Dieser Tagungsband enthält die Referate der 12. Basler Kunstrechtstagung Kunst & Recht / Art & Law vom 16. Juni 2023. Der Tagungsband wird mit dem Referat vom US-Kunstrechtler Stephen K. Urice über die überraschenden transatlantischen Entwicklungen im Zusammenhang mit der Frage des «Deaccessioning» von Museumsgut eröffnet. Reto M. Hilty behandelt danach die Werkausführung im Auftrag am Beispiel der «Paris Bar» und Niklaus Ruckstuhl geht mit seinen Ausführungen zu Steinstossen als Kulturgut auf die revidierten Bestimmungen im KGTG ein. Ann Demeester, die Direktorin des Kunsthauses Zürich, berichtet in ihrem Referat «Bilder und ihre Biographie – über Chancen und Fallstricke bei musealen Präsentationen» in englischer Sprache. Hiernach widmet sich Rolf Bolwin der Problematik der künstlerischen Verantwortung von Kollektiven am Beispiel der Documenta 22. Den Abschluss des Tagungsbandes bildet das Referat von Sandrine Giroud zu Fragen der Beschlagnahmung und Einziehung von Kulturgut durch Anwendung von internationalen Sanktionen und durch internationale Strafrechtshilfe.

The illicit traffic in cultural objects is a grave concern to the general public and international community. The resulting cultural damage fuels debates on how best to regulate the trade in cultural objects and inform legal responses at all levels for the protection of movable cultural heritage. Treaties concerning the treatment of cultural objects during peacetime and war represent some of the earliest multilateral initiatives on cultural heritage in the modern era. They also remain some of the most deeply contested, representing shifting fault lines within the international community. Authored by leading scholars and practitioners from around the world, this Commentary is the first to cover the two leading multilateral treaties on movable cultural heritage in one volume: the Convention on the Means of Prohibiting and Preventing the Illicit Import, Export and Transfer of Ownership of Cultural Property adopted by UNESCO in 1970 and the Convention on Stolen or Illegally Exported Cultural Objects adopted by UNIDROIT in 1995. This Commentary is designed to be the authoritative text for academics, lawyers, policymakers, and diplomats on the protection and regulation of cultural objects. The treatment of cultural colonial objects is one of the most debated questions of our time. Calls for a new international cultural order go back to decolonization. However, for decades, the issue has been treated as a matter of comity or been reduced to a Shakespearean dilemma: to return or not to return. Confronting Colonial Objects seeks to go beyond these classic dichotomies and argues that contemporary practices are at a tipping point. The book shows that cultural takings were material to the colonial project throughout different periods and went far beyond looting. It presents micro histories and object biographies to trace recurring justifications and contestations of takings and returns while outlining the complicity of anthropology, racial science, and professional networks that enabled colonial collecting. The book demonstrates the dual role of law and cultural heritage regulation in facilitating colonial injustices and mobilizing resistance thereto. Drawing on the interplay between justice, ethics, and human rights, Stahn develops principles of relational cultural justice. He challenges the argument that takings were acceptable according to the standards of the time and outlines how future engagement requires a re-invention of knowledge systems and relations towards objects, including new forms of consent, provenance research, and partnership, and a re-thinking of the role of museums themselves. "This study explores the language of canon law, the legal order of the Roman Catholic Church. It seeks to bring the language of canon law into the law and language debate and in doing so better understand how the Roman Catholic Church communicates as a legal institution. It ex-amines the function of canon law language in ecclesiastical communications. It studies the character of canonical language, the grammar and terminology of canon law, and how it makes use of linguistic tricks and techniques to create its typical sound. It discusses the com-prehension difficulties that arise out of ambiguities in the law, out of transfer problems be-tween legal and common language, and out of canon law's confusing mix of legal, doctrinal, and moral norms. It reviews the potential consequences of a plain language agenda in the church. This includes an evaluation of whether dead Latin is the appropriate language for a global and cross-cultural legal order such as canon law, and a discussion of how to improve multi-language communication. It takes a closer look at ecclesiastical interpretation theory. It examines forensic language, the language of ecclesiastical tribunals, in its problematic shifting between orality and textuality"--
