Human Rights In Action

eBook Download

BOOK EXCERPT:

Since World War II, human rights have engaged people around the world like perhaps no other discourse. In Finland their embrace represents a shift from ideological homogeneity to pluralism and openness. Human rights education is understood to hold a key role in empowering individuals to become free and equal members of their societies. Yet little empirical scholarship exists evaluating how this goal is met in reality. By combining anthropological approaches with critical legal theory, this study explores the conceptions of knowledge, expertise and learning embedded in the educational activities of a particular network of Scandinavian and Nordic human rights experts. It explores how the ideals of emancipation and equality of the abstract discourse are realized in action.

Statelessness Human Rights And Gender

eBook Download

BOOK EXCERPT:

This book explores the developing relationship between statelessness and migration. Migration law is setting the new parameters for international protection. Irregular migration is producing new forms of statelessness. International conventions on statelessness, refugees and migrant workers and international human rights instruments do not provide effective protection for these contemporary groups of stateless persons. The case study of Burmese irregular migrant workers in Thailand demonstrate that women and children are among the most unprotected because of the gendered construction of statelessness. The book concludes firstly that the 1999 CEDAW Protocol is an avenue through which stateless women may pursue redress. Secondly, it argues that it is imperative to set international law limits on state powers over immigration matters.

The Human Right To Democracy

eBook Download

BOOK EXCERPT:

The Human Right to Democracy is the first major study to offer a comprehensive and up-to-date account of the debate. It reconstructs the relevant positions in that debate, identifies the key points of disagreement, and proposes an understanding of the human right to democracy that might form the basis of a wide consensus. The book rejects the idea of a comprehensive right to democratic institutions, and instead argues for a minimal “human right to democracy” which is best understood as an individual’s right to voice. The human right to voice is a right, enjoyed by any individual independently of his or her place of residence or nationality, to be heard and supported in cases of severe injustice that is tolerated or condoned by the political community or polity of which the individual is a member. By bringing together human rights discourse and democratic theory, as well as taking into account practical politics, this study broadens the scope of the debatefrom a sometimes overly-narrow focus. The book is of interest not only to political philosophers, but also to international lawyers, diplomats, representatives of civil society, human rights activists, and specialists in development economics.

Research Methods For International Human Rights Law

eBook Download

BOOK EXCERPT:

The study and teaching of international human rights law is dominated by the doctrinal method. A wealth of alternative approaches exists, but they tend to be discussed in isolation from one another. This collection focuses on cross-theoretical discussion that brings together an array of different analytical methods and theoretical lenses that can be used for conducting research within the field. As such, it provides a coherent, accessible and diverse account of key theories and methods. A distinctive feature of this collection is that it adopts a grounded approach to international human rights law, through demonstrating the application of specific research methods to individual case studies. By applying the approach under discussion to a concrete case it is possible to better appreciate the multiple understandings of international human rights law that are missed when the field is only comprehended though the doctrinal method. Furthermore, since every contribution follows the same uniform structure, this allows for fruitful comparison between different approaches to the study of our discipline.

Human Rights Interdependence In National And International Politics

eBook Download

BOOK EXCERPT:

This book offers a fresh approach to human rights by analyzing the role of institutional checks and balances, governmentalism and system's approach, intended for the prevention of human rights violations, the enforcement of human rights norms and rules, and important actors such as International Non-Governmental Organizations (INGO), and domestic Non-Governmental Organizations (NGOs). The book presents case studies that offer innovative, political, historical, and social perspectives on how the International Human Rights Regime (IHRG) is practiced. It critically examines the interpretation, inconsistency, and application of the human rights norms in the Global South, and shows how the national mobilization of human rights is directly affected by the interdependence existing between the national and the transnational levels. This book will be of key interest to scholars, students, and practitioners of human rights, and more broadly of comparative politics, international law, global governance, international and nongovernmental organizations.
