BOOK EXCERPT:

Despite acknowledging that a 'handful' of providers give him concern, the Regulator is reluctant to give them lower financial viability ratings, fearing that doing so might trigger an upward re-pricing of their debt. Instead, the Regulator uses governance ratings to signal concerns about financial viability. This practice lacks openness and should stop and accurate financial viability ratings should be published. The fear of triggering a re-pricing also prevents the Regulator from using many of his statutory powers, preferring to adopt informal approaches instead. This lacks transparency and risks too close a relationship developing between the Regulator and providers. The devolved administrations' housing regulators, not to mention regulators in other sectors, must encounter similar dilemmas. The Regulator should work with them to see how they have addressed his concern that the use of statutory powers could prove counter-productive. The Committee's concerns are underlined by the case of Cosmopolitan Housing Group, which came close to insolvency in 2012. The Regulator only lowered its financial viability rating for Cosmopolitan in December 2012, despite the fact that he had been monitoring the situation for months and the possibility of insolvency had been raised in the media two months previously. The report also raises concerns about how effectively the Regulator is discharging his remit for consumer regulation. Noting that of 111 complaints related to consumer standards referred to the Regulator no case of serious consumer detriment was found, the Report calls for an annual external check to be carried out to provide assurance that the Regulator is discharging his duties effectively

Policing The Borders Within

eBook Download

BOOK EXCERPT:

Policing the Borders Within offers an in-depth, comprehensive exploration of the everyday working of inland border controls in Britain, informed by extensive empirical material viewed through the lens of wide-ranging interdisciplinary debates. In particular, this book examines afresh the relationship between policing, borders, and social order, in terms of migration policing. By charting this new landscape of everyday contemporary policing, this book's main goal is to advance understanding of novel forms of law enforcement in a global age. These new forms of collaboration direct attention to the way in which frontline enforcement agents, through their everyday work, not only enforce the border, but recreate it. As the book argues, the emphasis on borders and migration controls and the growing importance of it within inland policing is a symptom of the new demands and challenges facing the state in exercising authority in a fast-moving, interconnected world, and its attempt to offer a semblance of order. Such challenges result in practice of random, capricious, informal, and arbitrary operation of power, which relies on non-rational elements to solve policing problems. Through an ethnography of the worlds of police and immigration officers, this book dissects the ethical, political, legal, and social dilemmas, and explores the tensions and contradictions of maintaining order in a deeply unequal globalized world. The new impetus to police migration is an insightful entry point to understand law enforcement in a global age.

BOOK EXCERPT:

Public Law is a high quality introductory textbook that comprehensively covers the key topics found on undergraduate public law courses. Three key themes that permeate all of the content allow students to approach the content in a structured and easy to understand way and questions posed throughout the chapters give students the opportunity to provide answers that show how their knowledge has increased as the chapter progresses. The key themes are: -The significance of executive power in the contemporary constitution and the challenge of ensuring that those who wield it are held to account -The shift in recent times from a more political to a more legal constitution and the implications of this change -The increasingly 'multi-layered' character of the British constitution Online Resource Centre Public Law is accompanied by a free, open-access Online Resource Centre (www.oxfordtextbooks.co.uk/orc/elliott_thomas) which offers the following resources to support students: - Figures from the book reproduced online - A list of useful websites for students - Regularly posted legal and political updates for the book - A testbank of questions for tutors to assess students' progress This book has been highly endorsed by lecturers for level of coverage, accuracy, and the manner in which the three themes provide an excellent backdrop to the book's content. 'I think it will be a very welcome addition to the range of text books available and I suspect that it will become my personal favourite.' - Barbara Mauthe; Lancaster University 'I found the book impressive and likely to be of interest and use to a great many. It is written in a style that is pitched about the right level. It was easy to understand and provides - for me - a good blend of black letter law and socio-political context' - David Mead; University of East Anglia Written by two experienced teachers of the subject, Public Law is an essential new text that focuses on what students need to engage with and understand this challenging subject.
