This volume fills a gap in the literature regarding questions around the interactive dynamics between law and diplomacy on international trade and investment. It brings together lawyers and political scientists from Europe and Asia in an interdisciplinary effort at tracing the respective roles of law and diplomacy in the relations of the European Union (EU) with its trade and investment partners in Asia. Focusing on trade and investment relations with Asia, the EU presents a particularly interesting case as it has been a strong proponent of a rules-based international economic order for years and a frequent user of the formal procedures established in international treaties in case of disputes. At the same time, it has kept diplomatically active to adjust dispute management and international agreements to the needs and demands of the partners involved. Furthermore, not only is this region of crucial importance due to the presence of both vigorous emerging economies, like China, India and Vietnam, and more established partners, like Japan, EU-Asia relations also present a broad set of economic disputes and recent negotiation efforts analyzed in the contributions to this volume. This book highlights the emerging bidirectional interactions between Europe—primarily the EU—and Asia in the fields of political economy, development, environmental policy, security, diplomacy, and inter-institutional relations within the context of two recent global trends: the rise of China and the growing withdrawal of the U.S. from multilateral commitments. The volume incorporates nine different aspects and dimensions of Asian-European relations. In recent decades, Asia has (re-)gained rising importance on the world stage, which also entails closer interconnections with Europe. In an age of receding American global leadership and reduced commitments to its European allies, the EU and its member states have increasingly become more open to seeking and considering new partnerships. This book offers comprehensive coverage of various aspects of financial accountability around the EU budget – how it is spent via policies, how institutions engage in checking policy performance (what taxpayers’ money actually delivers), and therein, the issues of monitoring, controlling, auditing, scrutinising and communicating budgetary expenditure. Presenting conceptual and theoretical approaches including financial accountability, learning, multi-level governance, implementation and throughput legitimacy, it looks at EU institutions (European Parliament, European Court of Auditors, European Ombudsman, European Public Prosecutor’s Office) and national bodies (supreme audit institutions at the national level), examining their contact with the EU budget. It details the historical development of accountability mechanisms (the ‘statement of assurance’, financial corrections, and parliamentary oversight by the Budgetary Control Committee (CONT)), and examines policy areas such as those of agriculture, social policy and cohesion (including Structural Funds and the Common Agricultural Policy), exploring the challenges of financial accountability in practice. Given the recent introduction of non-budgetary financial instruments and tools only partly financed by the EU budget, it sheds light on new burgeoning areas such as the European Stability Mechanism (ESM) and the European Fund for Strategic Investment (EFSI) and the challenges they bring for ensuring the accountability of public money. This book provides a timely evaluation of the EU’s ability to act internationally and coordinate policy in a time when it also seeks to meet shifting demands of international cooperation. These include global sustainable development, the challenge of multilateralism and the changing geopolitical order. Analysing the networks of officials and policy professionals in EU development policy, the book yields theoretical insights into dominant processes that characterise EU governance in international cooperation and assesses their role for policy coordination. Overall, this book concludes that EU policy coordination evades intergovernmental control and demonstrates how the agency of EU institutions depends on efforts of member state officials to defend their priorities and identities.
