Is it appropriate to honour and admire people who have created great works of art, made important intellectual contributions, performed great sporting feats, or shaped the history of a nation if those people have also acted immorally? This book provides a philosophical investigation of this important and timely question. The authors draw on the latest research from ethics, value theory, philosophy of emotion, social philosophy, and social psychology to develop and substantiate arguments that have been made in the public debates about this issue. They offer a detailed analysis of the nature and ethics of honour and admiration, and present reasons both in favour and against honouring and admiring the immoral. The capability approach to social justice construes a person's well-being in terms of the substantive freedoms people value. John Alexander engages with the rapidly growing body of literature on the capability approach in economics, inequality, poverty measurement and development studies. Critically assessing Sen and Nussbaum's work in normative economics, social ethics and political philosophy, Alexander develops a unified vision of the capability approach embodying the ideal of creating the greatest possible condition for the realization of basic capabilities for all. He then assesses this vision as a political theory arguing that capabilities are necessary but not sufficient for overcoming conditions of domination. The book calls for a more intimate relationship between individual liberty and the freedom of the political community as a whole

This is the first ever index of contributions to common law Festschriften and fills a serious bibliographic gap in the literature of the common law. The German word Festschrift is now the universally accepted term in the academy for a published collection of legal essays written by several authors to honour a distinguished jurist or to mark a significant legal event. The number of Festschriften honouring common lawyers has increased enormously in the last thirty years. Until now, the numerous scholarly contributions to these volumes have not been adequately indexed. This Index fills that bibliographic gap. The entries included in this work refer to some 296 common law Festschriften indexed by author, subject keyword, editor, title, honorand and date. It therefore includes over 5,000 chapter entries. In addition, there are more than a thousand entries of English language contributions to predominantly foreign language, non-common law legal Festschriften from Germany, Austria, Switzerland, Denmark, Finland, Iceland, Norway and Sweden.

This critical edition delivers a unique and comprehensive collection of the works of Ktunaxa-Secwepemc writer and educator Vera Manuel, daughter of prominent Indigenous leaders Marceline Paul and George Manuel. A vibrant force in the burgeoning Indigenous theatre scene, Vera was at the forefront of residential school writing and did groundbreaking work as a dramatherapist and healer. Long before mainstream Canada understood and discussed the impact and devastating legacy of Canada’s Indian residential schools, Vera Manuel wrote about it as part of her personal and community healing. She became a grassroots leader addressing the need to bring to light the stories of survivors, their journeys of healing, and the therapeutic value of writing and performing arts. A collaboration by four Indigenous writers and scholars steeped in values of Indigenous ethics and editing practices, the volume features Manuel’s most famous play, Strength of Indian Women—first performed in 1992 and still one of the most important literary works to deal with the trauma of residential schools—along with an assemblage of plays, written between the late 1980s until Manuel’s untimely passing in 2010, that were performed but never before published. The volume also includes three previously unpublished short stories written in 1988, poetry written over three decades in a variety of venues, and a 1987 college essay that draws on family and community interviews on the effects of residential schools.

The gradual legal and political evolution of the European Union has not, thus far, been accompanied by the articulation or embrace of any substantive ideal of justice going beyond the founders' intent or the economic objectives of the market integration project. This absence arguably compromises the foundations of the EU legal and political system since the relationship between law and justice-a crucial question within any constitutional system-remains largely unaddressed. This edited volume brings together a number of concise contributions by leading academics and young scholars whose work addresses both legal and philosophical aspects of justice in the European context. The aim of the volume is to appraise the existence and nature of this deficit, its implications for Europe's future, and to begin a critical discussion about how it might be addressed. There have been many accounts of the EU as a story of constitutional evolution and a system of transnational governance, but few which pay sustained attention to the implications for justice. The EU today has moved beyond its initial and primary emphasis on the establishment of an Internal Market, as the growing importance of EU citizenship and social rights suggests. Yet, most legal analyses of the EU treaties and of EU case-law remain premised broadly on the assumption that EU law still largely serves the purpose of perfecting what is fundamentally a system of economic integration. The place to be occupied by the underlying substantive ideal of justice remains significantly underspecified or even vacant, creating a tension between the market-oriented foundation of the Union and the contemporary essence of its constitutional system. The relationship of law to justice is a core dimension of constitutional systems around the world, and the EU is arguably no different in this respect. The critical assessment of justice in the EU provided by the contributions to this book will help to create a fuller picture of the justice deficit in the EU, and at the same time open up an important new avenue of legal research of immediate importance.

In May 1928, the body of George Edey was discovered on his Saskatchewan farm, leading to the swift arrest of a deaf and mentally disabled farmhand named Mike Hack. Following a three-day murder trial, Hack was quickly convicted and sentenced to death. Denied clemency, in January 1929 he was hanged in the courtyard of the Regina Jail at twenty-seven years of age and buried in an unmarked grave. Prairie Justice dissects this case, revealing its implications for important themes in the history of the Canadian criminal justice system. Wayne Sumner meticulously traces the narrative of the case, analysing each step from the initial murder investigation to the subsequent arrest, trial, conviction, denial of clemency, and execution of the man accused. Drawing on a personal connection to the case rooted in his family history – his father’s hometown was the village where the crime occurred, and both his grandfather and great-grandfather were involved in the investigation – Sumner uncovers deeper and more universal reasons to share the story. The book punctuates the narrative with insightful analysis on key criminal justice themes illustrated by the case: unfitness to stand trial, the defence of insanity, ineffective assistance of counsel, wrongful conviction, and miscarriage of justice. Ultimately, Prairie Justice exposes how access to justice can be merely illusory for the poor and marginalized.

The book consists of the keynote papers delivered at the 2012 WG Hart Workshop on Globalisation, Criminal Law and Criminal Justice organised by the Queen Mary Criminal Justice Centre. The volume addresses, from a cross-disciplinary perspective, the multifarious relationship between globalisation on the one hand, and criminal law and justice on the other hand. At a time when economic, political and cultural systems across different jurisdictions are increasingly becoming or are perceived to be parts of a coherent global whole, it appears that the study of crime and criminal justice policies and practices can no longer be restricted within the boundaries of individual nation-states or even particular transnational regions. But in which specific fields, to what extent, and in what ways does globalisation influence crime and criminal justice in disparate jurisdictions? Which are the factors that facilitate or prevent such influence at a domestic and/or regional level? And how does or should scholarly inquiry explore these themes? These are all key questions which are addressed by the contributors to the volume. In addition to contributions focusing on theoretical and comparative dimensions of globalisation in criminal law and justice, the volume includes sections focusing on the role of evidence in the development of criminal justice policy, the development of European criminal law and its relationship with national and transnational legal orders, and the influence of globalisation on the interplay between criminal and administrative law.

In the last two decades, the philosophy of criminal law has undergone a vibrant revival in Canada. The adoption of the Charter of Rights and Freedoms has given the Supreme Court of Canada unprecedented latitude to engage with principles of legal, moral, and political philosophy when elaborating its criminal law jurisprudence. Canadian scholars have followed suit by paying increased attention to the philosophical foundations of domestic criminal law. Because of Canada's leadership in international criminal law, both at the level of the International Criminal Court and of specific war crimes tribunals, they have also begun to turn their attention to international criminal law per se. This collection seeks to bring all these Canadian voices together for the first time, and evidence the fact that criminal law theory is no longer to be associated exclusively with the older British, German and American traditions.
