration, både vad gäller ‘prekära arbetskraftsmigranter’ och ‘aktiva och begåvade EU-mobila medborgare’.

This book explores the increasing concern over the extent to which those suffering from forced cross-border displacement as a result of environmental change are protected under international human rights law. Formally they are not entitled to admission or stay in a third state country, a situation that has been identified as an international "legal protection gap". The book seeks to provide answers to two basic questions: whether and to what extent existing international law protects cross-border environmental displacement, and whether and how existing formalized regional complementary protection standards can interpretively solidify and conceptualize protection for cross-border environmental displacement. The discussion outlines that the protection of the human person is not only an ex post facto obligation of states, but must be increasingly seen as an ex ante one. The analysis further suggests that the European Union regionally orientated protection regime can help states to consolidate an evolving protection paradigm of proactive and reactive measures being erected at the international level. It can also narrow the identified legal protection gaps. In so doing, it helps states to reconceptualise protection as a holistic and dynamic enterprise. This book will be of great interest to academics in law, political science and human rights, policy makers and civil society organisations both at national and international level.

The Making of Migration addresses the rapid phenomenon that has become one of the most contentious issues in contemporary life: how are migrants governed as individual subjects and as part of groups? What are the modes of control, identification and partitions that migrants are subjected to? Bringing together an ethnographically grounded analysis of migration, and a critical theoretical engagement with the security and humanitarian modes of governing migrants, the book pushes us to rethink notions that are central in current political theory such as "multiplicity" and subjectivity. This is an innovative and sophisticated study; deploying migration as an analytical angle for complicating and reconceptualising the emergence of collective subjects, mechanisms of individualisation, and political invisibility/visibility. A must-read for students of Migration Studies, Political Geography, Political Theory, International Relations, and Sociology.
