This volume is a tribute to the work of legal and social historian and Arabist Rudolph Peters (University of Amsterdam). Presenting case studies from different periods and areas of the Muslim world, the book examines the use of legal documents for the study of the history of Muslim societies. From examinations of the conceptual status of legal documents to comparative studies of the development of legal formulae and the socio-economic or political historical information documents contain, the aim is to approach legal documents as specialised texts belonging to a specific social domain, while simultaneously connecting them to other historical sources. It discusses the daily functioning of legal institutions, the reflections of regime changes on legal documentation, daily life, and the materiality of legal documents. The documents from the Ḥaram al-sharīf in Jerusalem constitute one of the most important corpora from the pre-Ottoman Middle East covering broad areas of social, political, cultural and economic history. The first documents from the Ḥaram al-sharīf in Jerusalem were discovered in the 1970s and described by Donald Little (Catalogue of the Islamic Documents, Beirut/Wiesbaden 1984). In recent years, approximately 100 new documents have been discovered that are described in this catalogue. This catalogue sets the new corpus in relation to the 'old' corpus and highlights its potential for future scholarship. The main part is a description of all documents, including size, materiality, summary, editions of beginning/end of document as well as a list of personal names, place names and names of witnesses. The volume also includes the edition of ten fascinating documents (five Persian, five Arabic) with high-quality reproductions of the originals. Finally, the volume includes a list of all Ḥaram al-sharīf documents edited so far.

Markets emerge in recent historical research as important spheres of economic interaction in ancient societies. In the case of ancient Egypt, traditional models imagined an all-encompassing centralized, bureaucratic economy that left practically no place for market transactions, as many surviving documents only described the activities of the royal palace and of huge institutions?mainly temples. Yet scattered references in the sources reveal that markets and traders were crucial actors in the economic life of ancient Egypt. In this perspective, this volume aims to discuss the role of markets, traders and economic interaction (not necessarily organized through markets) and the use of “money” (metals, valuable commodities) in pre-modern societies, based on archaeological, anthropological and historical evidence. Furthermore, it intends to integrate different perspectives about the social organization of transactions and exchanges and the different forms taken by markets, from meeting places where exchanges operated under ritualized procedures and conventions, to markets in which profit-seeking activities were marginal in respect with other practices that stressed, on the contrary, community collaboration. The book also deals with social forms of pre-modern exchanges in which trust and ethnic solidarity guaranteed the validity of commercial operations in the absence of formal codes of laws or accepted authorities over long distances (trade diasporas, guilds, etc.). Finally, the volume analyzes a critical aspect of small-scale trade and markets, such as the commercialization of agricultural household production and its impact on the peasant economic strategies. In all, the book covers a diversity of topics in which recent research in the fields of economic sociology, archaeology, anthropology, economics and history proves invaluable in order to analyze the role of Egyptian trade in a broader perspective, as well as to suggest new venues of comparative research, theoretical reflection and dialogue between Egyptology and social sciences. This book shows how political and administrative forces shaped the way justice was applied in medieval Egypt. It introduces the model that evolved during the 7th to the 9th centuries, which involved four judicial institutions: the cadi, the court of complaint (mazalim), the police/shurta (responsible for criminal justice) and the Islamized market law (hisba) administrated by the market supervisor/muhtasib. Literary and non-literary sources are used to highlight how these institutions worked in real-time situations such as the famine of 1024-1025, which posed tremendous challenges to the market supervisors in Cairo. The inner workings of the court of complaint during the 11th-12th century Fatimid state are revealed through array of documentary sources. Further, non-Muslim communities, their courts and their sphere of responsibilities are treated as integral to how justice was dispensed in medieval Islam. Documentary sources offers significant insights into these issues and illuminate the scope and limits of non-Muslims self-rule/judicial autonomy.In sum, the book shows that the administrative and political history of the judiciary in medieval Egypt implicitly and explicitly illuminates broader questions about religious and social forces that shaped the lives of medieval people in the Middle East, Muslims and non-Muslims alike.

A compelling look at the Fatimid caliphate's robust culture of documentation The lost archive of the Fatimid caliphate (909–1171) survived in an unexpected place: the storage room, or geniza, of a synagogue in Cairo, recycled as scrap paper and deposited there by medieval Jews. Marina Rustow tells the story of this extraordinary find, inviting us to reconsider the longstanding but mistaken consensus that before 1500 the dynasties of the Islamic Middle East produced few documents, and preserved even fewer. Beginning with government documents before the Fatimids and paper’s westward spread across Asia, Rustow reveals a millennial tradition of state record keeping whose very continuities suggest the strength of Middle Eastern institutions, not their weakness. Tracing the complex routes by which Arabic documents made their way from Fatimid palace officials to Jewish scribes, the book provides a rare window onto a robust culture of documentation and archiving not only comparable to that of medieval Europe, but, in many cases, surpassing it.
