This book examines the state of access to criminal justice by considering the health of the lawyer-client relationship under legal aid. In the largest study of its kind for some two decades, ethnographic fieldwork is used to gain a fresh perspective upon the interaction that lies at the heart of the criminal justice system's equality of arms. The research produces two contradictory messages; in interview, lawyers claim a positive relationship with their clients while, under participant observation, there emerges quite the opposite. Paying more heed to what was seen than what was said, it is supposed that these lawyers were able to talk the talk but not walk the walk. The lawyers treat their clients with wanton disrespect; making fun of them, talking over them and pushing them to plead guilty – despite protestations to the contrary. The evidence is damning for this branch of the legal profession – and tragic for the clients who depend on them. What is responsible for this malaise...inadequate financial remuneration? Increased time pressures? Lapsed ethical training? Whatever the origin, this book is intended to show the profession that there is a problem – one that could get worse unless they choose to learn from the mistakes made by the lawyers in this study.

In 1967, after a ten-year campaign, the laws which treated all homosexual acts between males as crimes in England and Wales were altered to permit such behavior between two consenting men aged over twenty-one in private. Twenty-five years on, the profound significance of that change, and the nature of the struggle that was waged to achieve it, are not always fully appreciated. Gay people and their lifestyles are still the subjects of considerable controversy and entrenched prejudice, and today's gay rights campaigners are justified in believing that many more sweeping changes in legal and social attitudes are now called for. Quest for Justice is the inside story of the battle for the Wolfenden reforms, told by one of its main protagonists. Antony Grey was Secretary of the Homosexual Law Reform Society during much of the campaign and for some time afterwards. Here, besides giving his personal account of the reform campaign, he comments on the subsequent course of the developing movement for gay rights, and his own not always entirely harmonious relations with it. He also describes the rising power of the 'moral majority' backlash, and its bitter attacks upon the liberalisers whom it miscalled 'permissive'. Whilst expressing disappointment at the slow progress of human sexual rights during recent years, and a sense of ever greater urgency, with the advent of AIDS, for the widespread acceptance of much more frank and realistic attitudes, Antony Grey concludes on a hopeful note, foreseeing a sexually saner twenty-first century in which updated moral, social and legal attitudes will combine to promote, rather than hinder, human happiness.

Against the backcloth of perceived abuse of corporate power - alleged violations of human rights, degradation of the environment, abuse of labour, Enron-style financial scandals, and the like - the chapters in this collection examine the nature and function of the corporation as well as the way in which we should understand corporate governance and the power of transnational corporations. Central to the question is the issue of accountability, as well as the questions of social and environmental responsibility - here the authors ask whether corporations should be more accountable relative to the broader public interest, and suggest that public law approaches to accountability may offer a way forward. Consideration is also given to the most appropriate regulatory locus (local, regional, or international) and the most effective form of response to the deficit in corporate responsibility and the abuse of corporate power. For example, are transnational corporations most effectively regulated internationally (e.g., by the United Nations), regionally (e.g., by the EU or NAFTA) or locally (e.g., through stringent reporting requirements and implementation of triple bottom line standards)?

The first part of the book deals with the ways in which 'globalisation' impacts on established commitments to respect human rights. When human rights are set against, or alongside, potentially competing priorities, such as 'security' or 'economy' how well do they fare? Does it make any difference whether human rights commitments are expressed in dedicated free-standing instruments or incorporated as side-constraints (or 'collaterally') in larger multi-functional instruments? In this light, does it make sense to view a trade-centred community such as the EU as a prospective regional model for human rights? The second part of the book debates the coherence of a global order committed to respect for human rights and human dignity as one of its founding principles. If 'globalisation' aspires to export and spread respect for human rights, the thrust of the papers in this volume is that it could do better, that legitimate global governance demands that it does a great deal better, and that lawyers face a considerable challenge in developing a coherent jurisprudence of fundamental values as the basis for a just global order.

Chapter One sets the scene. Chapters Two, Three and Four focus on various challenges that globalisation poses for private law. How does substantive contract and tort doctrine that has been developed (mainly) for use within national legal systems adapt to more globalised dealings and wrongdoings? Should the source of regulation be private international law, harmonised national law, international accords (or some combination)? Chapters Five, Six and Seven focus on issues relating to access to justice (as a mode of empowerment) and its impact on the functioning of civil society. These chapters highlight a variety of procedural, professional and institutional challenges for access to justice in a globalised world. Chapter Eight considers how we are to reconcile the competing visions of the basis on which essential services are to be provided. In a global marketplace, is there any room for local values or for values other than those of free-market thinking? Finally, Chapter Nine focuses on the question of democracy in a globalised world. If civil society is to retain its political vitality, how are citizens to remain engaged and enfranchised as a new global politico-legal order takes shape?

Would it be easy to imagine a court where justice is dispensed not by women and men wearing black flowing gowns but by ordinarily dressed, uneducated women? Muslim women living in slum communities of Mumbai took upon themselves the job of providing legal aid to other distressed women. Need for justice is as crucial as other needs, especially for women who face marginalization on a large scale. This book looks closely at the genesis of these groups, their history, their interventions, their motivations and their contributions to women’s movement. The book suggests recommendations for strengthening alternative dispute resolution forums where justice will be dispensed not by learned lawyers but by ordinarily dressed unlettered women. These women, through their innate sense of justice reaches out passionately towards other equally battered women and together they journey towards a life of dignity.

This book examines facets of popular politics that are, above all, animated by a quest for justice as law, fairness and public virtue. The aim is to better understand how "the political" emerges in the interstices of state law and local moralities. The contributors to the book focus on the interplay between private and public spaces, between morality and law, and between ‘front stage’ and ‘back stage,’ to explore how the common quest for justice, which takes on state slogans but cannot be absorbed by state institutions, changes Chinese society from the bottom-up by creating self-reflective new publics.
