BOOK EXCERPT:
People are generally aware that legislation is introduced through Bills that are sent to the legislature, usually by the executive, and then passed into law. Few, however, are familiar with the processes that precede the submission of a Bill to the legislature. In fact, what eventually comes to the legislature is the product of long, often laborious processes, which go on for weeks, months and even years. To ensure that the civil servants and others who may be involved in shaping proposals are able to candidly express their views on policies that are being developed and refined, the deliberations on the executive side of government traditionally take place in secrecy. Mainly for that reason, the processes are not well known to the general public and even to some activists who lobby for or against legislation. This book, written by a lawyer who has long experience participating in these processes, gives rare insight into how legislative proposals are conceived, developed and finally written into the law. It also contains easy-to- understand technical information that explains the significance of certain features of statutes. Further, it deals with other matters that follow after enactment including publication, entry into force, application and much more.

BOOK EXCERPT:
Originally published in 1968, this book deals with the process of public legislation in modern Britain at the time, not in terms of constitutional formulae, but by a realistic appraisal of the relationships between the political institutions and forces which gave the process its shape. It concentrates particularly on the procedures and conventions which operated at the preparatory stages of legislation, and established that legislation was almost exclusively a governmental function, Parliament playing only a minor role. It is particularly concerned to stress the extent to which consultation by the government with pressure groups was now a major feature of the legislative process, and concludes that subordinate departmental legislation, developed as a result of collaboration between pressure groups and Civil Servants, was the most characteristic and important stage of the legislative process in Britain. The book brought together the conclusions of recent scholarship in this field, and the result is a balanced perspective of an important decision-making process of British government at the time. Today it can be read in its historical context.

BOOK EXCERPT:
In one of the only accounts of Latino legislative behavior, Stella M. Rouse examines how well the growing Latino population translates their increased presence into legislative influence. Latinos in the Legislative Process explores Latino representation by considering the role of ethnicity throughout the legislative process - from bill sponsorship, to committee deliberations, to floor votes - in seven state legislatures. Rouse first identifies issues that are priorities for Latinos and tells us whether a Latino political agenda exists. She then provides a theoretical framework for ethnicity in legislative behavior and outcomes. Rouse demonstrates that ethnicity is a complex dynamic that plays a variable role in the legislative process. Thus, Latino representation cannot be viewed monolithically.

BOOK EXCERPT:
In the realm of the law of international organizations and treaty law, few commentators have made a more significant contribution than Paul C. Szasz. In his years of distinguished service at the U.N., and in his subsequent career as a prominent consultant to international institutions, he has mastered a highly specialized body of knowledge that allows him to study the inner and outer workings of the international legislative, administrative, and judicial processes with unique and compelling authority. His incisive essays, always deeply informed with first-hand experience, have gone directly to the heart of the most vital international legal issues of our time. This volume gathers twenty-one essays that will be of inestimable value to the entire community of public international lawyers. With penetrating insight Szasz exposes the institutional underpinnings affecting such international law matters as: law-making in international organizations, the obligation to arbitrate, monitoring treaty compliance, UN system "complexification," sanctions, the advisory competence of the World Court, the legal liability of diplomats, peacekeeping intervention, and the role of NGOs. Specific facts and events-such as the U.S. action in the 1988 PLO mission controversy, developments in the safeguards regime of the International Atomic Energy Agency, the Kosovo Conflict, the Dayton Accords, and the Namibian peace process-provide a firm topical basis for the author's analysis of policy, practice, and theory in this little-understood but crucially important area of international governance. Published under the Transnational Publishers imprint.

BOOK EXCERPT:
This book outlines the procedures used in many Commonwealth countries in key areas of the legislative process, especially on the executive side of government. It also covers the procedures in the legislature and the entry into force of different types of legislation. The jurisdictions discussed include the United Kingdom, Canada, Australia and New Zealand, as well as others in Asia, Africa and the Caribbean. The intention is to assist legislative counsel, politicians and students gain a wider perspective of processes in which drafters, civil servants and politicians participate. In this process, the book also lays bare certain procedures that should now be considered international best practice in the Commonwealth. The book is a follow-up to the authors well-received earlier publication The Legislative Process: A Handbook for Public Officials (2009). However, this book considerably expands on the earlier one in terms of the countries and areas covered, as well as the whole approach to the subject.

BOOK EXCERPT:
Much has changed in European constitutional law after the Lisbon Treaty, not least the efforts to increase democratic legitimacy by engaging national legislatures and introducing a stricter subsidiary review process, namely the Early Warning Mechanism (EWM). This collection looks at how national parliaments have adapted to their new roles and looks at how the new system has impacted on relations between the EU legislative bodies and national parliaments. A team of experts from across Europe explore the effect of the EWM on the national constitutional orders; analyse the regional impact of EWM and evaluate the new system of scrutiny.
