Law And Religion In A Secular Age

eBook Download

BOOK EXCERPT:

Law and Religion in a Secular Age seeks to restore the connection between spirituality and justice, religion and law, theology and jurisprudence, and natural law and positive law by building a new bridge suitable for pluralistic societies in the secular age. The author argues for a multidimensional view of reality that includes legal, political, moral, and spiritual dimensions of human nature and society. Each of these dimensions of life needs to recognize the existence, influence, and function of the others, which act as a filter or check on the excesses of each other. This multidimensionality of reality clarifies why no legal theory can fully account for law from the legal dimension alone, just as no moral theory makes perfect sense of morality from the moral dimension?and, for that matter, nothing in physics can fully interpret the physical dimension of reality. The premises of a legal system cannot be fully explained by the legal dimension alone because the fundamental conditions and qualities of justice, freedom, and dignity touch all the dimensions of reality in which the human person acts, including the moral and the spiritual, not just the legal. Building on this multidimensional theory of reality, the author explores the core differences and the essential interconnections between law, morality, religion, and spirituality and some of the legal implications of these connections. Rafael Domingo reminds readers of the vital role of religion in shaping the conceptual framework of Western legal systems, underscores the spirit of Christianity that inspired legal institutions, principles, and values, and recalls the contributions of specific Christian jurists as central figures for the development of justice in society. Law and Religion in a Secular Age aims to be a valuable antidote against the dominant legal positivism that has cornered public morality, the defiant secularism that has marginalized religion, and any other legal doctrine that diminishes the spiritual dimension of law and justice.

Belonging To God

eBook Download

BOOK EXCERPT:

A breathtaking exploration of divine love in Christianity, Islam and Hinduism—and the writings of leading mystics from these traditions—culminating in a glorious universal path of love that is illuminated equally by modern science and ancient wisdom. There is a unified call from all religions for the human soul to follow a profound path of love that leads to union with God. Belonging to God examines the commonalities in the scriptures, writings of key mystics and core practices of Christianity, Islam and Hinduism in order to illuminate a clear universal path of divine love. It weaves the common spiritual threads into an elegant theological framework, drawing on recent scientific advances in fractal geometry and quantum physics to emphasize the transforming fire that burns on every level from macrocosm to the microcosm, thereby uniting the human soul with the heart of God. Combining decades of Eastern and Western contemplative practice with scientific research, Belonging to God concludes with twelve principles of divine love that point toward a universal spiritual path of the heart, both within and beyond the religions. Easy to comprehend and uplifting to read, this interfaith journey will appeal to seekers of all faiths interested in the path of love that bridges the world religions, as well as to believers within the Christian, Hindu and Islamic traditions who are eager to learn exactly how their particular faith intersects in a deep way with other religions. Belonging to God will also inspire students of perennial wisdom, comparative mysticism and the new science, and the large number of "spiritual but not religious" seekers who yearn for a universal path of divine love that honors—yet transcends—traditional religions.

BOOK EXCERPT:

This volume identifies and elaborates on the significance and functions of the various actors involved in the development of family law in the Middle East. Besides the importance of family law regulations for each individual, family law has become the battleground of political and social contestation. Divided into four parts, the collection presents a general overview and analysis of the development of family law in the region and provides insights into the broader context of family law reform, before offering examples of legal development realised by codification drawn from a selection of Gulf states, Iran, and Egypt. Norway Without God

eBook Download

BOOK EXCERPT:

""Norway Without God"" explores the pivotal role of Christian values in shaping Norway's national identity, legal system, and social cohesion from the Viking Age to the present day. This thought-provoking book challenges readers to consider the implications of secularization on modern societies, using Norway as a compelling case study. The author argues that Christian principles have been instrumental in building a stable and prosperous nation, and questions whether abandoning this foundation could lead to unforeseen societal challenges. The book traces Norway's historical development, examining how Christian values became intertwined with law and governance. It highlights the gradual integration of religious principles into Norwegian society, from the Viking era through the Middle Ages and beyond. By drawing on a rich tapestry of historical documents, legal texts, and archaeological evidence, the author paints a comprehensive picture of Norway's religious and cultural evolution. As the narrative progresses, ""Norway Without God"" delves into contemporary Norwegian society, analyzing the potential consequences of the rising tide of atheism and materialism. The book's unique approach lies in its critical examination of secularization, challenging readers to reconsider the often-positive narrative surrounding the retreat of religion from public life. By connecting history, law, sociology, and religious studies, this work offers valuable insights into the complex relationship between religious heritage and modern pluralism in Norway and beyond.

Diaspora And Law

eBook Download

BOOK EXCERPT:

Today, law is no longer homogenous or unquestioned. Different overlapping legal systems constantly interfere with one another, both on an international level, in complex transnational contexts such as the European Union or human rights law, but also in the context of cultural diversity or conflicts between religious norms and civil institutions, between minorities and the power of the state. On the other hand, the neutrality of law is also under growing pressure, be it from different global transnational players, or from within nation states where calls are made to adapt law to the will of "the people." The heated European debate on the "refugee crisis" has made it manifest that law is more necessary than ever and yet fundamentally contested, perhaps even caught in contradictions and self-limitations. At the same time, the current perspective on legal problems allows us to address issues of diversity and the role of Europe in the globalized world more clearly. The articles of this book take these recent developments and debates as a starting point to discuss from the perspective of different disciplines the pressing question of how to live together in the new millennium and how to figure the long history of law before, besides, and after the dominant paradigm of state law.

What Is Good And What God Demands

eBook Download

BOOK EXCERPT:

The normative rhetoric of tannaitic literature (the earliest extant corpus of rabbinic Judaism) is predominantly deontological. Prior scholarship on rabbinic supererogation, and on points of contact with Greco-Roman virtue discourse, has identified non-deontological aspects of tannaitic normativity. However, these two frameworks overlook precisely the productive intersection of deontological with non-deontological, the first because supererogation defines itself against obligation, and the second because the Greco-Roman comparate discourages serious treatment of law-like elements. This book addresses ways in which alternative normative forms entwine with the core deontological rhetoric of tannaitic literature. This perspective exposes, inter alia, echoes of the post-biblical wisdom tradition in tannaitic law, the rich polyvalence of the category mitzvah, and telling differences between the schools of Akiva and Ishmael.
