The Indonesian Journal of International & Comparative Law: Socio-Political Perspectives is a forum for progressive domestic entrenchement of the cosmopolitan values that has been going on for over six decades at the international plane which is an initiative of the Institute for Migrant Rights, an academic based initiative that emphasize the inadequacy of the prevailing models that tends to exemplify the State centrality in international issues. As the Institute noted in its founding document, "the traditional models of advocacy that predominate have produced very limited results in terms of actual government protection for this population [that] failed to link the international law and human rights." As a result, "[i]nternational mechanisms has rarely been used or considered neither by the activists or scholars." To support this pioneering undertaking, the Journal is intended to publish cutting edge multidisciplinary works that promote the introduction of cosmopolitan democracy in Non-western society that support the further acceptance of universal human rights protection beyond the conventional notion of the citizens' rights.

The Indonesian Journal of International & Comparative Law (IJICL) is published under the auspices of the Institute for Migrant Rights (IMR), Cianjur—Indonesia. The idea behind its establishment grew out of the concern over an impasse in contemporary and comparative legal scholarship in Indonesia and the region in general. As a transnational scholarly project, the Journal provides a forum for legal practitioners and scholars from the Republic of Indonesia, Asia, and elsewhere to discuss a broad range of issues relating to “law.” As States become more integrated, there is a pressing need to respond to the climate where legal, social, and political issues increasingly cross national boundaries in their impact. The Journal, in its global reach, is designed to address these considerations by challenging the orthodoxies that once considered “progressive.” Its primary purpose is to provide a new forum for emerging perspectives on international and comparative legal issues, especially those that implicate non-Western regions or cultures. In that respect, the Journal—through its publications—aims to enrich existing approaches to legal analysis and widen the proper ambit of legal studies in the Global South. The Journal is thus particularly interested in considering submissions that invoke creative outlooks on “law” and present arguments that go beyond doctrinal analysis. We strongly encourage works that aim to generate practical impact in policy-making at all levels. The Journal welcomes theoretical, historical, comparative, and inter-disciplinary manuscripts covering legal issues in any jurisdiction, as well as notes and book reviews examining the impact of rapidly changing legal regimes on specific areas or sub-disciplines of legal studies.

In this era of globalization, International Law plays a significant role in facing rapid development of various legal issues. Cultural preservation has emerged as an important legal issue that should be considered by States. This book consists of academic papers presented and discussed during the 9th International Conference of the Centre of International Law Studies (9th CILS Conference) held in Malang, Indonesia, 2-3 October 2018. The title of the book represents the major theme of the conference: "Culture and International Law." It is argued that along with globalization, cultural preservation is slowly ignored by States. Various papers presented in the book cover five topics: cultural heritage; cultural rights; culture and economic activity; culture and armed conflict; and a general topic. The authors of the papers are outstanding academics from various countries, Lithuania, United States of America, Australia, Thailand and Indonesia. The conference was organized by Universitas Indonesia in collaboration with Brawijaya University. This book aims to give a useful contribution to the existing literature on International Law, specifically focussing on cultural issues from the perspective of cultural heritage and rights, economic as well as armed conflict.

Among international financial centres (IFCs), London is known as the ‘Western hub of Islamic Finance’, on account of its well-developed legal infrastructure. However, Brexit has threatened London’s status and consequently, the financial services industry is moving to Dublin to continue operating in the Euro region. Similarly, Islamic finance (IF) service providers in the UK are also looking to Dublin for expansion of this niche area in euro member states. This is the first book to be written about Islamic finance operations in the Eurozone. Indonesia has a growing population of almost 300 million people, it is increasingly involved in world affairs, and has a booming economy. The need to better understand its unique, complex, and often obscure legal system, has become pressing. This is true across a wide range of sectors including, but not limited to, trade and investment, crime and terrorism, and human rights. Indonesia's democratization after the fall of Soeharto in 1998 triggered massive social and political changes that opened up this diverse, and formerly tightly-controlled, society. Law reform was a key driver of Indonesia's transformation and its full effect remains to be seen. Marriage is central to Indonesia’s social fabric and critical in defining socially legitimate relationships. This book offers a rich anthropological account of Muslim Indonesian women’s experiences of courtship, love, marital discord and separation, polygamy, divorce and remarriage. By applying a new approach to theorising marital experiences as playing out across a dynamic marital continuum, it expands static and dichotomous understandings of marriage and divorce. It offers new insights on how local modalities of Islam shape gender relations and are actively negotiated by women in pursing their marital desires. The book draws upon ethnographic case studies from the eastern Indonesian island of Lombok where early marriage, divorce and remarriage, are common place for Muslim women. In this context up to 70 per cent of marriages are legitimated through Islamic ceremonies and remain unregistered with the state. While these unregistered marriages are legally valid within the communities in which they occur, such unions exclude women from accessing the marital rights theoretically enshrined in Indonesian marriage law. A key contribution of this book lies in its exploration of legal plurality in relation to Indonesian marriage, which involves investigating the salience of Islamic law, local customary law and state law, for women’s varied marital trajectories.

