Human Rights at Risk brings together social scientists, legal scholars, and humanities scholars to analyze the policy challenges of human rights protection in the twenty-first century. The book focuses on international institutions, thematic blind spots in policy-making, and the role of the United States as a global and domestic actor in human rights protection.

This book assesses the construction, operation and effects of the international protection regime for human rights defenders, which has evolved significantly over the last twenty years in response to the risks people face as they promote and protect human rights. Drawing upon the experiences of human rights defenders who continue to persevere in their activism in Indonesia, Egypt, Kenya, Mexico and Colombia, this edited collection examines the ways in which formal protection mechanisms by state and civil society actors intersect with self-protection measures and informal protection initiatives by families and friends. It highlights that protection practices are most effective when they are designed to address the specific risks that human rights defenders face (which are gendered and intersectional); reflect how defenders understand ‘risk’, ‘security’ and ‘protection’; and are appropriate for the dynamic sociopolitical and legal contexts in which defenders operate. This book proposes ways in which the protection of human rights defenders at risk should be reimagined and practised. This book will be a thought-provoking guide for students and scholars of politics, international relations, law and human rights, as well as to practitioners engaged in the protection of human rights defenders at risk.

When Business Harms Human Rights uses reported narrations to discuss and analyze the experiences of individuals and communities from around the world, and examines the impact that business activities has had on their lives. The volume is situated within the broader subject area of business and human rights, and uses various methodologies to share the perspectives of affected individuals and communities. The narratives collected here follow rights holders in their attempts to secure remedies, and examine the impact of the emerging legal regime of business and human rights.

Traditionally, human rights have protected those facing the sharp edge of the criminal justice system. But over time human rights law has become increasingly infused with duties to mobilise criminal law towards protection and redress for violation of rights. These developments give rise to a whole host of questions concerning the precise parameters of coercive human rights, the rationale(s) that underpin them, and their effects and implications for victims, perpetrators, domestic legal systems, and for the theory and practice of human rights and criminal justice. This collection addresses these questions with a focus on the rich jurisprudence of the European Court of Human Rights (ECtHR). The collection explores four interlocking themes surrounding the issue of coercive human rights: First, the key threads in the doctrine of the ECtHR on duties to mobilise the criminal law as a means of delivering human rights protection. Secondly, the factors that contribute to a readiness to demand coercive measures, including discrimination and vulnerability, and other key justificatory reasoning shaping the development of coercive human rights. Thirdly, the most pressing challenges for the ECtHR's coercive duties doctrine, including: - how it relates to theories and rationales of criminalisation and criminal punishment; - its implications for the fundamental tenets of human rights law itself; - its relationship to transitional justice objectives; and - how (far) it coheres with the imperative of effective protection for persons in precarious or vulnerable situations. Fourthly, the (prospective) evolution of the coercive human rights doctrine and its application within national jurisdictions.

Climate Change already having serious impacts on the lives of millions of people across the world. These impacts are not only ecological, but also social, economic and legal. Among the most significant of such impacts is climate change-induced migration. The implications of this on human rights raise pressing questions, which require serious scholarly reflection. Drawing together experts in this field, Climate Change, Migration and Human Rights offers a fresh perspective on human rights law and policy issues in the climate change regime by examining the interrelationships between various aspects of human rights, climate change and migration. Three key themes are explored: understanding the concepts of human dignity, human rights and human security; the theoretical nexus between human rights, climate change and migration or displacement; and the practical implications and challenges for lawyers and policy-makers of protecting human dignity in the face of climate change and displacement. This book aims at gauging whether the nature of US foreign policy decision-making has changed after the Cold War as radically as a large body of literature seems to suggest, and develops a new framework to interpret presidential decision-making in foreign policy. It locates the study of risk in US foreign policy in a wider intellectual landscape that draws on contemporary debates in historiography, international relations and Presidential studies. Based on developments in the health and environment literature, the book identifies the President as the ultimate risk-manager, demonstrating how a President is called to perform a delicate balancing act between risks on the domestic/political side and risks on the strategic/international side. Every decision represents a ‘risk vs. risk trade-off,’ in which the management of one ‘target risk’ leads to the development ‘countervailing risks.’ The book applies this framework to the study three major crises in US foreign policy: the Cuban Missile Crisis, the seizure of the US Embassy in Tehran in 1979, and the massacre at Srebrenica in 1995. Each case-study results from substantial archival research and over twenty interviews with policymakers and academics, including former President Jimmy Carter and former Senator Bob Dole. This book is ideal for postgraduate researchers and academics in US foreign policy, foreign policy decision-making and the US Presidency as well as Departments and Institutes dealing with the study of risk in the social sciences. The case studies will also be of great use to undergraduate students.

The FCO was timid and inconsistent in the discussions which led to the decision to award to Sri Lanka the right to host the 2013 CHOGM. It should have taken a more robust approach since, in the light of continuing human rights abuses in the country. In 2009 the FCO objected to Sri Lanka hosting the 2011 CHOGM but did not obstruct a proposal that it might do so in 2013, nor did it insist that Sri Lanka's right to host in 2013 should be conditional on improvements in human rights. The Committee took evidence from the BBC World Service on jamming and denial of access to its broadcast and internet services, particularly in Iran and China. The Committee calls on the BBC to recognise in future funding plans the need to provide the resources necessary to afford protection. All providers of satellite services have a commercial interest in defeating jamming. The report considers Government policy on human rights in Burma and concludes that the EU's decision to lift economic sanctions in April 2013 was the right one, given the remarkable progress made in Burma. But it warns that the UK should be prepared to advocate re-imposition of sanctions if undertakings on human rights are not followed through. The Government should also urge condemnation of those responsible for violence in Rakhine State in 2012. The Committee does not support suggestions that the 2014 Winter Olympic and Paralympic Games should be boycotted in protest against human rights abuses in Russia

Do anthropogenic greenhouse gas emissions affect human rights? Should fundamental rights constrain climate policies? Scientific evidence demonstrates that anthropogenic greenhouse gas emissions contribute to increasing atmospheric temperatures, soon passing the compromising threshold of 2° C. Consequences such as Typhoon Haiyan prove that climate alteration has the potential to significantly impair basic human needs. Although the United Nations Framework Convention on Climate Change and human rights regulatory regimes have so far proceeded separately, awareness is arising about their reciprocal implications. Based on tripartite fundamental obligations, this volume explores the relationship between climate change and interdependent human rights, through the lens of an international and comparative perspective.
