Is the European Union still a viable project? The last few years have been difficult both economically and politically, while its integrative function and legitimacy have been seriously tested. For many social, economic and geo-political reasons, its expansionary moment has stopped abruptly. On the contrary, the Greek economic crisis and the Brexit referendum have raised the spectre of fragmentation and political disintegration. The promise of the EU as a possible model for legitimate governance beyond the nation state lies somewhat in tatters. Even if the EU may indeed survive most of its current crises, is the project of a EU as a normative project beyond rescue? Ever since Maastricht, the democratic legitimacy of the EU has been a key concern of policy makers, citizens and academics alike. This issue is essentially a normative one, and over the same period our work in this area has been at the forefront in exploring what has come to be known (following an early working paper we wrote with this title in 2000) 'the normative turn in EU studies'. The debate on the democratic form and legitimacy of the EU is one that has gone on for some time and to which we, together with other scholars, have tried to contribute in the course of the last twenty years or so. Brexit is the withdrawal of the United Kingdom from the European Union. This volume addresses an important aspect of Brexit that has been ever-present in public debates, but has so far not received corresponding attention by academic scholars, namely the role of parliaments and citizens in this process. To address this gap, this book brings together an international group of authors who provide a comprehensive and multidisciplinary treatment of this subject. Specifically, the contributors, scholars from the UK and across Europe, provide diverse accounts of the role of regional, national and European parliaments and citizens from the perspectives of Law, Political Science and European Studies. This book is open access under a CC BY 4.0 license. This Open Access book investigates European citizenship after Brexit, in light of the functionalist theory of citizenship. No matter its shape, Brexit will impact significantly on what has been labelled as one of the major achievements of EU integration: Citizenship of the Union. For the first time an automatic and collective lapse of status is observed. It is a form of involuntary loss of citizenship en masse, imposed by the automatic workings of the law on EU citizens of exclusively British nationality. It does not however create statelessness and it is likely to be tolerated under international law. This loss of citizenship is connected to a reduction of rights, affecting not solely the former Union citizens but also second country nationals in the United Kingdom and their family members. The status of European citizenship and connected rights are first presented. Chapter Two focuses on the legal uncertainty that afflicts second country nationals in the United Kingdom as well as British citizens, turning from expats to post-European third country nationals. Chapter Three describes the functionalist theory and delineates three ways in which it applies to Brexit. These three directions of inquiry are developed in the following chapters. Chapter Four focuses on the intension of Union citizenship: Which rights can be frozen? Chapter Five determines the extension of Union citizenship: Who gets to withdraw the status? The key finding is that while Member states are in principle free to revoke the status of Union citizen, former Member states are not unbounded in stripping Union citizens of their acquired territorial rights. Conclusions are drawn and policy-suggestions summed up in the final chapter.

On 23rd June 2016, the United Kingdom shocked the world by voting to leave the European Union. This short book examines why this happened, examining the historical, economic, political, social and cultural reasons that led to the Brexit vote.

The decision by the people of the United Kingdom to vote in a referendum in June 2016 to leave the European Union has produced shock-waves across Europe and the world. Brexit calls into question consolidated assumptions on the finality of the EU, and simultaneously sparks new challenges. These new challenges are not only in regard of the constitutional settlements reached in the UK, notably in Scotland and Northern Ireland, but also on the future of European integration. Now that Article 50 of the Treaty on the European Union has been invoked, and the path towards full withdrawal by the UK from the EU remains clouded in uncertainties, a comprehensive legal and political analysis of how Brexit impacts on UK and the EU appears of the utmost importance. This book brings together leading lawyers, economists and political scientists to discuss the constitutional implications of Brexit and propose possible solutions for the way forward. The book is structured around four main themes. First, it considers how Brexit will be implemented legally and politically, in terms of the withdrawal and the possible new relations between the UK and the EU.
