This book brings together three distinct areas of International Law – namely Environmental, Heritage and Ocean Law – to address the international legal protection of historically significant wrecks, with particular focus on the environmental hazards they may pose. The confluence of Heritage Law and the Law of the Sea with International Environmental Law represents an important development in international governance strategies for the twenty-first century, in particular those legal and administrative regimes that concern the world’s oceans and underwater cultural heritage protection. Importantly, connections between international legal regimes, such as the 1982 Law of the Sea, and institutions like the International Maritime Organisation (IMO) and United Nations Education Scientific Cultural Organisation (UNESCO), can play a crucial part in governance strategies that involve the regulation of marine pollution and historic shipwrecks.

This book presents a comprehensive historical analysis of merchant shipping on the high seas and associated shipbuilding under sovereign U.S. jurisdiction from precolonial times to the present. It identifies U.S. policy developments that have affected the merchant marine and shipbuilding industries.

Since the conclusion of World War II, the legacy of militarism and colonialism in areas of Asia has left many unresolved conflicts, dividing parts of the region. This legacy has also contributed to the discourse of contemporary legal issues in the region, including territorial disputes, human rights, the environment, state responsibility, and international trade among others. This volume addresses salient international legal issues that flowed from the legacy of the region's historical experience with colonialism. Launched in 1991, the Asian Yearbook of International Law is a major internationally-refereed yearbook dedicated to international legal issues as seen primarily from an Asian perspective. It is published under the auspices of the Foundation for the Development of International Law in Asia (DILA) in collaboration with DILA-Korea, the Secretariat of DILA, in South Korea. When it was launched, the Yearbook was the first publication of its kind, edited by a team of leading international law scholars from across Asia. It provides a forum for the publication of articles in the field of international law and other Asian international legal topics. The objectives of the Yearbook are two-fold: First, to promote research, study and writing in the field of international law in Asia; and second, to provide an intellectual platform for the discussion and dissemination of Asian views and practices on contemporary international legal issues. Each volume of the Yearbook contains articles and shorter notes; a section on Asian state practice; an overview of the Asian states’ participation in multilateral treaties and succinct analysis of recent international legal developments in Asia; a bibliography that provides information on books, articles, notes, and other materials dealing with international law in Asia; as well as book reviews. This publication is important for anyone working on international law and in Asian studies. The 2019 edition is the Yearbook's 25th volume. To commemorate this achievement, this volume has two reflective articles: the first article presents the history of DILA and its flagship publication, this Yearbook; and the second article provides an overview of the Yearbook's State Practice section beginning with volume 1 to volume 24.

Following successive international legal verdicts, Bangladesh is now an accredited maritime state. Possessing a spacious territorial sea and an extended continental shelf, with a maritime zone almost equalling its land borders, a ‘window of opportunity’ has opened for the country to realise its developmental aspirations. In September 1951, Japan signed a peace treaty with forty-eight countries in San Francisco; in April 1952, the treaty came into effect. The San Francisco Peace Treaty is an international agreement that in significant ways shaped the post–World War II international order in the Asia-Pacific. With its associated security arrangements, it laid the foundation for the regional structure of Cold War confrontation: the "San Francisco System" fully reflected the strategic interests and policy priorities of the peace conference’s host nation, the United States. The treaty fell far short of settling outstanding issues in the wake of the Pacific War or facilitating a clean start for the "post-war" period. Rather, critical aspects of the settlement were left equivocal, and continue to have significant and worrisome implications for regional international relations. This book examines the key developments of the contentious political and security issues in the Asia-Pacific that share a common foundation in the post-war disposition of Japan, particularly the San Francisco Peace Treaty. These include both tangible and intangible issues, such as disputes over territories and "history" problems. Taking the San Francisco System as its conceptual grounding, the authors examine how these issues developed and have remained contentious long after the San Francisco arrangements. To provide bases for producing solutions, the chapters offer comprehensive accounts that explain and deepen our understanding of these complex regional issues and the San Francisco System as a whole.
