This book represents a comprehensive contemporary view of the current, hot, and controversial issues revolving around nuclear energy. It involves issues of international/national security where realpolitik, in terms of power politics, remain key features in State relations. States, through international law and cooperation, managed to put in place a nuclear energy management regime with the Non-Proliferation Treaty as its main pillar. The book analyzes the role of international law in this highly sensitive issue, with referral to specific cases of proliferation and the current standings in the control of nuclear energy. (Series: International Law and International Relations / Volkerrecht und internationale Beziehungen - Vol. 9) [Subject: International Affairs, Security Studies, Politics, Energy Studies, International Law]

This book analyses the German constitutional system's responses towards nuclear energy. Robert Rybski begins with a presentation of energy security as a constitutional value and explores how it connects with nuclear energy. He also examines constitutional standards derived from the German Constitution, which directly regulates nuclear energy issues within the German system of power. The book presents the structure of sources of law that are binding in the area of security of nuclear installations and considers the impact that The European Atomic Energy Community had on the German constitutional system. The final part of the book is devoted to a novel judicial concept of the so-called Restrisiko – a risk that cannot be avoided – which has been developed in the jurisprudence of the Federal Constitutional Court. The essence of this concept is an assumption that as long as the legal framework regulating nuclear energy fulfils conditions formulated in that judgment, then each citizen has to accept risks resulting from the nuclear energy sector. Covering the entire period of commercial usage of nuclear energy for power generation, this book will be of great interest to students, scholars and energy experts who are active in researching or adopting public policies related to the nuclear energy sector.

This third volume of the book series on Nuclear Non-Proliferation in International Law focuses on the development and use of nuclear energy for peaceful purposes within a contemporary global context, an interdependent characteristic of the Non-Proliferation Treaty along with disarmament and non-proliferation. The scholarly contributions in this volume explore this interrelationship, considering the role of nation States as well as international organizations such as the International Atomic Energy Agency (IAEA) in monitoring and implementing the Treaty. The 2015 Nuclear Accord with Iran and its implementation is also discussed, highlighting relevant developments in this evolving area. Overall, the volume explores relevant issues, ultimately presenting a number of suggestions for international cooperation in this sensitive field where political discussion often dominates over legal analysis. The important tasks of limiting the proliferation of nuclear weapons, ensuring the safety and security of peaceful uses of nuclear energy, and achieving nuclear disarmament under strict and effective international control, calls for the interpretation and application of international legal principles and rules in their relevant context, a task that this book series endeavours to facilitate whilst presenting new information and evaluating current developments in this area of international law. Jonathan L. Black-Branch is Dean of Law and Professor of International and Comparative Law at Robson Hall, Faculty of Law, University of Manitoba; a Barrister at One Garden Court, London; a Magistrate in Oxfordshire; a Justice of the Peace for England & Wales; a Member of Wolfson College, University of Oxford; and Chair of the International Law Association (ILA) Committee on Nuclear Weapons, Non-Proliferation & Contemporary International Law. Dieter Fleck is Former Director International Agreements & Policy, Federal Ministry of Defence, Germany; Member of the Advisory Board of the Amsterdam Center for International Law (ACIL); and Rapporteur of the International Law Association (ILA) Committee on Nuclear Weapons, Non-Proliferation & Contemporary International Law.

Nuclear breakout or nuclear weapon free zones, which do we encourage? In the past, legal studies focused on regulating military rather than peaceful uses of the atom. This volume assesses the legal regime pertaining to the peaceful transfer of nuclear technology, which includes the NPT, IAEA Statute, and the work of the nuclear supplier groups. It offers a new perspective to the interaction between international law and politics in the Middle East, a region that continues to be a hotspot for attempts at nuclear proliferation. Israel, in a state of war with most of its neighbours, turned into a nuclear power decades ago, consequently, it drove Iraq to develop a military nuclear programme. This has affected the rights of Iran as a non-nuclear weapon state to develop its peaceful nuclear capabilities. This book supports the establishment of a Middle East Zone Free of Nuclear Weapons as the only way to cease the arms race and ensure a long-lasting peace in the region.
