Effective human rights advocacy and research require the use of statistics, carefully collected and objectively analyzed and presented, using the best techniques available. Statistics that lack credibility are of little value. Those that can be defended against critics can be effective in throwing the light on violations and promoting the observance of human rights for all. This book analyses the compatibility of data retention in the UK with the European Convention on Human Rights (ECHR). The increase in the use of modern technology has led to an explosion of generated data and, with that, a greater interest from law enforcement and intelligence agencies. In the early 2000s, data retention laws were introduced into the UK, and across the European Union (EU). This was met by domestic challenges before national courts, until a seminal ruling by the Court of Justice in the European Union (CJEU) ruled that indiscriminate data retention was incompatible with EU law. Since then, however, the CJEU has revised its position and made certain concessions, particularly under the guise of national security. This book focuses on data retention in the UK with the principal aim of examining compatibility with the ECHR. This is explored through a variety of ways including providing an account of democracy and why secret surveillance poses a threat to it, a history of data retention, assessing the seriousness that data retention poses to fundamental rights, the collection of rights that are affected by data retention which are crucial for a functioning democracy, the implications of who can be obligated to retain (and what to retain), the idea that data retention is a form of surveillance and ultimately, with all things considered, whether this is compatible with the ECHR. The work will be an invaluable resource for students, academics, researchers and policy-makers working in the areas of privacy, human rights law and surveillance.

This report from the Joint Committee of Human Rights (HLP 72/HCP 132, ISBN 9780104012468) examines issues surrounding data protection and human rights, particularly in relation to the recent loss of data by government departments. Personal data should be handled in accordance with the Data Protection Act (PGA 1998 chp. 29, ISBN 9780105429982), whilst the Human Rights Act (PGA 1998 chp. 42, ISBN 9780105442981) safeguards the right to respect personal information. The Committee has expressed concern about the recent lapses in the protection of data in particular where the sharing of information takes place, and that such sharing needs to be justifiable and appropriate. The Committee fundamentally disagrees with the Government's approach about data protection and does not agree that the two Acts offer sufficient protection, and that further primary legislation is needed to make clear the importance of data protection inside and outside government. The Committee also states that the recent lapses are indicative of a symptomatic failure within government to safeguard personal data and that human rights are far from being a mainstream consideration in Government department's. The Committee states that Government needs to set out proposals to rectify this situation. The Committee supports the extension of the Information Commissioner's powers to defend human rights, but expresses regret that it has taken the loss of personal data affecting 25 million people for the Government to take the issue of personal data more seriously. Comparative politics often involves testing of hypotheses using new methodological approaches without giving sufficient attention to the concepts which are fundamental to hypotheses, particularly the ability of these concepts to ‘travel’.
