A distinctive contribution to the politics of citizenship and immigration in an expanding European Union, this book explains how and why differences arise in responses to immigration by examining local, national and transnational dimensions of public debates on Romanian migrants and the Roma minority in Italy and Spain.

Drawing upon socio-legal research, this insightful book considers labour migration within the context of ('eastward') European Union enlargement. Specifically, this volume explores the legal rights of accession nationals to access employment, their experiences once in work and their engagement with broader family and social entitlement. By combining analysis of the legal framework governing free movement-related rights with analysis of qualitative data gained from interviews with Polish migrants, this volume is able to speculate on the significance the status of Union citizenship holds for nationals of the recently-acceded CEE Member States. Citizenship is conceptualised not merely as rights but as a practice; a real 'lived' experience. The citizenship status of migrants from the CEE Member States is shaped by formal legal entitlement, law in action - as it is implemented by the Member States and 'accessed' by the migrants - and social and cultural perceptions and experiences 'on the ground'.

Three years ago the Faculty of Law and Administration of the University of Silesia and the Faculty of Law of the University of Leicester embarked on a joint research and academic co-operation programme with the support of the British Council in Warsaw. The programme resulted in the organisation of two academic conferences, one in Leicester and one in Katowice. This book is the tangible result of these conferences. The content of the book reflects the wide-ranging nature of the collaboration between the two Faculties. Environmental law, public international law, intellectual and cultural property law are the main areas that are covered, but certain issues of constitutional law, European law, social law, company law and legal education are also addressed. The main strength of this book is found in its breadth of coverage and the detailed examination of key issues such as the rights of minorities; the transboundary movement of waste in Europe and the environmental problems which it creates; the theft and illegal exportation of cultural property; and the convergence of the droit d'auteur and copyright traditions.

Using mobility as a unique angle of approach, the Handbook of Human Mobility and Migration is a pioneering assessment of the theoretical concerns, empirical questions and issues of governance surrounding international mobility and migration today.

This book studies the normative intersection between integration, immigration and nationality in the European Union (EU). It examines the relationship between integration and the legal frameworks of admission, stay and access to nationality by third country nationals at national and European levels. Integration is being subject to multifaceted processes transforming its traditional policy and legal settings, as well as its classical theoretical premises and approaches. The Europeanisation of immigration policy has provoked the emergence of distinctive European approaches on integration. The legal elements of integration are being developed through two parallel settings: the EU Framework on Integration and European immigration law. These venues constitute two of the main pillars upon which the common EU immigration policy is being constructed, and their nexus raises several elements in need of reflection and study. This book examines the processes through which integration becomes a norm in nationality and immigration law and policy at the national and EU levels, and the implications of these processes for the legal status of third country nationals and the overall coherency of the common EU immigration policy.

Unequal life-chances became a key feature of cross-border migration to, and within, the enlarged Europe. Combining transnational, intersectional and cultural-sociological perspectives, this book develops a conceptual tool to analyse patterns, contexts and mechanisms of these cross-border inequalities. This book synthesizes the theories of social boundaries and of intersectionality, approaching cross-border relations as socially generated and as an inherent element of contemporary social inequalities. It analyses the mechanisms of cross-border inequalities as ‘regimes of intersection’ relating spatialized cross-border inequalities to other types of unequal social relations (in terms of gender, ethnicity/race, class etc.). The conceptual arguments are supported by empirical research on cross-border migration in Europe: migration of scientists and care workers between Ukraine and Germany. This book integrates the analysis of space – including cross-border categories of global and transnational – into intersectionally-informed studies of social inequalities. Broadly, it will appeal to scholars and students in the areas of sociology, political sciences, social anthropology and social geography. In particular, it will interest researchers concerned with transnational and global social inequalities, the interplay of the categories ‘gender’, ‘ethnicity’ and ‘class’ on the one hand and global and transnational relations on the other, theories of space and society, and migration and mobility in Europe.

The Oxford Handbook of Global Studies provides an overview of the emerging field of global studies. Since the end of the Cold War, globalization has been reshaping the modern world, and an array of new scholarship has risen to make sense of it in its various transnational manifestations-including economic, social, cultural, ideological, technological, environmental, and in new communications. The editors--Mark Juergensmeyer, Saskia Sassen, and Manfred Steger--are recognized authorities in this emerging field and have gathered an esteemed cast of contributors to discuss various aspects in the field through a broad range of approaches. Several essays focus on the emergence of the field and its historical antecedents. This book maps out, from a variety of theoretical standpoints, the challenges generated by European integration and EU citizenship for community membership, belonging and polity-making beyond the state. It does so by focusing on three main issues of relevance for how EU citizenship has developed and its capacity to challenge state sovereignty and authority as the main loci of creating and delivering rights and protection. First, it looks at the relationship between citizenship of the Union and European identity and assesses how immigration and access to nationality in the Member States impact on the development of a common European identity. Secondly, it discusses how the idea of solidarity interacts with the boundaries of EU citizenship as constructed by the entitlement and capacity of mobile citizens to enjoy equality and social rights as EU citizens. Thirdly, the book engages with issues of EU citizenship and equality as the building blocks of the EU project. By engaging with these themes, this volume provides a topical and comprehensive account of the present and future development of Union citizenship and studies the collisions between the realisation of its constructive potential and Member State autonomy.

This book employs methods from comparative law to analyze voluntary migration, exploring the free movement of immigrants and their freedom of settlement under Brazilian and Mercosul law, as well as under German law and the European Union’s legal framework on migration. It discusses the level of protection granted to immigrants in terms of their right to enter and stay in Brazil and Mercosul, using German legislation and the EU’s legal framework on migration for comparison. Accordingly, the book will help migration researchers to understand not only the structure and rationale of migration law in Brazil, especially after the entry into force of its recent Migration Law in 2017, but also its relation to EU and German provisions on voluntary migration. It demonstrates how the differing natures of the migration law adopted by Brazil and Germany have led to different approaches and, consequently, different levels of protection for immigrants.
