This book explores the exportation and application of European Union legislation beyond EU borders. It clarifies the means and instruments of the voluntary application of the EU’s norms by third countries and analyses in detail the process of legislative approximation between the EU and its East European neighbours. It also assesses the extent to which the EU is successful in promoting its legal standards abroad. The first part of the book addresses the EU’s mechanisms and instruments promoting the export of its own laws and practices to other countries. Key issues include the post-Lisbon constitutional basis for the EU’s engagement with its Eastern neighbours (Art. 8 TEU); the different methods of acquis export and the impact of a new generation of Association Agreements providing for the establishment of Deep and Comprehensive Free Trade Areas (DCFTAs) and, ultimately, a Neighbourhood Economic Community (NEC) between the EU and its Eastern partners. The second part of the book includes substantive country reports that analyse the process of legislative approximation and application of EU law in the Eastern Partnership countries and Russia, authored by leading academics from the countries concerned. While currently these countries are not working towards full EU membership, the EU encourages them to approximate and converge their legislation with the EU acquis. The book also offers a unique picture of current practice of the application of EU law by judiciaries in the countries of the Eastern Partnership and Russia. The book concludes with reflections on the multi-faceted character of legislative approximation and the challenges surrounding the application of EU law in the EU’s Eastern neighbourhood. The conclusions reached are highly informative as to the effectiveness of present and future EU external regional policies aimed at the promotion of EU common values and EU legislation into the legal orders of third countries.

In The EU-Ukraine Association Agreement and Deep and Comprehensive Free Trade Area, Guillaume Van der Loo provides the first comprehensive legal analysis of this complex and controversial international agreement. While key political and legal hurdles towards the signing and conclusion of this agreement are analysed, its scope and contents are scrutinised and contrasted to other international agreements concluded by the EU. Specific attention is devoted to the ambitious “deep and comprehensive free trade area” and the unique provisions related to Ukraine’s approximation to the EU acquis. In particular, this book explores to what extent the agreement can be considered a new legal instrument for ‘EU integration without membership’.

This book offers a legal analysis of the European Neighbourhood Policy (the ENP) as it applies to developing relations with the EU's neighbours. It explores the legal aspects of this policy, including ENP competence matters, institutional arrangements and substantive policy issues, using international relations theory as the starting point in defining the EU's role as a political actor. The book focuses on the adequacy of the ENP legal framework for transposing the EU's democratic values and upholding its political image. In this connection, the book also features an analysis of EU democratic values as they are intended to be understood by its neighbours. The relevant legal framework of this policy and its implementation in the states of the South Caucasus (Georgia, Armenia and Azerbaijan) is evaluated, revealing the effects of the ENP in their democratic processes and the shortfalls of the ENP conditionality.

This book examines the European Neighbourhood Policy (ENP) in the context of internal functions performed with regard to the European Union (EU) political system and its key actors. It argues that the ENP has been formulated not only in reaction to external challenges and threats, but also in response to EU internal legitimacy needs at systemic, institutional and actor level. Looking beyond governance approaches and the power of norms, this book follows a sociological approach to the politics of legitimation. Using Bourdieu's field theory, it bridges the rationalist-constructivist divide inherent in much of ENP scholarship. While analyzing articulations of EU institutions in terms of narrative production, reproduction and reconstruction, it sheds valuable light on where the conflicting goals, ambiguity and incoherence stem from. By highlighting Developing Nations' responses and usages of ENP narratives for domestic and international legitimacy-seeking, the book calls for a more outside-in perspective on EU foreign policy. With the European integration project being increasingly contested, both internally and externally, this book provides a timely focus on the topic of legitimation and delegitimation dynamics with regard to EU foreign policy. The literature on the European Union influence’s in its Eastern neighbourhood has tended to focus on EU-level policies and prioritize EU-related variables. This book seeks to overcome this EU-centric approach by connecting EU policy transfer to the domestic and regional environment in which it unfolds. It looks at the way in which the EU seeks to influence domestic change in the post-Soviet countries participating in the European Neighbourhood Policy/Eastern Partnership and domestic receptivity to EU policies and templates. It seeks to disentangle the various dynamics behind domestic change (or lack thereof) in Eastern Partnership countries, including EU policy mechanisms, domestic elites’ preferences and strategies, regional interdependences and Russia’s policies. Based upon extensive empirical investigation on EU policies in four countries; Armenia, Georgia, Moldova and Ukraine – and in two pivotal policy sectors - the book provides systematic and nuanced understanding of complex forces at work in the policy transfer process. This text will be of key interest to scholars and students of international relations, European studies, democratization studies, and East European Politics and area studies, particularly post-Soviet/Eurasian studies.

The EU continuously searches for more effective policy towards its eastern neighbourhood, which is reflected in the on-going adaptation of its existing approaches, discourses and policy strategies to the new challenges of its external environment. In order to understand the complexity and limitations of the EU framework under the European Neighbourhood Policy (ENP) and the Eastern Partnership Initiative (EaP) – that is, to consider the interface between policy instruments, institutional structures, and multiple agents – one needs to adopt an original analytical perspective of practices to comprehensively assess the policies’ outcomes. This volume therefore offers an examination of social practices as implemented through the use of policy instruments and subsequently embedded into the existing/emergent social structures which shape and determine the EU-neighbours’ relations. To gauge success of the ENP in the eastern region, the manuscript pulls together a rich collection of geographical and thematic case-studies, joined by the overarching conceptual framework of practices. This study’s principal aims are to discern patterns of social practices which guide agents’ interactions in different policy areas; to explore the origin and effect of these practices (the role of dominant discourses, logistical imbalances, deliberate strategies, etc.); and to explicate the nature of the emerging social structures being established in the eastern region. This approach is distinctive from other constructivist undertakings as it allows to synergise the meanings of social actions (through the focus on agents and instruments), and their structural extensions (through the focus on emergent structures) across geo- and bio-political localities of the EU and its eastern neighbourhood. This book explores power in international relations, in a world characterized by the growing competition of major powers for smaller nations. Focusing on the major powers and smaller countries of Eurasia, it argues that power in international relations is different from coercion and is rather a social contract between a leader state and follower states where reciprocity is key and where leadership relationships cannot be adequately explained by focusing solely on the leader. It challenges the perception that genuine regional leadership is quite common, contending instead that it is rare; that much more often major powers make claims for leadership; and that regional leadership does not indicate the status of a particular state, but rather the social role of the leader, which is recognized by its followers, a role which is always relative and based on communication and constant interaction with followers. The book highlights the important role followers play in recognizing regional power, the importance for a state's regional leadership strategy in creating and holding a valuable position attractive for followers and delivering greater value to followers compared to other potential leaders.
