This edited collection seeks to map the landscape of contemporary informational interests, to evaluate a range of recognised and putative rights and wrongs associated with modern information societies, and to consider how law, regulation, and governance should be deployed in response. New technologies and new applications constantly disrupt our values, our framing of our world, and our sense of where we are and who we are. In our ‘information societies’, we entertain mixed hopes and expectations, as well as significant fears and concerns. At the root of these, there are a number of informational interests, on the basis of which certain rights are claimed and particular wrongs denounced. This book addresses these interests, considering them as relating primarily to the integrity of the informational ecosystem, to the accessibility, accuracy, and authenticity of public information, and to our individual ability to control the outward and inward flows of information that relates directly to ourselves. Covering a wide range of subjects, the book’s interrogation of our contemporary information society is oriented around two questions: first, whether the information society in which we live is the kind of society that we think it should be and, second, if not, what we can reasonably expect law, regulation, and governance to do in providing the basis for improving it. This book will be of considerable interest to those working at the intersection of law and technology, as well as others concerned with the legal, political, and social aspects of our information society.

The variety, pace, and power of technological innovations that have emerged in the 21st Century have been breathtaking. These technological developments, which include advances in networked information and communications, biotechnology, neurotechnology, nanotechnology, robotics, and environmental engineering technology, have raised a number of vital and complex questions. Although these technologies have the potential to generate positive transformation and help address 'grand societal challenges', the novelty associated with technological innovation has also been accompanied by anxieties about their risks and destabilizing effects. Is there a potential harm to human health or the environment? What are the ethical implications? Do this innovations erode of antagonize values such as human dignity, privacy, democracy, or other norms underpinning existing bodies of law and regulation? These technological developments have therefore spawned a nascent but growing body of 'law and technology' scholarship, broadly concerned with exploring the legal, social and ethical dimensions of technological innovation. This handbook collates the many and varied strands of this scholarship, focusing broadly across a range of new and emerging technology and a vast array of social and policy sectors, through which leading scholars in the field interrogate the interfaces between law, emerging technology, and regulation. Structured in five parts, the handbook (I) establishes the collection of essays within existing scholarship concerned with law and technology as well as regulatory governance; (II) explores the relationship between technology development by focusing on core concepts and values which technological developments implicate; (III) studies the challenges for law in responding to the emergence of new technologies, examining how legal norms, doctrine and institutions have been shaped, challenged and destabilized by technology, and even how technologies have been shaped by legal regimes; (IV) provides a critical exploration of the implications of technological innovation, examining the ways in which technological innovation has generated challenges for regulators in the governance of technological development, and the implications of employing new technologies as an instrument of regulatory governance; (V) explores various interfaces between law, regulatory governance, and new technologies across a range of key social domains.

This book is compiled of selected proceedings from the "Landscapes" Conference held at Turku University, Finland, in July 2005. The themes chosen for the conference – philosophy, ethics and sociological aspects, culture and education; social aspects; politics and regulation; economics and work; technology and emerging technologies – represent many of the perspectives from which to view this landscape. The papers illustrate the diverse impacts of the information society and the changing paradigms within education, law, health care, the workplace and on future societal infrastructures through research initiatives and the development of new technologies. In this book, IFIP WG9.2 has attempted to capture the new ‘emerging landscape’ of the Information Society. A picture of profound technological and social change emerges from this holistic approach. Chris Marsden argues that co-regulation is the defining feature of the Internet in Europe. Co-regulation offers the state a route back into questions of legitimacy, governance and human rights, thereby opening up more interesting conversations than a static no-regulation versus state regulation binary choice. The basis for the argument is empirical investigation, based on a multi-year, European Commission-funded study and is further reinforced by the direction of travel in European and English law and policy, including the Digital Economy Act 2010. The embedding of any new technologies in society is challenging. The evolving state of the scientific art, often-unquantifiable risks and ill-defined developmental trajectories have the potential to hinder innovation and/or the commercial success of a technology. The are, however, a number of tools that can now be utilized by stakeholders to bridge the chasm that exists between the science and innovation dimensions on the one hand, and the societal dimensions on the other. This edited volume will draw together leading researchers from the domains of law, philosophy, political science, public administration and the natural sciences in order to demonstrate how tools such as, for example, constructive technology assessment, regulatory governance and societal scenarios, may be employed by stakeholders to assist in successfully embedding new technologies into society. This volume will focus primarily on the embedding of two emergent and emerging technologies: nanotechnologies and synthetic biology. Government, industry and the epistemic community continue to struggle with how best to balance the promised benefits of an emerging technology with concerns about its potential impacts. There is a growing body of literature that has examined these challenges from various cultural, scientific and jurisdictional dimensions. There is, however, much work that still needs to be done; this includes articulating the successes and failures of attempts to the societal embedding of technologies and their associated products.
