Land Expropriation In Israel

eBook Download

BOOK EXCERPT:

Historically, Israel's Supreme Court has failed to limit the state's powers of expropriation and to protect private property. This book argues that the Court's land expropriation jurisprudence can only be understood against the political, cultural and institutional context in which it was shaped. Security and economic pressures, the precarious status of the Court in the early years, the pervading ethos of collectivism, the cultural symbolism of public land ownership and the perceived strategic and demographic risks posed by the Israeli Arab population - all contributed to the creation of a harsh and arguably undemocratic land expropriation legal philosophy. This philosophy, the book argues, was applied by the Supreme Court to Arabs and Jews alike from the creation of the state in 1948 and until the 1980s. The book concludes with an analysis of the constitutional change of 1992 and its impact on the legal treatment of property rights under Israeli law.

BOOK EXCERPT:

Through diversity, America has grown strong as a nation. Although all segments of the population share certain life patterns and basic beliefs, there are many differences in traditional lifestyles and cultures among ethnic groups. Respect for such differences is a benchmark of a democratic nation. Migrants, Immigrants, and Slaves documents the fact that all American ethnic groups have been both the oppressed and the oppressors. The book is written for introductory American history, ethnic studies, and sociology courses. Special attention is given to the immigration patterns and cultural contributions of more than 50 ethnic groups.

Immigration And Democracy

eBook Download

BOOK EXCERPT:

Immigration is one of the most polarizing issues in contemporary politics. It raises questions about identity, economic well-being, the legitimacy of state power, and the boundaries of membership and justice. How should we think about immigration and what policies should democratic societies pursue? Some contend that borders should generally be open and people should be free to migrate in search of better lives. Others insist that governments have the right to unilaterally close their borders and should do so. In Immigration and Democracy, Sarah Song develops an intermediate ethical position that takes seriously both the claims of receiving countries and the claims of prospective migrants. She argues that political membership is morally significant, even if morally arbitrary. Political membership grounds particular rights and obligations, and a government may show some partiality toward the interests of its members. Yet, we also have universal obligations to those outside our orders. Where prospective migrants have urgent reasons to move, as in the case of refugees, their interests may trump the less weighty interests of members. What is required is not open or closed borders but open doors. An accessible ethical framework that clarifies and deepens the ideas with which members of democratic societies can debate immigration, Immigration and Democracy considers the implications of a realistically utopian theory for immigration law and policy.

Towards Defragmenting The Management System Of Lake Chilwa Basin Malawi

eBook Download

BOOK EXCERPT:

The book presents results of the Defragmenting African Resource Management (DARMA) Project covering the Lake Chilwa basin in Malawi. The central theme is that, in order to ensure resource base sustainability, research and management within the basin should adopt an ecosystems approach. Presently, research and management of the basin is sector-based, hence resource user conflicts are increasing. User demand for various resources is increasing rapidly, mainly due to population increase and lack of alternative economic activities, thereby presenting challenges to sustainable resource management. Specific areas of sectoral interconnections are highlighted and defragmentation options suggested. (Series: Defragmenting African Resource Management [DARMA] - Vol. 1)