This novel and original book examines and disaggregates, theoretically and empirically, operations of power in international security regimes. These regimes, varying in degree from regulatory to prohibitory, are understood as sets of normative discourses, political structures and dependencies (anarchies, hierarchies, and heterarchies), and agencies through which power operates within a given security issue area with a regulatory effect. In International Relations, regime analysis has been dominated by several generations of regime theory/theorization. As this book makes clear, not only has the IR Regime Theory been of limited utility for security domain due to its heavy focus on economic and environmental regimes, but it, too, heuristically suffered from its rigid pegging to general IR Theory. It is not surprising then that the evolution of IR Regime Theory has largely been mirroring the evolution of IR Theory in general: from the neo-realist/neo-liberal institutionalist convergence regime theory; through cognitivism; to constructivist regime theory. The commitment of this book is to remedy this situation by bringing together robust power analysis and international security regimes. It provides the reader with a theoretically and empirically uncompromising and comprehensive analysis of the selected international security regimes, which goes beyond one or another school of IR Regime Theory. In doing so, it completely abandons existing, and piecemeal, analysis of regimes within the intellectual field of IR based on conventional grand/mid-range theorization.

With a diverse group of contributors from law, business and the social sciences, this book explores the line not only between order and disorder in global affairs, but also chaos and control, continuity and change, the core and the margins. The key themes include: global crises and the role of international law, norms and institutions; the challenge of pluralism to regulatory clarity; and critical assessments of taken-for-granted systems and values such as capitalism, centralised government, de-militarisation and the separation of powers. The book divides into two key parts. The first part, `Conceptions’, considers the diverse way in which order/disorder can be conceived in global governance and regulation. The second part, `Case Studies’, groups chapters around five topic areas: citizens, capitalism, conflict, crime and courts. The authors here build on the themes presented in the first part by embedding them within specific areas of international regulation, such as international criminal law, maritime law or finance regulation; jurisdictions and regions, such as Australia, Canada, China, Japan and South Asia; and subject-matter, such as water resources, citizenship, statelessness and public interest litigation. This blend of contemporary subject-matter, empirical studies, multi-disciplinary perspectives and academic theories provides a comprehensive analysis to current and emerging debates in the broader global community. In utilizing interdisciplinary studies to draw out common issues and alternative solutions, the book will appeal to a wide readership among academics and policy-makers.

Drawing on human rights discourse and a study of the difficulties faced by religious minority groups (using the Ahmadiyya minority group as a case study), this book presents three interconnected challenges to human rights culture in Indonesia. First, it presents a normative challenge, describing the gap between philosophical and normative principles of human rights on one side and the overall problems and critical issues of human rights at national and local levels on the other. Second, it considers the political problems in developing and strengthening human rights culture. The political challenge addresses the ability (or inability) of the state to guarantee the rights of certain individuals and minority groups. Third, it examines the sociological challenge of majority-minority group relationships in human rights discourse and practices. This book describes the background of human rights in Indonesia and reviews the previous literature on the issue. It also presents a comprehensive review of the discourses about human rights and political changes in contemporary Indonesia. The analysis focuses on how human rights challenges affect the situation of religious minorities, looking in particular at the Ahmadiyya as a minority group that experiences human rights violations such as discrimination, persecution, and violence. The study fills out its treatment of these issues by examining the involvement of actors both from the state and society, addressing also the politics of human rights protection.
