This book addresses the complexity of talking about normativity in bioethics within the context of contemporary multicultural and multi-religious society. It offers original contributions by specialists in bioethics exploring new ways of understanding normativity in bioethics. In bioethical publications and debates, the concept of normativity is often used without consideration of the difficulties surrounding it, whereas there are many competing claims for normativity within bioethics. Examples of such competing normative bioethical discourses can be perceived in variations and differences in bioethical arguments within individual religions, and the opposition between bioethical arguments from specific religions and arguments from bioethicists who do not claim religious allegiance. We also cannot merely assume that a Western understanding of normative bioethics will be unproblematic in bioethics in non-Western cultures and religions. Through an analysis of normativity in Christian, Hindu, Buddhist, Islamic, and Jewish bioethics, the book creates awareness of the complexity of normativity in bioethics. The book also covers normative bioethics outside an explicitly religiously committed context, and specific attention is paid to bioethics as an interdisciplinary endeavor. It reveals how normativity relates to empirical and global bioethics, which challenges it faces in bioethics in secular pluralistic society, and how to overcome these. By doing that, this book fills an important gap in bioethics literature.

The four articles, two review essays, various book reviews, and obituary contained in this issue all revolve around contestations of Islamic authority. Notably, two of these articles are drawn from the AJIS symposium on Maqāṣid whose first set of essays were featured in the previous issue (38:3-4) dedicated to the topic. In the first article, “Agents of Grace,” Ali Altaf Mian develops a sophisticated and nuanced reading of “intentionality” in the work of the moral theologian al-Ghazali. Mian reads the latter’s work to disclose ethical action as a site of contingency and ambivalence, indeed of the subject’s “non-sovereignty.” He contributes this theorization of intentionality as a constructive critique of accounts of ethical agency in the anthropology of Islam. In the second article, “No Scholars in the West,” Emily Goshey carefully unpacks the ostensible paradox by which Western Salafis who studied in the Muslim world are not seen as “scholars” by the very communities they lead. What then comprises religious authority and scholarship within these models of knowledge transmission? Goshey tracks the dynamics of scholarship and community leadership based on fieldwork with African American Salafi affiliate communities in Philadelphia. In the third article, “Maqāṣidi Models for an ‘Islamic’ Medical Ethics,” Aasim Padela presents a typology of maqāṣid-based approaches to medical ethics. Whether requiring a field-based redefinition, a conceptual extension, or a text-based postulation of the classical maqāṣid theory, however, Padela shows that these frameworks remain woefully underdeveloped to offer appropriate and sufficient guidance for pressing bedside cases. In the fourth article, “Developing an Ethic of Justice,” Thahir Jamal Kiliyamannil offers a creative rereading of new Muslim movements in South India. Rather than relying on old typologies about political Islam or secularized activists, he considers the Solidarity Youth Movement to articulate an Islamic ethic of justice inspired by Abul A’la Maududi. This case study shows not only how the maqāṣid framework may inform discourses well beyond the domains of legal practice, but also how this specific articulation of political justice is based in the praxis of the Indian Muslim minority. These four articles and the remaining elements of the issue foreground contemporary contestations of Islamic authority. Read together, they also offer a set of terms for thinking productively about its contours, limits, affordances, and possibilities.

This book includes a number of distinct religious and secular views on the anthropological, ethical and social challenges of reproductive technologies in the light of human rights and in the context of global bioethics. It includes contributions of bioethics experts from six major religions—Buddhism, Confucianism, Christianity, Islam, Hinduism and Judaism—as well as secular authors. Medical research involving human subjects has contributed to considerable advancements in our knowledge, and to medical benefits. At the same time the development of new technologies as well as further globalisation of medical research raises questions that require the attention of researchers from a range of disciplines. This book gathers the contributions of researchers from nine different countries, who analyse recent developments in medical research from ethical, historical, legal and socio-cultural perspectives. THE CONTEMPORARY postnormal world is posing for Muslims ever strange ethical, financial, and medical dilemmas for which modern jurists are expected to provide a suitable theological response. Yet even with an encyclopedic knowledge of Islamic law, the task facing them is daunting. In the real world this level of complexity has led to chaos in fatwa issuance with many scholars voicing concern at the direction to which things are moving and calling for the process to be regulated. This book critiques fatwa issuance in the modern context and calls for application of a synthesized approach using the mechanism of collective ijtihad to formulate rulings and overcome current weaknesses. It carefully examines central juristic concepts and puts forward consultative ijtihad as a viable alternative to the controversial classical ijma' approach which may be difficult to realize in the contemporary world. The author argues that fatwas become questionable when jurists, out of their depth, fail to grasp concepts which only engagement with specialists can fully elucidate, or give way to top down financial and/or political pressure from the executives of institutions employing them. Matters are compounded by the face of fatwas having undergone a radical transformation in modern times with online programs and social media often a go-to source for Muslims. The author exposes the world of modern fatwa pronouncements – packaged, supplied and broadcast in a matter of minutes, under a mentality of one-fatwa-fits-all. In a bid for much needed reform he calls for a reassessment of current institutional practices contending that Muslim societies need not be vulnerable to the demands of a media driven, technocratic age, with rapid shifts in ethical norms, but that, in the interests of a healthy functioning society, issue fatwas cognizant of the wider modern context, specialist knowledge, as well as the cultural diversity that exists in the common Ummatic identity.
