The present essay is an attempt to apply the German sociologist Niklas Luhmann's "Social Systems" theory to translation. Luhmann's book unfolds a theoretical view of human society as a closed system. In trying to apply it to translation as a practical communicative complexity, especially from the perspective of a functional model as e.g. the "skopos" theory, certain features discussed in Luhmann will prove to be helpful for a better understanding of the concept of translation, others must be reinterpreted for the present purpose. The "fragments" now published follow Luhmann's considerations as closely as possible, but refrain from drawing detailed parallels to "translation" as a complex system. Prof. Dr. Hans J. Vermeer taught Portuguese and translation theory at the universities of Mainz and Heidelberg. Retired since 1992, he nonetheless continued to accompany the development of translation theories and to teach in various universities abroad. His work comprises (mostly unpublished) lectures and contributions to conferences and publications on Translation Studies, medieval German specialized literature and South Asian languages.

Germany's most prominent social thinker here sets out a contribution to sociology that aims to rework our understanding of meaning and communication. He links social theory to recent theoretical developments in scientific disciplines.

The term ‘systems theory’ is used to characterize a set of disparate yet related approaches to fields as varied as information theory, cybernetics, biology, sociology, history, literature, and philosophy. What unites each of these traditions of systems theory is a shared focus on general features of systems and their fundamental importance for diverse areas of life. Yet there are considerable differences among these traditions, and each tradition has developed its own methodologies, journals, and forms of anaylsis. This book explores this terrain and provides an overview of and guide to the traditions of systems theory in their considerable variety. The book draws attention to the traditions of systems theory in their historical development, especially as related to the humanities and social sciences, and shows how from these traditions various contemporary developments have ensued. It provides a guide for strains of thought that are key to understanding 20th century intellectual life in many areas.

This book demonstrates the empirical gains and integrative potentials of social systems theory for the sociology of law. Against a backdrop of classical and contemporary sociological debates about law and society, it observes judicial review as an instrument for the self-steering of a functionally differentiated legal system. This allows close investigation of the US Supreme Court’s jurisprudence of rights, both in legal terms and in relation to structural transformations of modern society. The result is a thought-provoking account of conceptual and doctrinal developments concerning racial discrimination, race-based affirmative action, freedom of religion, and prohibition of its establishment, detailing the Court’s response to boundary tensions between functionally differentiated social systems. Preliminary examination of the European Court of Human Rights’ privacy jurisprudence suggests the pertinence of the analytic framework to other rights and jurisdictions. This contribution is particularly timely in the context of increasing appeals to fundamental rights around the world and the growing role of national and international high courts in determining their concrete meanings.

As his theory is based on the concept of autopoiesis, the original autopoiesis concept of Maturana and Valdera is shortly demonstrated as well as the way of how Luhmann shaped it into a general autopoiesis concept. This general introduction is followed by a detailed explanation of ideas of Luhmann’s social systems theory. As his theory is communication-based rather than action-based, the element of communication is further explored. Additionally, the social systems of society, organization and interaction are defined whereas the main focus is on society as social system. Within this context, several subsystems of society are explicated together with their appropriate coding, program, medium and function. Furthermore, the idea of structural coupling which can be described as relation between systems and their environments is implemented. After having a complete picture of the theory, the paper focuses on the practical example of Apple and the problems within its supply chain. This scandal is analyzed according to Luhmann’s social systems theory. As a last step, the role of ethics and morality within social systems theory are evaluated on basis of the Apple case. The paper finishes with a critical evaluation of Luhmann’s whole theory which also includes important criticism.

This open access book provides an alternative theoretical framework of irregular migration that allows to overcome many of the contradictions and theoretical impasses displayed by the majority of approaches in current literature. The analytical framework allows moving from an interpretation biased by methodological nationalism, to a more general systemic interpretation. It explains irregular migration as a structural phenomenon or contemporary society, and why state policies are greatly ineffective in their attempt to control irregular migration. It also explains irregular migration as a diversified phenomenon that relates to the social characteristics of the context, and why states accept irregular migrants. By providing new comparative, empirical, qualitative material which allows to start filling an evident gap in the current research on irregular migration, this book is of interest to graduate students, scholars and policy makers.

In the course of their elaboration, we will show that these principles are general – i. e. , that they hold for all organizations. 1. 5 Conceptual Background To describe organizations as social systems conducting experiments and to present principles for designing an infrastructure supporting the “social experiment,” we use concepts from (organizational) cybernetics, social systems theory, and Aristotle’s ethics. In this book, we hope to show that concepts from these traditions – as introduced by their relevant representatives – can be integrated into a framework supporting our perspective on organizations. To this purpose, we introduce, in each of the following chapters, relevant concepts from an author “belonging” to one of these three traditions and show how these concepts contribute to either describing organizations as social expe- ments (in Part I of the book), to formulating principles for the design of functions and organization structures supporting meaningful survival (Part II), or to formul- ing principles for the design of organization structures enabling the rich sense of meaningful survival (Part III). Of course, the relevance of cybernetics, social systems theory and Aristotle’s ethics can only be understood in full, after they have been treated in more detail – but based on what we said above, it may already be possible to see why these theories have been chosen as conceptual background.

In The Emerging Consensus of Social Systems Theory Bausch summarizes the works of over 30 major systemic theorists. He then goes on to show the converging areas of consensus among these out-standing thinkers. Bausch categorizes the social aspects of current systemic thinking as falling into five broadly thematic areas: designing social systems, the structure of the social world, communication, cognition and epistemology. These five areas are foundational for a theoretic and practical systemic synthesis. They were topics of contention in a historic debate between Habermas and Luhmann in the early 1970's. They continue to be contentious topics within the study of social philosophy. Since the 1970's, systemic thinking has taken great strides in the areas of mathematics, physics, biology, psychology, and sociology. This book presents a spectrum of those theoretical advances. It synthesizes what various strains of contemporary systems science have to say about social processes and assesses the quality of the resulting integrated explanations. Bausch gives a detailed study of the works of many present-day systems theorists, both in general terms, and with regard to social processes. He then creates and validates integrated representations of their thoughts with respect to his own thematic classifications. He provides a background of systemic thinking from an historical context, as well as detailed studies of developments in sociological, cognitive and evolutionary theory. This book presents a coherent, dynamic model of a self-organizing world. It proposes a creative and ethical method of decision-making and design. It makes explicit the relations between structure and process in the realms of knowledge and being. The new methodology that evolves in this book allows us to deal with enormous complexity, and to relate ideas so as to draw out previously unsuspected conclusions and syntheses.
