European borders that aim to control migration and mobility increasingly rely on technology to distinguish between citizens and aliens. This book explores new tensions in Europe between states and citizens, and between politics, technology and human rights.

This book explores the relevance of Japanese ethics for the field of ethics of technology. It covers the theories of Japanese ethicists such as Nishida Kitarō, Watsuji Tetsurō, Imamichi Tomonobu, Yuasa Yasuo, as well as more contemporary ethicists, and explores their relevance for the analysis of energy technologies, ICT, robots, and geoengineering. It features contributions from Japanese scholars, and international scholars who have applied Japanese ethics to problems in the global condition. Technological development is considered to cause new ethical issues, such as genetically modified organisms fostering monocultures, nanotechnologies causing issues of privacy, as well as health and environmental issues, robotics raising issues about the meaning of humanity, and the risks of nuclear power, as witnessed in the Fukushima disaster. At the same time, technology embodies a hope for mankind, such as ICT improving relationships between human beings and nature, and smart systems assisting humans in leading a more ethical and environmentally friendly life. This book explores these ethical issues and their impact from a Japanese perspective.

The ever-increasing use of technology is challenging the current status of the law, bringing about new problems and questions. The book addresses this trend from the perspective of International law and European Union law and is divided into three main thematic sections. The first section focuses on the legal implications of the use of technology either for law enforcement purposes or in the context of military activities, and examines how this use adds a new dimension to perennial issues, such as the uneasy balance between security concerns and the protection of individual rights, and defining the exact scope of certain State obligations. In so doing, it takes into account a range of current and potential scenarios at the international, regional and domestic level, including the use of killer robots, databases, drones and technology in general to patrol borders, exchange information on criminal suspects, maintain public order, target suspected terrorists and conduct military activities. In turn, the second section examines the role of institutional and non-institutional actors in establishing substantive normative standards for the use of high-tech applications. In this respect, it focuses both on the role that European courts have played so far, and on how other actors’ initiatives can contribute to the construction of a new legal framework for technology-related activities. Lastly, the third section has a two-fold focus: the first part investigates how the increasing reliance on technology is affecting traditional rules on international responsibility, and is challenging, in particular, the attribution of wrongful conduct to States and international organizations. The second part addresses issues of jurisdiction and justiciability. Given the scope of its coverage, this timely book addresses an important lacuna in the current legal scholarship, exploring some of the most recent applications of technology and the legal issues arising as a result. Readers will gain novel insights into the challenges posed to International law and European law by the growing reliance on technology, taking into account both its uses and misuses.

The Migration Mobile offers an account of the very different technologies implicated in border crossing and migration management. Borders have been sites of contestations and struggles over who belongs and who does not, who is and is not allowed to move freely in transnational or national spaces. Embedded as they are in the bordering process, policing and security practices produce the irregularity and illegitimacy of the migrating subject. At the same time, border practices simultaneously imply processes of dissidence and resistance. Border infrastructures and resistance to bordering practices refer to dynamic and complex interactions between migrants and non-human others, technologies at the borderland and elsewhere. Border guards, EU officials, Frontex officers, activists, NGOs and solidarity networks configure both hybrid alliances of humans/nonhumans and new virtual and urban spaces in order to enforce or resist bordering. Through analyses of empirical cases drawing from the European border regimes the book investigates how technologies employed by states and EU border agencies configure the border regimes; how spaces of migration are configured through uses and re-uses of high-tech technologies; and finally on how the border regimes and ‘the border industrial complex’ are contested reconfigured by the use of ICT by migrants and solidarity networks.

This book examines the management of migratory flows in the Mediterranean within an international security perspective. The intense migratory flows registered during the year 2015 and the tragedies in the Mediterranean Sea have tested the mechanisms of the Union’s immigration and asylum policies and its ability to respond to humanitarian crises. Moreover, these flows of varying intensities and geographies represent a threat to the internal security of the EU and its member states. By using Spain and Italy as case studies, the author theorizes that the EU, given its inability to adopt and implement a common policy to effectively manage migratory flows on its Southern border, uses a deterrence strategy based on minimum common denominators.

This book looks at the background to the policy of free movement in Europe and discusses the consequences. European integration changed migration conditions considerably: Under the concept of "freedom of movement", border crossings between EU member states as well as work and settlement by nationals of other member states were largely facilitated; internal borders thus lost their significance. At the same time, the question of how to deal with a common external border and the migration of "third-country nationals" gained in importance. The essential explains why migration from outside Europe was increasingly understood as a problem of security policy and why this still determines the measures for designing a common external border today.
